Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed the location of the subject property, proposed lot split and noted that the
lot area and frontage for Lot 2 and lot frontage for Lot 1 needs to be waived. Staff
indicated the proposed changes facilitate a sale of property, but does not result in
creating a new building lot.
There were no public comments.
The Zoning Advisory Commission reviewed the request, and had no objection to the
plat of survey, as submitted.
Recommendation
By a vote of 7 to 0 the Zoning Advisory Commission recommends that the City Council
approve the requests subject to waiving lot frontage for Lots 1 and 2 and lot area for Lot
2.
A simple-majority vote is needed for the City Council to approve the request.

RE: Plat of Survey Claussen Place
The submitted Plat of Survey of Claussen Place is located north of the intersection of
Pennsylvania Avenue and Lenox Street. The subject parcels are being re-subdivided to
facility a land sale.
Discussion
The submitted Plat of Survey re-subdivides an existing parcel into two lots. Neither lot
has frontage on a public or private street and Lot 2 is substandard in terms of lot area.
The property is served by an existing private drive that has access to Pennsylvania
Avenue. The current lot configuration is in the shape of a T and the proposed Plat of
Survey will subdivide off the north portion of the T (Lot 2) and sell that portion to the
owner of the Lot 1 of 2 of 1 of Mineral Lot 257.
Planning Staff does not object to the submitted Plat of Survey as it does not create any
additional building lots to be served by the existing private drive.
Recommendation
Planning Staff recommends that the Zoning Advisory Commission approve the Plat of
Survey of Claussen Place subject to waiving lot frontage requirements for Lots 1 and 2
and Lot Area Requirements for the Lot 2.

RESOLUTION NO. 509-07
RESOLUTION APPROVING THE PLAT OF SURVEY CLAUSSEN PLACE
Whereas, there has been filed with the City Clerk a Plat of Survey C{aussen Place in the
City of Dubuque; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 and Lot 2 to have 0 feet of frontage, where 50 feet of lot frontage is required and
Lot 2 to have 1,742 square feet of lot area, where 5,000 square feet is required.
Section 2. That the Plat of Survey Claussen Place is hereby approved and the Mayor
and City Clerk are hereby is authorized and directed to endorse the approval of the City
of Dubuque, Iowa upon said Plat of Survey.
