The application, staff report and related materials are attached for your review. Discussion Chairperon Norton removed himself due to a conflict and turned the meeting over to Vice-Chairperson Henschel, who conducted the meeting. Joe Schmit, 16702 Cedar Ridge Road, representing the applicant spoke in favor of the request noting that he would be available for any questions. Staff reviewed the staff report, reviewing locations of the proposed subdivision, two private streets, access to Derby Grange Road, number of lots, easements for future city utilities, and tools used to achieve the 40 points of sustainability required by the Unified Development Code. Staff noted that the access location on Derby Grange Road does comply with City standards for site distance. Staff recommended approval subject to waiving the lot frontage requirements for Lot 6 and the street width standard for both private streets. There were no public comments. The Zoning Advisory Commission discussed the request, and had no objections. Recommendation By a vote of 4 to 0, with 1 abstention, the Zoning Advisory Commission recommends that the City Council approve the request subject to waiving lot frontage for Lot 6 and street width requirements for Country View Drive and Country View Court.. A simple majority vote is needed for the City Council to approve the request. Conformance with Comprehensive Plan: This subdivision meets the Comprehensive Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3, and 10.2. Subdivision Staff Report — Preliminary Plat Derby Grange Acres Page 2 Impact of Request on: Utilities: The proposed Derby Grange acres Subdivision will utilize individual septic systems for each building lot and will have shared wells within the subdivision for water service. Traffic Patterns: Access to the proposed subdivision will be off of Derby Grange Road. Based on 2009 IDOT vehicle counts, there were 1,420 average daily trips on this portion of Derby Grange Road's intersection with John F. Kennedy Road. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided there is compliance with the Dubuque County Erosion and Sediment Control Manual. Adjacent Properties: Staff anticipates the most noticeable impacts to adjacent properties will be a change in the visual nature of this property with a change from open space to residential housing, and an increase in vehicle trips on Derby Grange Road. Staff estimates that the 14 new building lots, when fully built out with single-family homes, will generate approximately 140 average daily trips. Recommended Conditions on Plat: None. Staff Analysis: The submitted preliminary plat of Derby Grange Acres is located on the north side of Derby Grange Road immediately west of the Derby Grange Recreation facility. The proposed subdivision will include 14 new single-family building lots and the construction of two private streets. The subject subdivision is jointly reviewed by both the City and County of Dubuque as it is within two miles of the city of Dubuque's corporate limits. The preliminary plat of Derby Grange Acres encompasses 18.5 acres. Access to this proposed subdivision will be from a new private street to be named Country View Drive. In addition, another street to be named Country View Court will create a T intersection with cul-de-sacs at either end. The applicant's engineer has provided documentation that the proposed intersection with Derby Grange Road will comply with SUDAS standards for sight visibility. The proposed private streets within Derby Grange Acres Subdivision will be built with 22 foot of paving within a 66-foot right-of-way easement. The proposed cross section of road will have typical drainage swales to manage storm water. Both private streets will be built with concrete. The submitted preliminary plat includes one single-family building lot with a substandard street frontage, Lot 6. The street frontage at the right-of-way easement is 25-foot, Subdivision Staff Report— Preliminary Plat Derby Grange Acres Page 3 where the city standard is a 50-foot street frontage. Planning staff does not object to this proposed layout given the size and layout of the subject lot. Planning Services Department has reviewed the proposed preliminary plat for compliance with the City's sustainability requirements. The submitted preliminary plat of Derby Grange Acres proposed the following sustainable subdivision development tools. Proposed Sustainable Development Tools: 1) The proposed Country View Drive and Country View Court will be built with concrete (reduced heat island effect) — 5 points 2) The two proposed private roadways will be built to 22-foot wide reducing storm water runoff— 5 points 3) The covenants for the subdivision will require minimum tree planting on each lot— 5 points 4) The rating will be reduced to the minimum necessary to construct country View Drive and country View court— 5 points. 5) Compliance with Dubuque County stormwater management ordinance— 10 points. 6) Bio-retention cells on each lot— 10 points TOTAL: 40 points Planning staff is willing to allow the 10 points for compliance with the County Ordinance on a conditional basis. The submitted final plat and improvement plans will need to specifically address Best Management Practices that will warrant 10 points. The County Ordinance requires that the first 1.25 inches of rain be infiltrated on site. This requirement is more stringent than current City requirements. At this time, the developer is contemplating using bio-retention cells for each building lot. Under the Unified Development Code, this already nets developers 10 points. The developers of the proposed subdivision are required to sign a pre-annexation agreement with the City. This agreement stipulates that when the City proposes to annex the property, the property owners, existing and/or future, will agree to the annexation. In return, the City portion of property taxes will be discounted on a sliding scale for 10 years. The proposed subdivision also provides sufficient easements to extend water and sewer into the subdivision without the need of acquiring individual easements from each property owner in the future. Planning staff recommends the Zoning Advisory Commission approve the submitted preliminary plat of Derby Grange Acres subject to waiving the street width standard for Country View Drive and Country View Court, and waiving the lot frontage requirement for Lot 6.
