City Engineer Gus Psihoyos recommends City Council acceptance of the Grant of
Temporary Easement for Grading and Permanent Easement for Storm and Sanitary
Sewer from Northridge Ventures LLC.
Plans for the Upper Bee Branch Creek Project provide a contractor option to place
60,000 yards of clean fill at the site. If a contractor elects to waste soil at this location,
then relocation of the storm and sanitary sewer main will be required. The property is
described at Lot 11 in Block 2 of Dubuque Technology Park, includes the Cartegraph
office building, and is owned by Northridge Ventures LLC. The City has negotiated with
the owner for easements to facilitate the placement of fill and storm and sanitary sewer
relocation and on-going maintenance of the utilities. The City of Dubuque will own and
maintain the relocated utilities.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to seek acceptance of a temporary easement for grading and a
permanent easement for storm and sanitary sewer across Part of Lot 11 in Block 2 of Dubuque
Technology Park, in the City of Dubuque.
DISCUSSION
Plans for the Upper Bee Branch Creek Project provide a contractor option to place 60,000 yards of
clean fill at the site. If a contractor elects to waste soil at this location then relocation of the storm and
sanitary sewer main will be required. The property is described at Lot 11 in Block 2 of Dubuque
Technology Park, includes the Cartegraph office building, and is owned by Northridge Ventures LLC.
The City has negotiated with the owner for easements to facilitate the placement of fill and storm and
sanitary sewer relocation and on-going maintenance of the utilities. The City of Dubuque will own and
maintain the relocated utilities.
RECOMMENDATION
I recommend accepting the Grant of Temporary Easement for Grading and Permanent Easement for
Storm and Sanitary Sewer through, over and across Part of Lot 11 in Block 2 of Dubuque Technology
Park, as shown on the exhibits attached to the Grant of Easement.
ACTION TO BE TAKEN
I respectfully request accepting the Grant of Temporary Easement for Grading and Permanent
Easement for Storm and Sanitary Sewer from Northridge Ventures LLC.

For and in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the
receipt whereof is hereby acknowledged,

to the CITY OF DUBUQUE, IOWA (Grantee), a municipal corporation, its agents and contractors, in
perpetuity, from the date hereof, a right-of-way and easement through, under and across the following
described real estate situated in Dubuque, Iowa, to wit:

Said easement shall be as shown on the attached Storm and Sanitary Sewer Easement Plat No. 7 -IA -15
dated 3/26/15 and Easement Exhibit EXH.1 dated 3/27/15 prepared by IIW, P.C. for the purpose of
1. Constructing and maintaining a permanent storm and sanitary sewer as part of Contract #1 Bee
Branch Creek -Channel, Streets, and Utilities Project (Project) in accordance with the Plans and
Specifications on file in the office of the City Engineer.
2. Site grading and abandoning the existing storm and sanitary sewer as part of Contract #1 Bee
Branch Creek -Channel, Streets, and Utilities Project (Project) in accordance with the Project Plans
and Specifications on file in the office of the City Engineer
It is understood and agreed that the Grantee herein shall protect existing structures, pavement & utilities,
and restore all disturbed areas.
Grantee will coordinate work to minimize disruption of Grantor's operations and site including disturbance
form dust, noise, and vibration.
Grantor shall not erect any structure in easement area that will inhibit access of the Grantee without prior
written approval of the Grantee.
Grantor shall not change the grade, elevation, contour or perform any construction or excavation in
easement area that will inhibit Grantee's access and ability to use the easement that is in place without prior
written approval of the Grantee.
The construction access easement period for the City's Bee Branch Creek -Channel, Streets, and Utilities
Project shall commence on the date the Notice to Proceed for the Project issued and end on the date that
the Certificate of Final Acceptance is issued for the project by the City, approximately 18 months.
To have and to hold unto the said City of Dubuque, Iowa, forever, and the undersigned do hereby expressly
covenant that they are the owners in fee of said real estate and have good right to execute this agreement,
and that the grantee, its agents or contractors, shall at all times have free access to and egress from and
over said real estate thereon or therein.

RESOLUTION NO. 144-15
ACCEPTING A GRANT OF TEMPORARY EASEMENT FOR GRADING AND
PERMANENT EASEMENT FOR STORM AND SANITARY SEWER THROUGH, OVER
AND ACROSS PART OF LOT 11 IN BLOCK 2 OF DUBUQUE TECHNOLOGY PARK,
IN THE CITY OF DUBUQUE, IOWA
Whereas, Northridge Ventures LLC has executed a Temporary Easement for
Grading and a Permanent Easement for Storm and Sanitary Sewer through, over and
across Part of Lot 11 in Block 2 of Dubuque Technology Park, in the City of Dubuque,
Dubuque County, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Grant of Temporary Easement for Grading and a
Permanent Easement for Storm and Sanitary Sewer through, over and across Part of
Lot 11 in Block 2 of Dubuque Technology Park, in the City of Dubuque, Dubuque
County, Iowa from Northridge Ventures LLC, a copy of which is attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection herewith.
