Civil Engineer Deron Muehring has provided information related to the substantial and
final completion dates for the contracts associated with the Upper Bee Branch Creek
Restoration Project.
As approved by the City Council, the contracts for the Upper Bee Branch Creek projects
establish a substantial completion date of December 1, 2016 and a final completion
date of May 1, 2017.
The City of Dubuque held pre-bid conferences for the Upper Bee Branch Creek —
Channel, Streets, & Utilities Project and the Upper Bee Branch Creek — Structures
Project. Based on feedback from potential contractors, the current project schedule
would likely add up to $2,000,000 in additional costs which would be reflected in the
forthcoming bids.
After evaluating the pre-bid meeting comments and discussing them with the City's
engineering consultants from Strand Associates, Inc. and IIW Engineers, the consensus
was that it would be in the best interest of the City to provide the contractors more time
to complete the improvements. To that end, through addendum, the contracts will reflect
a substantial completion date of July 1, 2017 and a final completion date of
September 1, 2017.
In addition to the Substantial Completion and Final Completion dates, the contract
outlines intermediate "milestone dates" to complete key project improvements such as
the bridges and box culverts. The milestone ensure that the flood mitigation
improvements associated with Contract 1 and Contract 2 of the Upper Bee Branch
Creek Restoration Project will still be functional in time for the spring rains of 2017.

INTRODUCTION
The purpose of this memo is to provide information related to the substantial and final
completion dates for the contracts associated with the Upper Bee Branch Creek
Restoration Project.
BACKGROUND
Since 1999 there has been six Presidential Disaster Declarations related to flooding in
the Bee Branch Creek Watershed. The Drainage Basin Master Plan, completed and
adopted by the City Council in 2001, established that there are more than 1,100
properties at risk of flood damage as a result of the flash flooding. Based on a
subsequent study in 2009 by the Federal Emergency Management Agency (FEMA),
there are 1,373 properties in the flood prone area. In addition to homes, there are over
70 businesses in the at-risk area with over $500 million in annual sales.
On November 18, 2013 the City Council passed Resolution 335-13 adopting the 2013
Drainage Basin Master Plan Amendment. The 2013 Amendment did not replace the
2001 Drainage Basin Master Plan. Instead, it built upon its foundation. The amended
Drainage Basin Master Plan outlined several improvements throughout the Bee Branch
watershed, including the Bee Branch Creek Restoration Project, to mitigate the effects
of future flooding and disasters.
In June of 2012, the City Council adopted Resolution 142-12, approving the City's
application for funding for the Bee Branch Creek Restoration Project made available for
cities and counties that received a Federal Disaster Declaration in 2011 through the
U.S. Economic Development Administration (EDA) Disaster Relief Program. And in
August of 2013, the City received a Financial Assistance Award from the EDA with a
total federal share of$1 ,227,138.00. Finally, in order to receive the $1,227,138.00
federal award, it was necessary for the City to acknowledge and agree to comply with
the grant provisions within 30 days of the award notice. Thus, the Financial Assistance
Award was signed by Mayor Roy D. Buol, the City's Authorized Representative, and
returned to the EDA solidifying the federal funding obligation for the Bee Branch Creek
Restoration Project. The EDA Financial Assistance Award states that the timeline for
the project is as follows:
Start of Construction by: April 30, 2016
Completion of Construction by: February 8, 2017
Authorized Grant End Date: May 8, 2017
The City of Dubuque is to adhere to the timeline and provide a written request for an
amendment to the Special Award Conditions if there is a change required.
On October 6, 2014 the City Council passed Resolution 306-14 authorizing the City
Manager to act as an "authorized representative" on the Economic Development
Administration grant agreement with the authority to execute any documents required
by the agreement as the Economic Development Administration may reasonably
request.
On April 20, 2015 the City Council passed Resolution 135-15 and Resolution 136-15
thereby approving the plans, specifications, form of contract, and estimated cost for the
Upper Bee Branch Creek — Channel, Streets, & Utilities Project (Contract 1) and the
Upper Bee Branch Creek — Structures Project (Contract 2) respectively.
DISCUSSION
As approved by the City Council, the contracts for the Upper Bee Branch Creek projects
establish a substantial completion date of December 1 , 2016 and a final completion
date of May 1 , 2017. The importance of these dates is twofold. First, they adhere to the
dates reflected in the Financial Assistance Award from the EDA as amended. Second,
they assure that the flood mitigation improvements will be functional in time for the
spring rains of 2017.
The City of Dubuque held pre-bid conferences for the Upper Bee Branch Creek —
Channel, Streets, & Utilities Project and the Upper Bee Branch Creek — Structures
Project. According to the feedback from potential bidders, in order to meet the current
substantial and completion dates, a contractor would be required to pour concrete
through both winter seasons. While doing some cold weather work is feasible, the
contractors expressed concern that heating the concrete to pour roadways and bridges
in the winter would be cost prohibitive if not impossible. Based on feedback from
potential contractors, the current project schedule would likely add up to $2,000,000 in
additional costs which would be reflected in the forthcoming bids.
After evaluating the pre-bid meeting comments and discussing them with the City's
engineering consultants from Strand Associates, Inc. and IIW Engineers, the consensus

was sent to the EDA requesting an adjustment to the project completion date. The EDA
provided official notification to the City on April 29th and offered a further extension of
the timeline to allow for grant funding closeout activities. A comparison of the previously

Subject: Extension Request for Construction Completion Date and Award End Date
Dear Mr. Greener,
The purpose of this letter is to request EDA approval to extend the Construction
Completion Date and Award End Date of the Bee Branch Disaster Resiliency Project.
The current Construction Completion Date is February 8, 2017; we request to extend
this date to July 1, 2017. The current Award End Date is May 8, 2017; we request to
extend this date to September 1, 2017.
The City has held two pre-bid construction conferences; one on the EDA contract and
one for a related bridge/structures contract that is within the same EDA project limits.
The feedback received from a majority of the contractors was that the current
construction completion date does not provide enough time to complete the project
without increasing the cost of both contracts by a significant amount. Based on
contractor feedback, the City is estimating a possible increase of one to two million
dollars if we maintain the current construction schedule.
Under the new proposed schedule that the City of Dubuque is requesting, the Bee
Branch Creek will require contactors to have the floodway channel functional by
December 2016 to mitigate the potential for any flooding in the spring 2017. However
there will be some additional street paving and landscape type work that remains to be
completed during the spring of 2017 after winter weather conditions have passed.
The timing of this project has been affected by many factors throughout the past year,
including negotiations with the Canadian Pacific Railway. The City of Dubuque has
worked diligently to move forward with the final design and the construction start date in
order to improve our resiliency to flooding. In November of 2014 it was determined that
the City should construct the channel from Garfield Avenue to 24th Street (EDA project

area) prior to completing the storm sewer culverts beneath the Canadian Pacific
Railway so that citizens can realize the benefits of flood resiliency as soon as possible.
Our request for an extension is based on several factors. The City of Dubuque has
continued to work closely with the public through several community meetings and
presentations to ensure the impact to businesses and residential neighborhoods during
construction are as minimal as possible. Due to the input from the public, the City has
implemented restrictions on the amount of long-term roadway closures happening at
any one point in time in order to limit disruption to businesses and residents in the
construction area. Four long term roadway closures are necessary for the City's parallel
bridge/structures contract to construct two bridges and two major box culvert systems
across the channel before the roadways can be put back into service.
When the City hosted the two pre-bid construction conferences, contractor's provided
significant feedback regarding the City's proposed schedule included in the bid
documents. In order to meet the current EDA approved Construction Completion Date
of February 8, 2017 the project schedule calls for contractors to pour concrete through
both winter seasons between the start and end date for the project. While doing some
cold weather concrete work is feasible, the contractors provided feedback that having to
heat concrete to pour roadways and bridges in heart of winter would be cost prohibitive
if not somewhat impossible.
Finally, when the City was awarded the EDA grant the Bee Branch Disaster Resiliency
Project was estimated as a $10,226,150 project. Due to further refinement of the design
to meet the stated project objectives, construction material cost increases, and
increased costs to ensure the built infrastructure remains durable and resilient during
flood events, the engineers estimate is now $18,518,300 for the same awarded scope
of work. The City of Dubuque has evaluated and implemented value engineering
changes to reduce cost increase as much as possible, however the additional costs
have directly affected the budgeted local match the City of Dubuque may need to
provide. Any further increase to these costs due to the inability to change the scheduled
construction completion date will put undue strain on the project budget and the citizens
of Dubuque.
We respectfully request EDA approval to release an addendum to the contract
documents that extends the Construction Completion Date by five months to July 1,
2017. We would also like to request that the Award End Date be extended by four
months to September 1, 2017. We would need to release this addendum as soon as
possible as the Project's bid letting is on May 7, 2015.

BACKGROUND
In June of 2012, the City Council adopted Resolution 142-12, approving the City's
application for funding for the Bee Branch Creek Restoration Project made available for
cities and counties that received a Federal Disaster Declaration in 2011 through the
U.S. Economic Development Administration (EDA) Disaster Relief Program.
On August 8, 2013 the EDA awarded the City of Dubuque $1,227,138 for the Bee
Branch Disaster Resiliency Project (a.k.a. the Upper Bee Branch — Channel, Streets, &
Utilities Project).
In order to receive the $1,227,138.00 federal award, it was necessary for the City to
acknowledge and agree to comply with the grant provisions within 30 days of the award
notice. Thus, the Financial Assistance Award was signed by Mayor Roy D. Buol, the
City's Authorized Representative, and returned to the EDA solidifying the federal
funding obligation for the Upper Bee Branch Creek - Channel, Streets, & Utilities
Project.
On October 6, 2014 the City Council passed Resolution 306-14 authorizing the City

DISCUSSION
The EDA Financial Assistance Award established both the timeline and budget for the
EDA portion of the Upper Bee Branch Creek — Channel, Streets, & Utilities Project. A
need to adjust both the schedule and project cost arose during the public bidding
process.
As required, the City provided EDA written notification to amend the project completion
dates, as well as, the revised project budget based on the bid award.
The EDA subsequently provided the attached Amendment to Financial Assistance
Award (Amendment) that revises the project schedule to reflect a project completion
date of September 1, 2017 and adjusts the total project cost to reflect the actual cost
following the award of the contract to Portzen Construction on May 18, 2015.
In order to ensure the City's receipt of the $1,227,138 from the EDA for the Upper Bee
Branch Creek - Channel, Streets, & Utilities Project, the City must execute the
Amendment and return it to the EDA.
RECOMMENDATION
I recommend that the Mayor execute the attached Amendment to Financial Assistance
Award in order for the City to receive the full $1,227,138 for the Upper Bee Branch
Creek — Channel, Streets, & Utilities Project.
ACTION TO BE TAKEN
I respectfully request that the Mayor sign the attached Amendment to Financial
Assistance Award as required for the City's receipt of $1,227,138 for the Upper Bee

Attached, please find Amendment No. 2 to the Financial Assistance Award for the City of Dubuque's Bee
Branch Disaster Resiliency Project. The Amendment revises the Project Development Time Schedule
specified in Special Award Condition No. 1 and the Project Budget.
The Project Development Time Schedule has been revised to extend the deadline for the completion of
construction from February 8, 2017 to September 1, 2017, and to extend the award end date from May 8,
2017 to December 1, 2017. The City indicated that the additional time is necessary to avoid a significant
cost increase due to project time constraints. Please be advised that the City needs to take all necessary
actions to move this project forward as quickly as possible. The award requires that the construction be
completed prior to September 1, 2017.
The project budget is revised to account for a higher than expected awarded contract amount. The total
project cost increases by $15,027,395 to $25,253,545 with the recipient's local match increasing to a total
of $24,026,407. Additionally, an adjustment has been made to the budget to remove administrative
expenses and direct all EDA funds towards construction. EDA funding amount for this project remains
unchanged at $1,227,138. EDA's subsequent matching grant rate changes from 12.00% to 4.86%.
All other terms and conditions of the Financial Assistance Award shall remain in full force and effect. If

REASON(S) FOR AMENDMENT
This Amendment will revise the the Project Schedule and Budget. Special Award Condition No. 1, Project
Development Time Schedule, is revised to extend the project completion of construction date to September 1, 2017
and the grant end date to December 1, 2017. This amendment also increases the total project cost to $25,253,545.
The recipient's local match is increased by $15,027,395 for a total of $24,026,407. The EDA funding does not change.
The EDA match rate is reduced from 12.00% to 4.86%.
All other terms and conditions of the Financial Assistance Award shall remain in full force and effect.
