1. Hearing on the Grievance of Jim Powers
Dave Baker, Teamsters Union, explained that Jim Powers was requesting that
his name be placed on the certified list for the position of Maintenance Worker.
It was explained that Mr. Powers had served in the position twice for extended
periods and had been compensated at the Maintenance Worker rate; however,
he had never taken the Civil Service test for Maintenance Worker. The
Commission discussed the fairness of putting someone on the certified list who
had never tested. Kluesner moved to deny the request and encourage Mr.
Powers to take the next examination for the position. Seconded by Gieseman.
Motion carried 3-0.
2. Hearing on the Grievance of Matt Cooper
Dave Baker explained that the position of Equipment Operator II crosses over
two bargaining units and two departments. There was an opening for an
Equipment Operator II in the Water Department which was offered to all of the
employees on the list when the opening occurred. All of the employees on the
list were members of the Teamsters Union working in the Public Works
Department. No one accepted the position as they did not want to change
bargaining units or departments. The list was declared exhausted and a new
test was given on March 15, 2007 and certified on April 16, 2007. Matt Cooper
took the Equipment Operator II test on March 15th; however, he did not achieve
a passing score. At this time he was requesting that his name be added to the
list until the date the original list would have expired -April 20, 2008.
The Commission discussed the request, noting that the fact that the list crossed
departments and bargaining units was a problem which needed to be resolved.
The Commission also discussed the fairness of adding someone to a Certified
List who had failed the examination, even though he had previously passed the
test.
Gieseman moved to refer the matter to City Attorney Barry A. Lindahl for an
opinion as to whether the Civil Service Commission had the authority to add Mr.
Cooper's name to the certified list for Equipment Operator II. Seconded by
Kluesner. Motion carried 3-0.
3. Hearing on the Grievance of AI Hakanson
Dave Baker, Teamsters Union, requested that this item be tabled until further
notice. Motion by Kluesner to table the issue. Seconded by Gieseman. Motion
carried 3-0.
There being no further business, upon motion meeting adjourned at 12:25 p. m.
