RESOLUTION APPROVING THE FINAL PLAT OF HENSCHEL-MCNAMER PLACE
PLAT # 3
Whereas, there has been filed with the City Clerk a Final Plat of Henschel-McNamer
Place Plat #3 in the City of Dubuque; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and its
approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 to have 0 feet of frontage, where 50 feet of lot fron#age is required.
Section 2. That the Final Plat of Henschel-McNamer Plat #3 is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City
of Dubuque, Iowa upon said Plat of Survey.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Nick Lange, Buesing & Associates, represented the applicant. He discussed the request to
subdivide the property.
Staff reviewed the request noting that Lot 1 would not have frontage on a platted, public or
private street, but be served by an easement.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate, noting
that Lot 1, while having no frontage, is served by a platted easement.
Recommendation
By a vote of 5 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving lot frontage requirements for Lot 1.
Asimple-majority vote is needed for the City Council to approve the request.

SUBJECT: Final Plat of Henschel-McNamer Place, Plat #3
INTRODUCTION
The submitted Final Plat of Henschel-McNamer Place, Plat #3, resubdivides existing
property to facilitate the transfer of property from Thomas L. and Sheri A. Henschel to
North Cascade Road Developers/Marty McNamer. The property transfer facilitates
development of the second phase of Timber-Hyrst Estates Subdivision.
DISCUSSION
The submitted Final Plat of Henschel-McNamer Place, Plat #3, resubdivides Lots 1 and
2 and Henschel-McNamer Place, Plat #2. The submitted final plat creates three lots
with Lot 1 not having frontage on a public or private street. An existing access
easement provides access to Lot 1 and is dated December 3, 2001. Lot 2 has frontage
on Miller Road and Lot 3 has frontage on Creek Wood Drive, the street serving the first
phase of Timber-Hyrst Estates Subdivision.
Planning staff does not object to waiving of lot frontage for Lot 1, as the parcel has an
existing ingress and egress easement, and is adjacent to property currently owned by
the Henschels, which does have frontage on Miller Road.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the
submitted Final Plat of Henschel-McNamer Place, Plat #3, as it is in substantial
compliance with the City of Dubuque Subdivision Regulations, subject to waiving the lot
frontage requirement for Lot 1.
