Dear Chairpersons, Mayor and President:
Enclosed is a copy of a Stipulation of Settlement of a tax assessment appeal. Iowa
Code § 441.44 requires that the Stipulation of Settlement be served upon each of you.
The property that is the subject of this appeal is the loana Mamali property located at
700 Lowell Street, Dubuque, Iowa, Assessor's Parcel 10-23-277-010.

The Dubuque City Assessor's Office revalued all residential property for 2007 and
placed a value of $85,500 on the Mamali property at 700 Lowell Street as follows:
Land $14,200
Building $71,300
Total $85,500
The 2006 value was $76,900. Upon receiving the 2007 assessment notice the owners,
Catalin and loana Mamali filed a petition with the Dubuque City Board of Review. The
Board of Review denied the petition. The Mamalis then filed an appeal with the Property
Assessment Appeal Board.
The Mamalis feel their property should be valued at $76,900 due to the condition of the
property. They protested on the grounds that their property was not worth $85,500 and
had decreased in value since the last assessment. The Mamalis and the City Assessor
exchanged mail answering various questions before the Mamalis invited City Assessor
Rick Engelken to their home to show him the condition of the home.
The home visit took place on October 11, 2007. This property has many problems. The
basement foundation leaks, making the basement unusable. The home has poor
utilization of the available space. The two bedrooms, kitchen and bathroom are all very
small. The hot water furnace is original to the house and the insulation is in poor
condition, making it difficult to keep the home heated. The floor covering and cabinetry
are either inferior or need to be replaced.
After Mr. Engelken's visit to the home, Mr. Engelken refigured the value of the property
based on his observations. Mr. Engelken consulted with a certified appraiser who had
knowledge of the dwelling due to recently being in the Mamali home. Mr. Engelken felt
the house value should be near $80,000.
An offer for settlement of $80,000 was then presented to the Mamalis for the 2007 year.
The Mamali's accepted the offer.
The settlement would result in a loss of tax revenue of $86 per year.
Pursuant to the Stipulation of Settlement, this appeal will be dismissed and the tax
assessment will be adjusted to $80,000 for January 1, 2007.
The proposed settlement will be presented to the Property Assessment Appeal Board
after fourteen days from the date indicated on the attached Notice of Voluntary
Settlement. If there are any objections to the proposed settlement, they should be
made known to the City Assessor prior to that time.
