Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request ,reviewing that the Plat of Survey allows for
sale of property between the two existing property owners.
Staff reviewed the proposed lot layout, noting-that no additional building lots were being
created and two lots are not developable as noted in the plat.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objections.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot frontage requirements for Lots 2, 3 and 4.
A simple majority vote is needed for the City Council to approve the request.

Introduction
The submitted Plat of Survey of Waller Addition is located near Lake View Drive in the
Barrington Lake Subdivision in Dubuque County. The submitted plat of survey
resubdivides two existing parcels in Dubuque County. The Zoning Advisory
Commission is reviewing this plat of survey because the property is within 2 miles of the
City limits.
Discussion
The submitted plat of survey resubdivides two existing parcels. Lot 1 has frontage on
Lake View Drive within Barrington Lake Subdivision. Lots 2, 3 and 4 do not have
frontage on a public or private street. Currently Lot 4 has access but it is not an
officially recorded access easement, to the best of staff's knowledge.
The submitted plat of survey is not intended to allow for any additional single-family
homes to be built. The Plat of Survey resubdivides two existing parcels to facilitate a
property sale to create a more logical lot layout for the applicants, John P. and. Emily M:
Rowe.
Recommendation
Planning Staff recommends approval of the Plat of Survey of Waller Addition as it is in
substantial compliance with the City of Dubuque Subdivision Regulations subject to
waiving lot frontage requirements for Lots 2, 3 and 4.

RESOLUTION NO. 474-07
A RESOLUTION APPROVING THE PLAT OF SURVEY WALLER ADDITION.
Whereas, there has been filed with the City Clerk a Plat of Survey Waller Addition in
the City of Dubuque, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and Improvement
Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lo#s.
Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lots 2, 3 and 4 to have 0 feet of frontage, where 50 feet of lot frontage is required.
Section 3. That the Plat of Survey of Waller Addition is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said plat of survey.
