Public Works Director Mike Koch is recommending resolution of two issues related to
the assessments on the White Street Reconstruction Project. The original assessments
presented to and discussed with the property owners at a meeting with City staff were
inadvertently calculated at a 15% discount from the normal paving assessment level.
Even though this was done in error, City staff is asking for City Council concurrence in
establishing the actual assessments at that level, and holding the public headng, which
has already been set for February 18, 2002. This 15% error represents $51,158, which
would now be absorbed in the project as a City expense. This is an extremely
complicated project, and we think it is fair to the property owners to proceed with the
estimated assessments that they were already presented. Of course, this does not
preclude their assessments going down should we receive favorable bidding through
the public bidding process.
In the matter of five property owners who did not receive notice for their sidewalk
assessments and four property owners who were not included in the assessment
schedule for their sewer laterals, Public Works Director Mike Koch is recommending
that a separate public hearing be set for March 4, 2002, to consider approval of these
assessable components of the project.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

BACKGROUND
The following resolutions are intended to correct errors which were made in the
assessment schedule adopted by Resolution No. 554-01, dated December 17,
2001, and further errors which were incorporated into Resolution No. 23-02,
dated January 21,2002.
The first schedule provided for correct assessment amounts for each category of
work, but it was later determined that the total did not add correctly.
Therefore, in order to correct these errors, Resolution No. 554-01 was rescinded,
and a new Preliminary Schedule of Assessments was adopted. The closing of
the public hearing was then delayed until February 18, 2002, to allow corrected
notices to be mailed. In addition, it was later learned that the paving
assessments were calculated approximately 15% too Iow based upon the City's
paving assessment policies.
Without realizing it, the second Schedule of Assessments increased the amount
for the paving assessments to correct the errors contained in the first Schedule of
Assessments. The total amount for the paving assessments was then increased
from $366,919.83 to $418,078.05, a difference of 15%, or $51,158.
In order to proceed with the award of a contract for the street paving project and
approve the special assessments at the public headng of February 18, 2002,
there are two options available.
The options are to keep the original improperly Iow paving assessments or to
rescind Resolution No. 23-02, dated January 21, 2002, and increase the
assessment amounts which were mailed to the property owners for the public
hearing. This would require that new notices be mailed and action to adopt the
assessments again be deferred, this time until the March 4, 2002 Council
meeting.
DISCUSSION
It is my opinion that the City should honor the original paving assessment
amounts, even though they are approximately 15% too Iow. This is the amount
which was mailed to the property owners for discussion at the public meeting
with City staff and for the City Council public hearing. Staff made it very clear to
those in attendance at the staff meeting that their assessments would not rise as
the project progressed, but that they could be lowered because of a Iow bid or
ease of construction. Raising the paving assessments would make it appear that
City staff misled the property owners at the meeting; and I feel strongly that the
assessments not be raised and that the street paving project absorbs the
$51,158 error. There are two options on how to proceed at this point.
Option 1.
If the City Council chooses to raise the paving assessments, Resolution No. 23-
02 should be rescinded and a totally new Schedule of Assessments correcting all
previous errors should be adopted. New notices would need to be mailed to all
property owners, all which would be higher than their original notices. Notices
would also need to be mailed to 5 property owners who did not receive notice for
their sidewalk assessments and 4 property owners who were not included in the
assessment schedule for their sewer lateral assessments. A public hearing on
these revised assessments would be held on March 4, 2002.
Option 2.
If the City Council chooses to keep the paving assessments at their original
amount sent to the property owners, Resolution No. 23-02 should be amended to
reduce the paving assessments by $51,158; and the assessments can be
approved at the scheduled February 18, 2002 public hearing.
New letters would not need to be mailed to the property owners except for 9
property owners who did not receive proper notice the first time. These 9
assessments would be set for a public hearing on Mamh 4, 2002.
RECOMMENDATION
I recommend that Resolution No. 23-02, dated January 21,2002, be amended to
reduce the special assessments and that a new Preliminary Schedule of
Assessments be adopted for the 9 property owners left off of the original
assessments, for consideration at the March 4, 2002 meeting.
ACTION TO BE TAKEN
The attached resolution adopting a revised Preliminary Schedule of Assessments
on the White Street Reconstruction Project be adopted, and that a public hearing
be scheduled for March 4, 2002 for 9 properties not previously assessed through
adoption of the enclosed resolutions.

RESOLUTION AMENDING PRELIMINARY SCHEDULE OF ASSESSMENTS
FOR THE WHITE STREET RECONSTRUCTION - 21sT TO 32ND STREET
PROJECT
Whereas, the City Council passed Resolution No. 23-02, dated January 21,
2002, approving the Preliminary Schedule of Assessments for the White Street
Reconstruction - 21st to 32nd Street Project.
Whereas, it has been determined that the Schedule of Assessments contained
errors which need to be corrected by reducing the amount of the street paving
assessments.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the following amendments reducing the street paving assessments, as
shown on the attached sheets, be made to Resolution No. 23-02, Preliminary Schedule
of Assessments, for the White Street Reconstruction -21St to 32nd Street Project.

RESOLUTION NO. 47-02
RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the City
Council of the City of Dubuque and are now on file in the office of City Clerk showing
among other things the plans, specifications, form of contract, estimated cost and
preliminary plat and schedule showing the amount proposed to be assessed against
each lot and the valuation of each lot as filed by the City Council, for the White Street
Reconstruction Project - 21st to 32nd Street - Supplemental Assessments to Resolution
No. 23-02.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements, and unless property owners at the time of
the final consideration of this proposed resolution have on file with the City Clerk
objections to the resolution of necessity, they shall be deemed to have waived all
objections pertaining to the regularity of the proceeding and the legality of using the
special assessment procedure.
Said improvements shall be constructed and done in accordance with the plans
and specifications which have been approved by the City Council and now on file with
the City Clerk. That the cost and expense of making such improvement will be
assessed partially or totally against privately owned property lying with the assessment
limits, and in an amount not to exceed that provided by law, and in proportion to the
special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from the
Sanitary Sewer Fund, Watermain Construction Fund, Local Option Sales Tax Fund, and
the Street Construction Fund, and special assessment bonds may be issued in
anticipation of deferred payments of assessments when a contract has been performed
and accepted, and the proceeds thereof used to pay the contractor.
The above resolution was introduced, approved and ordered placed on file with
the City Clerk this day of ,2002.

FIXING DATE OF HEARING ON RESOLUTION OF NECESSITY
Whereas, the City Council of the City of Dubuque, Iowa, has given its preliminary
approval on the proposed plans, specifications and form of contract and placed same
on file in the office of the City Clerk for public inspection, for the White Street
Reconstruction Project - 21st to 32nd Street - Supplemental Assessments to Resolution
No. 23-02; and,
Whereas, the proposed Resolution of Necessity for said improvement has been
introduced and is now on file in the City Clerk's office for public inspection.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That on the 4th day of March, 2002, a public hearing will be held at 6:30 o'clock
p.m. in the Public Library Auditorium in the City of Dubuque at which time the owners of
property subject to assessment for the proposed improvement or any other person
having an interest in the matter may appear and be heard for or against the making of
the improvement, the boundaries of the district, the cost, the assessment against any
lot, or the final adoption of a resolution of necessity and the City Clerk be and is hereby
authorized and directed to cause a notice of time and place of such hearing to be
published in a newspaper having general circulation in the City of Dubuque, Iowa, which
notice shall be published once each week for two consecutive weeks, the first
publication of which shall be not less than ten days prior to the day fixed for its
consideration. Unless property owners at the time of the final consideration of this
proposed resolution have on file with the City Clerk objections to the Resolution of
Necessity they shall be deemed to have waived all objections thereto.

That the attached sheets, 1 to 1 inclusive, are hereby determined to be the
schedule of proposed assessments for the White Street Reconstruction Project - 21et
to 32nd Street- Supplemental Assessments to Resolution No. 23-02 and the valuations
set out herein are hereby approved.

NOTICE TO PROPERTY OWNERS
Notice is given that there is now on file for public inspection in the office of the
City Clerk of Dubuque, Iowa, a proposed Resolution of Necessity, an estimate of cost,
and a plat and schedule showing the amounts proposed to be assessed against each
lot and the valuation of each lot within a district approved by the City Council of
Dubuque, Iowa, for an improvement of the type(s) and in the location(s) as follows:
White Street Reconstruction - 21st to 32nd Street
Reconstruction of 11 City blocks with new sanitary sewer with Portland cement
concrete; and replacement of sewer laterals and lead water services
That the proposed district to be benefited and subject to assessment for the cost
