PRESENT:
Chairperson Mike Ruden; Board Members Randy Klauer, Jim Ureli, Bitt
Gasper and Fred Beeler; Staff Members Guy Hemenway and Wally
Wemimont
ABSENT: None.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the
meeting was being held in compliance with the Iowa Open Meetings Law.
CALL TO ORDER: The meeting was celled to at 4:00 p.m.
DOCKET 001-02: Application of Trent Marting/Merlan Marring for a special exception for
property located at 390 Mississippi View Drive to build an addition/garage 6 feet from the
front property line, 20 feet required, in an R-2 T~3-Family Residential zoning district.
Heidi Marring, 390 Mississippi View Drive, described the project, the property and
requested setbacks, and the setbacks of adjacent residences. She stated that the garage
woutd be buitt 18 feet f~om the pavement and would not block sight visibilitY from adjacent
properties. She said she wants to maintain living space on the main floor for potential
handicapped accessibility. She said she has spoken with her neighbors and they support
the project. She referenced the staff report regarding her proposal.
The Board discussed the property layout. Mark Gudenkauf, contractor for Heidi Matting,
said he is willing to answer any technical questions regarding the project.
Staff Member Wemimont reviewed the staff report, stating that the porch will be open and
that there will be 18 feet between the garage and the paved portion of the street.
Boe.,'d Men-a)ers discussed the project and felt it would have very limited impact on
adjacent properties or public safety.
Motion by Gasper, seconded by Urell, to approve the special exception request with the
condition that the front porch not be enclosed. Motion was approved by the following vote:
Aye - Klauer, Urell, Gasper, Beeler and Ruden; Nay - None.
DOCKET 002-02: Application of Milton & Judith Boyes for a special exception for property
located, at 3186 Erie Court to build an 18 foot by 22 foot attached garage, 10 feet from the
front property line and 2 feet from the west side proper~ line, 20 feet and 6 feet required
respectively, in an R~I Single-Family Residential zoning district.

Milton Boyes, 3186 Erie Court, outlined his request for the Board. He said that his lot is
small and he could not initially afford to build a large garage. He stated now he wants to
add a garage so that he can stay at this location. He said that adjacent residential
property at the comer of Erie Court and Tyler Lane is set back 10 feet from the front
pmpertyline. Hesaldthe purpose fer the garege is to store two new show cars. Hestated
he built an addition at the back of his residence five years ago.
The Board discussed the proposed setbacks for the project and the setbacks of adjacent
structures. They also discussed curb cuts for properties along Erie Court and Tyler Lane.
Board Members were concerned that a vehicle pa~rkad in the front driveway would block
pedestrian access along the sidewalk. Board Member Gasper felt that a garage projecting
into the front yard was not consistent with adjacent residences, and would have a negative
impact on said properties.
Chairperson Ruden stated that he felt the garage would have little negative impact on
adjacent properties and that pedestrian traffic on the cul-de-sac would be light.
Motion by Gasper, seconded by Klauer, to approve the special exception request as
submitted. Motion was denied by the following vote: Aye - Ruden; Nay- Klauer, Urell,
Gasper, and Beeler.
DOCKET 003-02: Application of Lynn & Marilyn Michels for a cond~onal use permit for
property located at 990 White Street to develop a 22-space auto sales lot in a C-4
Downtown Commercial zoning district.
Lynn Michels presented his request to the Board. He stated that Stacey Rockwell from the
Iowa Department of Transportation has reviewed and approved his Site plan. He said that
the display vehicles would be located on the ~ side of his existing parking lot. He
stated that he will widen his access driveway from White Street to the parking lot.
Staff Member Hemenway explained the site plan layout. He explained that the five spaces
located off the alley are for employee and customer parking. Mr. Michels asked if he may
display some vehicles next to the shop. Staff Member Hemenway said that there is a need
to maintain parking spaces for employees and customers. Board Members discussed the
location of the display area along the south property line and inquired as to the use of the
property south ofthe subject lot. Board Member discussed potential circulation ofvehicles
onto the adjacent property. Board Members discussed the possibi{i~y of placing a ~
along the south property line to prevent vehicles from pulling onto the neighboring
property.
Staff Member Hemenway explained the reasoning for requiring a fence, stating that it
would confine vehicle circulation and other activity associated ~ the car lot to lhe subject
property. Staff Member Hemenway reviewed the staff report, explaining the site plan
review undertaken by the Engineering and Planning Departments. Board Members

dis~ the style and type of fence that would be appropriate along the south property
line.
Motion by Gasper, seconded by Urell, to approve the conditional use permit with the
following conditions:
t. A four-foot fence be placed along the south property line.
2. The car lot be limited to 22 display vehicles.
3. Parking areas for employees, customers and display vehicles be striped.
Motion was approved by the following vote: Aye - Urell, Gasper, Beeler and Ruden;
Nay - None; Abstain - Klauer.
I~INUTES & NOTICES OF DECISION; The minutes of the December 20, 2001 meeting
and Notices of Decision for Dockets 101-01,102-01,103-01 and 104-01 were approved as
submitted.
