SUBJECT: Acceptance of Public Improvements in Emerald Acres No. 1 and No. 2
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, T-Corp, has recently completed in Emerald Acres No. 1 and No. 2,
which includes the sanitary sewer along Heritage Trail from Peru Road north to the
subdivision. This does not include the shared detention basin located in Alpine Park.
Maintenance of said improvements shall be the responsibility of the contractor,
Tschiggfrie Excavating Co., and the developer, T-Corp, for a period of two years from
the date of acceptance. Maintenance of the shared detention area in Alpine Park will
continue to be the responsibility of the developer until such time as it is completed and
accepted by the City Council at a later date.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in Emerald Acres No. 1 and
No. 2
INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, T-Corp, has recently completed in Emerald
Acres No. 1 and No. 2 which includes the sanitary sewer along Heritage Trail
from Peru Road north to the subdivision.
BACKGROUND
As a condition of subdivision plat approval through Resolution Nos. 462-99 and
288-01, the developer of Emerald Acres No. 1 and No. 2 was required to install
certain improvements including street paving with curb, sanitary sewer main,
watermain, storm sewers and catch basins, boulevard street lighting, and
stormwater detention facilities and to dedicate these improvements to the City
upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
T-Corp has requested City's acceptance of the improvements in Emerald Acres
No. 1 and No. 2. Upon inspection by the City, it has been determined that all of
the public improvements required by Resolution Nos. 462-99 and 288-01 have
been completed in accordance with plans approved by the City Council and in
conformance with City specifications, with the exception of the stormwater
detention facility located at the northwest corner of Alpine Park. Final piping into
the detention facility cannot be completed until that portion of the mobile home
park is graded.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the improvements,
except for the shared detention basin located in Alpine Park. Maintenance of
said improvements shall be the responsibility of the contractor, Tschiggfrie
Excavating Co., and the developer, T-Corp, for a period of two (2) years from the
date of acceptance by the City Council. Maintenance of the shared detention
area in Alpine Park will continue to be the responsibility of the developer until
such time as it is completed and accepted by City Council at a later date.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

ACCEPTING IMPROVEMENTS IN EMERALD ACRES NO. 1 AND NO.2
Whereas, pursuant to Resolution Nos. 462-99 and 288-01, certain public
improvements including street paving with curb, sanitary sewer main, watermain,
storm sewers and catch basins, boulevard street lighting, and stormwater
detention facilities were installed by the developer of Emerald Acres No. 1 and
No. 2.
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, with the exception of the shared detention
area located in Alpine Park, and has recommended that the improvements be
accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said public improvements in Emerald Acres No. 1 and No. 2 be and the
same is hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the contractor and developer for a period of two (2) years from
this date. The developer shall continue to maintain the shared detention area in
Alpine Park until it is completed and accepted by City Council at a later date.

RE: Sanitary Sewer Line for Emerald Acres II
Mike:
T-Corp, at this time, is requesting the acceptance of the 12" and 8" sanitary sewer that
was built to serve Alpine Park and Emerald Acres II to be accepted and dedicated as a
public sewer to the City of Dubuque. This sanitary sewer, which ran from Peru Road into
Tanzanite Drive, consisting of Manhole #1 through Manhole #25, was constructed
according to the City of Dubuque Plans and Specifications.
