Enterprise Zone -1 and Enterprise Zone - 2
INTRODUCTION
This memorandum presents for City Council review and approval two resolutions
approving the filing of applications with the Iowa Department of Economic Development
(IDED) requesting Enterprise Zone Recertification to the City's existing Enterprise
Zones that meet the state's eligibility requirements. The completed applications are
attached to this memo.
BACKGROUND
The City currently has two enterprise zones. Enterprise Zone - 1 includes Census Tract
1 and Censust Tract 7.01 Block Group 1 and covers the downtown, Loras College area,
and the riverfront areas. Enterprise Zone - 2 includes Census Tract 5 and is located
generally along Central Avenue from the downtown area to E. 32"d Street. The
legislation regarding Enterprise Zones has extended the program and Dubuque's
Enterprise Zones can be recertified for an additional 10 years.
Enterprise zone designation provides incentives for new development that include tax
credits, refunds of sales, service and use taxes, supplemental new jobs training
withholding credit and property tax exemption. The City will continue to offer only a 10-
yearone dollar per year property tax exemption that protects the City's ability to use tax
increment financing in coterminous urban renewal/enterprise zone areas. Also, in
portions of the Enterprise Zone - 1, the existing Urban Revitalization program allows a
10-year 100% property tax exemption on new assessed value for residential projects.
This memo proposes to recertify both existing zones and include all eligible areas. The
City is eligible to include 6.17 square miles in total enterprise zone areas. The current
enterprise zones cover 3.37 square miles.
DISCUSSION
The proposed recertification of EZ - 2 would include the entire Census Tract 5, all of
which meets the state's Enterprise Zone eligibility requirements for per capita income of
$12,648 or less and family poverty rate of 12 percent or higher based on the 2000
census.
The proposed recertification of EZ - 1 ;would include the entire Census Tract 1, all of
which meets the state's Enterprise Zone eligibility requirements for the family poverty
rate of 12 percent or higher based on the 2000 census and a vacancy rate higher than
10 percent based on the 2000 census. EZ - 1 also covers Census Tract 7.01 Block
Group 1, all of which meets the state's Enterprise Zone eligibility requirements for per
capita income of $12,648 or less and family poverty rate of 12 percent or higher based
on the 2000 census.
RECOMMENDATION
I recommend that the City Council adopt the attached resolutions authorizing the filing
of the applications for Enterprise Zone Recertification for Enterprise Zones - 1 and 2.
The benefits of zone designation provide additional financial development tools for the
City and developers as we seek to attract and stimulate eligible housing and job
creation projects in the community.
ACTION STEP
The Action Step for the City Council is to adopt the attached resolutions.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the filing of an application for Enterprise Zone Certification to
expand the City's existing Enterprise Zone - 1 is approved.
Section 2. That the schedule of value-added property tax exemption for this
Enterprise Zone shall be One Dollar ($1.00) per year for ten years.
Section 3. That the Mayor is hereby authorized and directed to execute, on behalf
of the City Council of the City of Dubuque, Iowa, the appropriate Enterprise Zone application.
Section 4. That the City Manager is directed to submit the application to the Iowa
Department of Economic Development together with such documents as may be required.

This Enterprise Zone encompasses the majority of the Central Business District of
Dubuque. The land uses are mainly commercial and retail with residential uses above
storefronts and sparsely mixed within commercial buildings. The northern portion of the
Enterprise Zone has more industrial uses as well as some housing.
Please see Attachment 3 for a list of the existing businesses with in the Enterprise Zone.
9. Please describe how the proposed Enterprise Zone will be used.
The Zone is seeking recertification and the zone will be continued to be used to assist in
business expansions, building renovations, and housing renovations to improve the
district for those that live and work in it.
10. If applicable, please describe the local property tax exemption authorized by the City Council for
the proposed Enterprise Zone. (Please note that a local property tax exemption is not
required.) If other property tax exemptions or incentives will be used in lieu of an Enterprise
Zone property tax exemption, such as Urban Revitalization Areas, Tax Increment Financing (TIF)
districts, or Industrial Property Exemption authorized under Iowa Code Section 427B, please
indicate this.
A portion of the Enterprise Zone overlaps with an Urban Revitalization area that provides
tax exemptions on significant improvements. Also, a portion of the zone overlaps with
the downtown Urban Renewal district which provides TIF financing for certain types of
projects within the district.

INTENT: The Enterprise Zone Program was established by the Iowa Legislature with the intent of promoting
new economic development in economically distressed areas of Iowa by encouraging communities to target
resources in ways that attract productive private investment.

2. Before filling out this application form, please read Iowa Code Sections 15E.191 through 15E.196, as
amended by 2002 Iowa Acts, H.F. 2378 and the Enterprise Zone administrative rules.
3. Only typed or computer-generated applications will be accepted and reviewed. (Contact the IDED to have an
electronic copy of this application e-mailed to you.) Any material change to the format, questions or wording
of questions presented in this application, will render the application invalid and will not be accented.
4. Complete the application fully; if any questions are left unanswered or required attachments are not
submitted, an explanation must be included.
5. Use clear and concise language. Attachments should only be used when requested or as supporting
documentation.

Completed applications will be reviewed and acted upon by the Iowa Department of Economic Development's
Board of Directors during their monthly board meetings. The IDED Board meets on the 3`d Wednesday and the
subsequent Thursday of every month. Applications received by IDED on or before the 1St of the month will be
included on the agenda for that month's board meeting.

If more than one Enterprise Zone is being designated, please prepare a separate application for each proposed
Enterprise Zone.
Please indicate which two eligibility criteria the designated area* has met in order to be eligible to apply
for Enterprise Zone Certification.
A) The area has a per capita income of $12,648 or less based on the 2000 Census.
B) The area has a family poverty rate of 12% or higher based on the 2000 Census.
* One or more contiguous census tracts or other geographic units located within the boundaries of a
city will: a population of 24,000 or more as shown by the 2000 Census.
Please attach supporting documentation that shows how the designated area meets these eligibility
criteria.

This is a recertification application for EZ-2 in Dubuque which is 376.00 acres. EZ-1 in
Dubuque has 1774.00 acres which makes 2150 acres previously certified as Enterprise Zones.
4. Please indicate the size (in acres) of the Enterprise Zone for which you are requesting certification.
This is a recertification application for EZ-2 in Dubuque which is 376.00 acres. The total
acreage of Enterprise Zones in Dubuque County will not increase with this recertification.
Does the proposed Enterprise Zone include any area that qualifies as an Empowerment Zone or Enterprise
Community, pursuant to Title XIII of the federal Omnibus Budget Reconciliation Act of 1993? If so,
please indicate the size (in acres) of the area that qualifies as an Empowerment Zone or Enterprise

The current use in the zone is mainly residential with neighborhood commercial uses.
Please see Attachment 3 for a list of the existing businesses with in the Enterprise Zone.
9. Please describe how the proposed Enterprise Zone will be used.
The Enterprise Zone has been used to utilize Enterprise Zone incentives to assist in the
rehabilitation of housing in the zone. Some local businesses could benefit from the Enterprise
Zone programs, but incentives to improving the housing of the zone will benefit the residents
who live there.
10. If applicable, please describe the local property tax exemption authorized by the City Council for the
proposed Enterprise Zone. (Please note that a local property tax exemption is not required.) If other
property tax exemptions or incentives will be used in lieu of an Enterprise Zone property tax exemption,
such as Urban Revitalization Areas, Tax Increment Financing (TIF) districts, or Industrial Property
Exemption authorized under Iowa Code Section 427B, please indicate this.
A portion of the Enterprise Zone overlaps with an Urban Revitalization District. This allows for a
property tax abatement on significant improvements in the district. There is one property (Swiss
Valley Farms) in the zone that is with in an Urban Renewal District which allows for TIF to be
used.

designating, if applicable, the property tax exemption for the zone.

Commencing as a point of reference at the intersection of the centerline of Central Avenue with West 17tH
Street, said point being the point of beginning:
Thence northeasterly along the centerline of West 17th Street to the centerline of the most westerly
railroad tracks in Pine Street;
Thence northeasterly along the centerline of the railroad tracks to the centerline of Stafford Street
extended;
Thence northwesterly along the centerline of Stafford Street to the centerline of East 22"d Street;
