Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant reviewed the location of his property, the parcel, Lot 2, he intends to buy from
the current property owner. He noted incorporating the new lot into his property will help
him square off his lot and place his driveway solely on his lot.
Staff reviewed the submitted Plat of Survey, noting the property is within two miles of the
City limits, and is being jointly reviewed by the County and City. Staff noted that the lot area
requirement of 5,000 square feet is being requested to be waived for Lot 2. Staff did not
object to waiving the lot area as the applicant's driveway bisects the lot and the lot does not
have sufficient lot area to construct a home.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot area for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey Hancock Subdivision, Dubuque County
INTRODUCTION
The submitted Plat of Survey of Hancock Subdivision is located in Dubuque County
along Key West Drive near St. Joseph's Church. The submitted Plat of Survey is within
two miles of the city of Dubuque, and is being jointly reviewed by the City and Dubuque
County.
DISCUSSION
The submitted Plat of Survey of Hancock Subdivision subdivides an existing 6,271
square foot parcel into two parcels to facilitate the sale of Lot 2 to the adjacent property
owners, Mark A. and Pauline A. Hancock.
The submitted Plat of Survey is being reviewed by the Zoning Advisory Commission
because the newly created Lot 2 will not have sufficient lot area as required by Section
16-11-14 of the Unified Development Code. Lot 2 will be utilized only for a driveway
access to Key West Drive.
Planning staff does not object to the waiving of the lot area requirement for Lot 2
because of its small size and shape, and the lot is not buildable. The driveway already
exists providing access to Key West Drive from the property owned by the Hancock's.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Plat
of Survey of Hancock Subdivision and recommend approval of the Plat of Survey
subject to waiving the lot area requirement for Lot 2.

RESOLUTION APPROVING THE PLAT OF SURVEY OF HANCOCK SUBDIVISION IN DUBUQUE
COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of Hancock Subdivision in
Dubuque County, Iowa; and
Whereas, said Plat of Survey provides 1,021 square feet of lot area for Lot 2, where 5,000
square feet of lot area is required by Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission and had
its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Section 11-14 of Title 16 of the Code of Ordinances, Unified Development Code,
is waived to allow 1,021 feet of lot area for Lot 2.
Section 2. That the Plat of Survey of Hancock Subdivision is hereby approved and the Mayor and
City Council are hereby authorized and directed to endorse the approval of the City of Dubuque,
Iowa upon said Rat of Survey.
