Dear Chairpersons, Mayor and President:
The City of Dubuque Board of Review recently was advised that 13 property
assessment appeals were withdrawn by the taxpayer at the Property Assessment
Appeal Board (PAAB) for the 2013 and 2014 assessment years. The appeals involved
Dollinc LLC (the taxpayer).
The Dollinc appeals involve four condominiums on Hawkeye Drive (820, 822, 824, and
826), five apartment buildings on Hawkeye Drive (811, 830, 840, 850, and 860), three
apartment buildings on Wildwood Drive (2950, 2975, and 2985), and an apartment
building at 3260 Raven Oaks. All of these properties were protested for both the 2013
and 2014 assessment years.
The four condominiums each have an assessed value of $100,730 for both the 2013
and 2014 years. The nine remaining apartment buildings have a total assessed value of
$3,294,444 for 2013 and a total assessed value of$3,628,970 for 2014.
In its protests to the Board of Review, the taxpayer requested an assessed value of
$55,402 for each of the condominiums for both 2013 and 2014. The taxpayer requested
a 2013 total assessed value of $1,892,409 for the nine apartment buildings. The
petitioner also requested that the 2014 apartment assessed values be reduced to
$1 ,986,257.
The Board of Review denied the taxpayer's protests in May of 2013 and also in May of
2014. The taxpayer filed an appeal to the PAAB for both the 2013 and 2014
assessments.
The Board of Review was comfortable with the assessments on the properties and had
reserved an appraiser in case the appeals proceeded further. The Board of Review had
prior appraisals that supported the values on the apartments and condominiums.
The taxpayer, represented by Richard Millspaugh of the Kansas City firm of Savage and
Browning, withdrew its appeals on November 19, 2014.
If the taxpayer had been successful on its appeals for 2013, the total taxes lost to all
taxing bodies would have been $47,308. The total taxes lost to all taxing bodies for the
2014 assessments would have been $52,224.
The City Attorney's office and the City Assessor's office spent many hours preparing
documents and files for the hearings with PAAB which were scheduled for December 3,
2014. We are pleased to advise you no tax dollars will be lost for the 2013 and 2014
assessment years. This will end the 100 appeals we received from the same owner for
2013 and 2014.
We have one appeal remaining with PAAB for 2013 and 2014 with a different taxpayer.
