RESOLUTION NO. 544-07
RESOLUTION AUTHORIZING THE PLAT OF SURVEY OF LT KUTSCH PLACE
Whereas, there has been filed with the City Clerk a Plat of Survey of LT Kutsch Place in
the City of Dubuque; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 and Lot 2 to have 0 feet of frontage where 50 feet of lot frontage is required
Section 2. That the Plat of Survey of LT Kutsch Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Plat of Survey.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the requested subdivision and location of
the property.
Staff reviewed the submitted Plat of Survey noting that the proposed lot split creates lots that do
not have frontage. Staff noted the plat facilitates the sale of a portion of the property and does
not result in creating any new lot without frontage on a public street.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the request is reasonable.
Recommendation
By a vote of 7 to 0 the Zoning Advisory Commission recommends that the City Council approve
the request subject to waiving lot frontage requirements..
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of L T Kutsch Place
INTRODUCTION
The submitted Plat of Survey of L T Kutsch Place subdivides an existing parcel of land
into two parcels to facilitate the sale of what will be called Lot 2 of L T Kutsch Place to
an adjacent property owner.
DISCUSSION
The submitted Plat of Survey of L T Kutsch Place resubdivides an existing parcel to
facilitate a sale of what will be Lot 2 of L T Kutsch Place to the owner of Lot 2 of 19
Sunny Side Addition. The submitted Plat of Survey is coming before the Zoning
Advisory Commission as both Lots 1 and 2 do not have frontage on a public or private
street. There is an existing house on what will be Lot 1, which currently does not have
frontage on a public or private street. The property currently is served by a private
access easement. The proposed Lot 2 of L T Kutsch Place will be consolidated with Lot
2 of 19 Sunny Side Addition and Lot 2 of 4 in Boxleiter Subdivision of Lot 1 of Caroline
Boxleiter Subdivision of Mineral Lot 160. That Plat of Survey is also attached for Zoning
Advisory Commission information only. Because the second Plat of Survey involves
consolidation of multiple lots into a single lot that has adequate frontage on a public
street and lot area, the Zoning Advisory Commission does not have to review the Plat of
Survey, but is only provided for informational purposes.
The replatting of the subject property does not result in any additional building lots being
created without lot frontage.
RECOMMENDATION
Planning staff recommends that the Plat of Survey of L T Kutsch Place be approved
subject to waiving the lot frontage requirements for both Lot 1 and Lot 2.
