The application, staff report and related materials are attached for your review. Discussion The applicant's representative spoke in favor of the request, noting the rezoning is a down zoning from R-2 Two-Family to R-1 Single-Family Residential District. Staff reviewed the surrounding zoning and land use, and noted rezoning is also intended to facilitate the keeping of horses as part of a prospective land sale. Staff noted the location of the subject 13-acre parcel in the subdivision. There were no public comments. The Zoning Advisory Commission discussed the request and found that it was appropriate. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Physical Characteristics: The subject property is characterized by wooded hillsides and areas of flood plain associated with Catfish Creek. Concurrence with Comprehensive Plan: The Future Land Use Map 2030 designates the property for multi-family use. The request involves the Comprehensive Plan's Land Use Element Goals 1.1, 1.2, 1.5, 1.8 and 9.7. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Traffic Patterns/Counts: Manson Road provides access to the subdivision while Creek Wood Drive provides access to the lots in Phase 1 of Timber-Hyrst Estates Subdivision. Public Services: Existing public services are adequate to serve the site. Zoning Agenda: September 5, 2007 Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water control is provided during all phases of development. Rezoning Staff Report -Creek Wood Drive Page 2 Adjacent Properties: Adjacent properties should not be impacted by the proposed rezoning from R-2 to R-1, as it will reduce the potential number of units that can be built. CIP Investments: None proposed. Staff Analysis: The requested rezoning of the 12.7 acres of land is from R-2 Two- Family Residential District to R-1 Single-Family Residential District and is intended to facilitate the sale of the subject properties and allow the keeping of horses on the subject parcels. The City of Dubuque Zoning Ordinance allows the keeping of horses as a conditional use in the R-1 Single-Family Residential district only. When the text amendment was proposed to allow the keeping of horses on larger single-family residential lots, City staff had only received requests for parcels zoned R-1. Most areas zoned R-2, R-3 or R-4 at the time were subdivided into smaller parcels that would not be conducive for the keeping of horses. The proposed property to be rezoned to R-1 Single-Family Residential District includes Lots 29, 30 and Lot E of Timber Hyrst Estates. These lots are located along the CatFish Creek with Lot E being part of the designated flood plain area. A copy of the approved preliminary plat is attached. Staff does not anticipate any significant impact to the surrounding property as the rezoning represents a down zoning and will also require that a conditional use permit be approved by the Zoning Board of Adjustment. In addition, the subject property is buffered from other adjacent parcels, and most of the surrounding property is zoned either R-1 Single-Family Residential District or AG Agricultural District. Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the Zoning Ordinance that establishes criteria for review of rezoning requests. That Appendix A (The Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter-described property from R-2 Two-Family Residential to R-1 Single-Family Residential, to wit: Lot 29, 30 and E of Timber-Hyrst Estates, and to the centerline of the adjoining public right-of-way, all in the City of Dubuque, Iowa.
