SUBJECT: Loras College -Pedestrian Bridge over Cox Street Irrevocable License
City Engineer Gus Psihoyos is recommending issuance of an irrevocable license for
Loras College to construct an overhead pedestrian bridge on Cox Street to connect the
existing Alumni Campus Center to the Athletics and Wellness Center currently under
construction.
There is a 30' high retaining wall approximately 530' in length on the west side of Cox
Street that prohibits student movement across the Loras College campus. The Loras
College Campus Master Plan includes improvements to student access for classes,
food service, as well as safety of students, staff, faculty and guests from the part of
campus east of Cox Street to the part of campus west of Cox Street.
The proposed pedestrian bridge would provide 16' of clearance for vehicle traffic on Cox
Street.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Loras College -Pedestrian Bridge Over Cox Street
Irrevocable License
INTRODUCTION
This is in response to a request from Loras College, 1450 Alta Vista, to construct a
pedestrian bridge over Cox Street right-of-way to connect the existing Alumni Campus
Center (ACC) to the Athletics and Wellness Center (AWC) currently under
construction.
DISCUSSION
Loras College campus covers an area bounded generally by Alta Vista, Henion Street,
Loras Blvd. and Kirkwood Street. Running north/south through the campus is Cox
Street from Loras Blvd. to Kirkwood. Classes are held on both upper and lowers ends
of the campus as well as student residence halls. Students not only have to cross
Cox Street many times for classes but to access food service in the Alumni Campus
Center.
There is a 30' high retaining wall 530' approximately in length on the west side of Cox
Street which prohibits student movement across campus. An integral part of the
design for the new Athletics and Wellness Center included circulation criteria to
improve student access for classes, food service, as well as safety of students, staff,
faculty and guests. Food service alone serves 575 students who reside on the east
side of Cox Street. The requested usage of Cox Street right-of-way to construct the
overhead pedestrian bridge is a critical element of the Loras College Campus Master
Plan. Cox Street has parking on the east side and therefore limits vehicle travel with
and further causes congestion with thousand student crossings per day. Loras
College feels the construction of pedestrian bridge will have a positive and great
impact on student safety
Cox Street has aright-of-way of 60' with a paved travel portion of 26'. The proposed
pedestrian bridge on Cox Street will be 340' north of Loras Blvd., 10'6" width, with a
minimum 16' distance from pavement to bottom of structure and will connect the new
vestibule of the existing Alumni Campus Center to the new proposed circulation tower
of the Athletics and Wellness Center. The bridge construction will consist of poured
reinforced concrete column, metal panels on steel framing, mechanical chase, floor
deck of concrete on metal pan, aluminum window system, and engineered steel box
truss.
Photos of both areas are attached for information and review.
All documents required have been received which include the Irrevocable License
Application, signed Acceptance of Terms, Certificate of Insurance, letter of request
and drawing of proposed improvements. The Engineering Department, Building
Services, Planning and Fire Department have reviewed the material as it relates to the
public right-of-way encroachment and have found them all to be in accordance with
City standards.
ACTION TO BE TAKEN
The requested action is for approval and signature of the Irrevocable License for Loras
College to construct the overhead pedestrian bridge on Cox Street.

TO CONSTRUCT pedestrian Bride over Cox St.
ON PUBLIC RIGHT-OF-WAY
Section 1. Loral College as the owher of the premises,
(Licensee), known as T,nrac ('n11egQ in Dubuque, Iowa, and legally
described as lot lcity lot 741 across cox to Lot 2(see attachedbe and IS hereby
granted an Irrevocable License and authority to construct and maintain
Pa>_c:estrian. Bridge Over cox Street (Encroachment) (see attachment for
location) under the terms and conditions set forth in this License.
Section 2. The permission herein granted is expressly conditioned on
Licensee's agreement to:
a) Assume any and all liability for damages to persons ol- property Which may
result from the existence, location, installation, construction or maintenance of
said Encroachment;
b) Procure and maintain in force during the term of this License a policy of liability
insurance as set forth in the attached Insurance Schedule;
c) Pay on behalf of the City of Dubuque, all sums which the~City of Dubuque shill
become obligated to pay by reason of the liability impt~l~+~ti upon the City of
Dubuque for damages of any kind resulting from the' location, instillation,
existence, construction or maintenance of said Encroachment sustained by any
person or persons, caused by accident or otherwise ~o defend at its own
expense and on behalf of said City any claim against the City of Dubuque
arising out of the location, installation, existence, constriction or maintenance
of Encroachment and to pay reasonable attorney fees thel-efor; and
d) Indemnify, defend and hold the City of Dubuque free and harmless from any
and all claims, loss, liability and expense for death and/or injuries to third
persons or damages to property of third persons, or for damage to any property
of the City of Dubuque which may occur as a result of or in connection with the
location, installation, existence, construction, maintenance and repair of
Encroachment.
e) Any special conditions as set forth for this License as identified:
Section 3. The Encroachment shall be maintained in accordance with all
applicable state and federal laws and regulations, and the Ordinances of the City of
Dubuque.
Section 4. Licensee covenants and agrees that the Irrevocable License herein
granted does not constitute an approval of the design, erection, location, construction,
repair or maintenance of said Encroachment and Licensee hereby covenants and agrees
not to assert such claim or defense against the City of Dubuque in the event of claim
asserted for death, personal injuries and/or property damage against Licensee arising out
of or in any way connected with the location, installation, construction, design, repair and
maintenance of the Encroachment.
Section 5. This Irrevocable License shall become effective and the rights
hereunder accrue to Licensee when this License has been approved by the City Council
and the terms and conditions thereof accepted by Licensee by acceptance endorsed on
this License.
Section 6. The City Clerk is authorized and directed to file at Licensee's
expense a copy of this License in the Office of the Recorder in and for Dubuque County,
Iowa.
Section 7. Iowa One-Call registration may be required by the Code of Iowa.
When applicable Licensee shall submit documentation to the City Engineer of Iowa One-
Call registration membership.

movement was accommodated somewhat when the Alumni Campus Center (ACC) was built, as
elevators to the 4th floor were added in the east vestibule. However, even these elevators force
students to go to the 4th floor, and then down to the 3`d floor of the ACC for food service. And, they
continue to be forced to walk around the existing Cox Street retaining wall.
Safety concerns are also a part of the decision to build a bridge over Cox Street. Parking on Cox
Street often reduces the ability of students, faculty, staff and visitors to see vehicular traffic passing
on the street. There are 575 students who are in residence facilities east of Cox who find their way to
and from upper campus on a daily basis. Combined with class requirements both on upper and lower
campus, the number of pedestrian crossings at Cox Street totals in the thousands per day. In light of
recent events on local school campuses, Loras College wishes to especially take the safety of our
students, faculty and guests seriously. We believe the bridge concept will substantially reduce this
risk.
When the concept of the Athletics and Wellness Center (AWC) was first conceived, an integral part
of the concept was to improve overall campus circulation. The concept of a vertical circulation tower
and bridge over Cox Street was a critical element of this thinking. With the installation of the
proposed bridge over Cox Street, students coming from the AWC and the buildings east can use the
elevators in the tower to rise to either of the floors in the AWC or to continue up to the level of the
3`d floor of the ACC. They can also continue westward on campus by using the vertical circulation
of the ACC to get up one more floor to the level of the central quad, or to the skyway leading to the
relatively new Academic Resource Center (ARC). The bridge and tower make it possible for the
College to leverage its food service facilities in the ACC to serve events in the AWC.
In closing, for safety, functional and circulation purposes, I am grateful for your strongest
consideration.
