City Clerk's Office • 50 W. 13"' Street, Dubuque, IA 52001 • 563.589.4100 Chapter 6 ENVIRONMENTAL STEWARDSHIP ADVISORY COMMISSION 2-6-1: COMMISSION CREATED: There is hereby created the Environmental Stewardship Advisory Commission. 2-6-2: PURPOSE: j The purpose of the commission is to advise the city council on environmental issues; to educate on environmental issues; and to promote environmental stewardship. 2-6-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as 1 may be necessary and which are not in conflict with this Code of Ordinances or the Iowa a Code. 2-6-4: PROCEDURES FOR OPERATION: j All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. 2-6-5: MEMBERSHIP: A. The commission comprises seven (7) residents of the city, appointed by the city council. B. Qualifications. 1. One (1) commissioner will be appointed to represent those who will inherit the environment. Such commissioner must be under the age of thirty (30) at the time of appointment. 2. Six (6) commissioners will be appointed to represent diverse segments of the city's �. population. 3. It is desirable to select some commissioners who may have backgrounds with environmental/biological science, healthcare, business/industry, and environmental/civic groups. 2-6-6: OATH: Each person, upon appointment or reappointment to the commission, must execute an oath u' of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. 2-6-7: TERMS: The term of office for commissioners is three (3) years or until such commissioner's successor is appointed and qualified. 2-6-8: VACANCIES: Vacancies must be filled in the same manner as original appointments. 2-6-9: OFFICERS/ORGANIZATION: The commissioners must choose annually a chairperson and vice-chairperson, each to serve a term of one (1) year. The chairperson must appoint a secretary, who need not be a member of the commission. The commissioners must fill a vacancy among its officers for the remainder of the officer's unexpired term. i 2-6-10: MEETINGS: A. Regular Meetings. The commission must meet monthly. B. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. C. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. I D. Attendance. 1. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. 2. Attendance must be entered upon the minutes of all meetings. 'i E. Minutes. A copy of the minutes of all regular and special meetings of the commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. F. Quorum. Four(4) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and voting is necessary for the u adoption of any motion or resolution. i 2-6-11: COMPENSATION: Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies budget. �! G' 2-6-12: REMOVAL: The city council may remove any commissioner for cause upon written charges and after a public hearing. G 2-6-13: POWERS: The commission has the following powers, duties, and responsibilities: 1. To develop, articulate, and propose goals, objectives, and policies to the city council for the stewardship of the city's environment and its ecological systems for present and future generations. 2. To advise and inform the city council on environmental stewardship issues, including the implementation of and compliance with legislation, regulations, and policies. 3. To hold public forums on specific issues at the direction of the city council. 4. To provide, upon request, to other boards, commissions, and city departments, information for environmental educational programs, educational materials, and environmental volunteer opportunities. 5. Created: There is hereby created a housing code appeals board. B. Purpose: The housing code appeals board shall conduct hearings upon application by any person aggrieved by a notice and order of the city manager issued in connection with a violation of this housing code or of any applicable rule or regulation issued pursuant to this housing code. C. Membership; Terms of Office; Vacancies: 1. The housing code appeals board shall be comprised of seven (7) persons who shall be appointed by the city council for terms of three (3) years. All terms of office shall expire on January 11 in their respective years. Reasonable efforts should be made to obtain representation of both tenant and landlord interests in the appointment process. 2. Upon completion of a term of office, a member shall continue to serve in the member's i full capacity until a successor has been duly appointed. 3. Vacancies on the board caused by death, resignation or other reason shall be promptly filled by the city council for the unexpired term of office. 4. The board shall elect a chairperson and vice chairperson from its members at the first regular meeting of each year. 5. Members of the board shall be residents of the city and may not be employed by the city. D. Meetings: 1. The housing code appeals board shall meet at least quarterly and at such other times as necessary in order to fulfill its purpose. 2. Members of the board shall attend at least two-thirds (2/g) of all regularly scheduled and held meetings within a twelve (12) month period. If any member does not attend such j prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that the member be replaced. All meetings shall be held in conformance with the provisions of the Iowa open meetings law. 4. The city manager shall serve as secretary to the board and shall render all decisions and findings in writing to the appellant. 5. The city manager shall file with the city clerk a copy of the minutes of each meeting of the board within ten (10) working days after each such meeting. E. Internal Organization And Rules: The housing code appeals board may adopt rules and regulations to govern its organizational procedures as it may deem necessary and which are not in conflict with this chapter or other ordinances of the city. F. Procedures For Operations: All administrative, personnel, accounting, budgetary and procurement policies of the city shall govern the housing code appeals board in all of its operations.
