This is a claim in which the claimant states its insured, Samuel Ellerbeck lost control of
his vehicle on Sheridan Road, striking the vehicle of Earl Hinzman. Claimant feels this
was partly due to the roadway being covered with rocks. For this reason, claimant
states that the City of Dubuque should share responsibility for the vehicle damage to its
insured, Samuel Z. Ellerbeck's vehicle, and also for the vehicle damage and personal
injury of Earl Hinzman.
This claim has been referred to Public Entity Risk Services of Iowa, the agent for the Iowa
Communities Assurance Pool.
