Cdy(1~snF~ MINUTES OF HOUSING CODE APPEALS BOARD DATE: 20 March 2007 TIME: 4:30 p.m. PLACE: Housing and Community Development Department Chairperson Bob Schaub called the meeting to order at 4:30 p.m. following staff assurance of compliance with Iowa Open Meeting Law. Board Members Present: Tom Swift Bill Kinsella David Young Sandra Moore Robert Schaub Board Members Absent: Jim Matheos Staff Present: Kathy Lamb Crenna Brumwell Tom Smith Roger Benz Review and Certification of Minutes of 21 November 2006 Housing Code Appeals Board Meetin Bill Kinsella motioned to certify the minutes. Tom Swift seconded. Sandra Moore abstained. Motion passed. Sandra had a question regarding an agenda item that was tabled at the November 21St meeting regarding Roger Richard - 1513 Washington Street. Has this been taken care of or did it need to be addressed. Kathy responded that this was still an open inspection, however, Mr. Richard's unit is no longer a Section 8 unit, so the time schedule issue has changed. Correspondence/Public Input Budget Preparation-Conflicts of Interest It appears that this does not apply to this board. It reminds boards and commissions that if they have a conflict of interest, they need to remove themselves from the discussion and vote on cases that would present a conflict of interest. Crenna Brumwell was introduced as the City's Assistant Attorney. Metal Fire Escape Inspection Procedures A memorandum was received and reviewed requiring engineering analysis of deteriorated metal fire escapes. There was a question regarding the issue of rust. It was noted that if there is rust, a structural inspection would be initially required and then reviewed every five years. A suggestion was made to substitute the word "deterioration" for the word "rust". It was also suggested to include information on handrails and guardrails with information mailed to owners. Consent Agenda The consent agenda items are considered to be routine and non-controversial and all consent items will be normally voted upon in a single motion without any separate discussion on a particular item. The following extensions were approved: Executive Management, agent for 1373 Iowa -extension to 5/1/07. Lori Nelson, agent for 3520 Pennsylvania -extension to 5/15/07. Margie White, agent for 1503-1503%2 Prescott -extension to 6/1/07. Sandra Moore motioned to approve the consent agenda. Tom Swift seconded. Motion passed 5-0. ALL DEFICIENCIES AND MOTIONS ARE IN ACCORDANCE WITH THE DUBUQUE RESIDENTIAL HOUSING CODE UNLESS OTHERWISE STATED. EXTENSIONS OF TIME ARE GRANTED IN ACCORDANCE WITH SECTION 26-9.(f)(1) AND VARIANCES ARE GRANTED IN ACCORDANCE WITH SECTION 26-9.(f)(2). New Business CASE #1 Judge Properties, agent for 1003-1005 Bluff Street, is requesting an extension of time until June 15, 2007, to complete exterior repairs: soffit, fascia, stucco, peeling paint, rotted wood, repair stairs and add guardrail. This is a S8 Initial inspection. IT WAS SUGGESTED TO TABLE. THIS ITEM UNTIL THE NEXT MEETING AND A CURRENT INSPECTION OF THE PROPERTY CAN BE PERFORMED. BILL KINSELLA MOTIONED THIS ITEM BE TABLED. DAVID YOUNG SECONDED. MOTION PASSED 5-0. CASE #2 Ted Stackis, owner of 324 Kaufmann Avenue requested an extension of time until July 1, 2007 to complete exterior repairs. This is a S8 Initial inspection. BILL KINSELLA MOTIONED TO GRANT THE EXTENSION OF TIME UNTIL JULY 1, 2007, TO COMPLETE EXTERIOR REPAIRS. SANDRA MOORE SECONDED. MOTION PASSED 5-0. CASE #3 Bruce and Julie Berstler, owners of 750 Kirkwood, requested a variance on the room size and ceiling height. The second floor left bedroom is deficient required light and ventilation. The light needed is 19.52 square feet. The light provided is only 11.10 square feet, making the light short by 8.42 square feet. Ventilation required is 9.76 square feet. The ventilation provided is only 7.20, making the ventilation short by 2.56 square feet. This room is also only 6'11" in height. This is a 1" variance in the required 7' ceiling height and the requirement has been granted. The back bedroom is only 6' in one dimension and thus does not meet the minimum requirement of 7' in length and width. This is a General Housing inspection. SANDRA MOORE MOTIONED TO APPROVE THE VARIANCE DUE TO PRACTICAL DIFFICULTIES OR UNNECESSARY HARDSHIPS IN CARRYING OUT THE STRICT LETTER OF THE ORDER. DAVID YOUNG SECONDED. MOTION PASSED 5-0. CASE #4 J Thomas Zaber, owner of 1005 Locust Street Apt. L2, requested a variance on window sill height, light and ventilation. The light needed is 19.52 square feet. The light provided is only 18.45, making the light short by 1.07 square feet. Ventilation required is 9.76 square feet. The ventilation provided is only 9.37, making the ventilation short by 0.39 square feet. Window sill height is not a violation as there are several direct exits to the outside from the apartment. This is a S8 Initial inspection. TOM SWIFT MOTIONED TO APPROVE THE VARIANCE DUE TO PRACTICAL DIFFICULTIES OR UNNECESSARY HARDSHIPS IN CARRYING OUT THE STRICT LETTER OF THE ORDER. BILL KINSELLA SECONDED. MOTION PASSED 5-0. CASE #5 Vance Delire, owner of 1921 Madison Street requested the Order of the Housing Officer be reversed. This is a General Housing inspection. TOM SWIFT MOTIONED TO DENY THE REQUESTED FOR REVERSAL OF THE ORDER. SANDRA MOORE SECONDED. MOTION PASSED 5-0. INFORMATION SHARING Dave Stuart, agent for 1511 Bluff Street requested the Order of the Housing Officer be reversed. This is a General Housing inspection.
