INTRODUCTION
The enclosed resolutions authorize the pubic bidding procedure for the John F.
Kennedy (JFK) Road Sidewalk Installation Project, from Asbury Road to Iowa Hwy 32
(Northwest Arterial).
BACKGROUND
During the past ten years, there have been numerous requests for sidewalks along the
John F. Kennedy Road north of Asbury Road. When requests for sidewalks along John
F. Kennedy Road were received in 1998 and 1999, the Engineering Department
prepared improvement plans and assessments based on preliminary approval of the
project by City Council. At the July 6, 1999 public hearing, the City Council rejected the
project due to objections from the property owners who cited high assessment costs
and lack of pedestrian usage.
In preparation of the John F. Kennedy Road Reconstruction Project from Spring Valley
Road to the northerly City limits in 2002, Engineering had included the installation of
sidewalks with the project. At the April 15, 2002 public hearing on the plans for that
project, the City Council approved the elimination of sidewalks from the project.
Since October, 2006, several requests have again been made for sidewalk on this
section of John F. Kennedy Road. On May 7, 2007 the Engineering Department
requested direction from the City Council on how to proceed with the installation of
sidewalks along John F. Kennedy Road between Asbury Road and the Northwest
Arterial. (Note April 27, 2007 memorandum) The property owners along Gordon Drive,
whose backyards abut John F. Kennedy Road, have filed a petition in objection to the
placement of sidewalks in this area. The primary issues cited are: a) Steep backyard
slopes; and b) Accessibility to John F. Kennedy Road from Gordon Drive for winter
weather maintenance and to utilize equipment (shovels and/or snow blowers). On the
other hand, area residents and Eisenhower Elementary school staff have filed a petition
with over 75 signatures in support of sidewalk installation along this corridor.
On May 7, 2007, the City Council directed Engineering staff to study the feasibility of
sidewalks along this corridor, especially along the backyards of Gordon Drive.
On August 6, 2007, the City Council directed the Engineering Department to proceed
with initiating a sidewalk replacement project along John F. Kennedy Road, from Asbury
to Iowa Hwy 32 (Northwest Arterial).
DISCUSSION
This assessable project consists of 4,974 lineal feet of sidewalk installation on both the
east and west sides of JFK Road from Asbury Road to Iowa Hwy 32 (Northwest
Arterial). After the August 6, 2007 City Council meeting, the owners of Kennedy Manor
Apartments complex installed 616 lineal feet of sidewalk. Also, 288 lineal feet of
sidewalk has been constructed in front of the Summit Congregational Church on JFK
Road. Since the August meeting, approximately 45% of the sidewalks are now installed
along John F. Kennedy Road, between Asbury Road and Iowa Hwy 32 (Northwest
Arterial). The construction of the 904 lineal feet of sidewalk by Kennedy Manor
Apartments and Summit Congregational Church amounts to 15% of the sidewalks that
were remaining to be installed in this corridor prior to the August 6, 2007 City Council
meeting.
The estimate of probable cost for afour-foot wide sidewalk could be in the range of $25
to $28 per lineal foot if contracted by the property owner. Engineering proposes the
property owners be given until June 15, 2008, to complete the work. After that date,
any remaining properties will be included in an assessable project. The estimated
assessable rate of such work is $35 per lineal foot (including minor grading and property
restoration). This cost would be assessed to the respective property owner.
The assessment for a typical lot on Gordon Drive with 61.25 feet of frontage would be
$2,143.75. A lot with 125 feet of frontage would be $4,375. One of the largest
residential lots with 208-foot frontage would be assessed at $7,280. Most residential
lots have between 61 and 125 feet of frontage.

As part of a previous City Council directive, the City of Dubuque will not assess a
property owner more than 25% of the value of the property with improvements over a
cumulative ten-year period. Preliminary review indicates there will be one (1) property
affected by the 25% valuation rule and the City will be responsible for incurring those
costs. Financial assistance for new sidewalk installation is available for eligible owner-
occupied properties and is income level and family size based.
Small retaining walls and pedestrian access curb ramps will be needed to
accommodate the sidewalk installation in select areas along the corridor. It is proposed
that the City of Dubuque absorb this cost.
City of Dubuque Engineering Staff will work with the property owners directly on
sidewalk installation requirements if they elect to construct the sidewalks on their own. A
public information meeting will be scheduled to answer any questions property owners
have on installation of sidewalks.

The proposed City cost share includes retaining wall installation, the installation of
sidewalk adjacent to City owned property, pedestrian access curb ramps and any tree
removal.
The John F. Kennedy (JFK) Road Sidewalk Installation Project, from Asbury Road to
Iowa Hwy 32 (Northwest Arterial) will be funded through the annual capital improvement
project appropriation of City funds as noted above in the amount of $56,506.97. The
project, as outlined, will require Special Assessments in the amount of $172,822.51.
PROPERTY ASSESSMENTS
Public sidewalks are proposed to be constructed as part of this project. The construction
cost of these sidewalks would be 100% assessable to the adjoining property owner.
RECOMMENDATION
It is recommended that the City Council give preliminary approval to the Resolution of
Necessity, to approve the Preliminary Schedule of Assessment, to establish the date for
the public hearing, and to authorize the City Clerk to advertise for proposals.

the herein mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing on the
resolution of necessity, the property owner is deemed to have waived all objections pertaining to
the regularity of the proceeding and the legality of using the special assessment procedure.
Said improvements shall be constructed in accordance with the plans and specifications
which have been approved by the City Council and are now on file in the Office of the City
Clerk. The cost of making such improvement will be assessed against property lying with the
assessment limits.

Federal Building, Council Chambers, 350 W. 6th Street, Dubuque, Iowa. Said proposed
plans, specifications, form of contract and estimated cost are now on file in the office of
the City Clerk. At said hearing any interested person may appear and file objections
thereto.
The scope of the Project is as follows:
4,974 lineal feet of 4 foot wide sidewalk installation, along with pedestrian access
ramps, on the east and west sides of John F. Kennedy Road, from Asbury Road to
Iowa Hwy 32 (Northwest Arterial);
Small retaining walls to accommodate sidewalk installation in select areas along the
corridor; and
- Tree removal as necessary.

Notice is given that there is now on file for public inspection in the office of the clerk of
the City of Dubuque, Iowa, a proposed resolution of necessity, an estimate of cost, and
schedule showing the amounts proposed to be assessed against each lot and the
valuation of each lot within a district approved by the City Council of the City of
Dubuque, Iowa, for a public improvement of the type(s) and in the location(s) as follows:
The JFK Sidewalk Installation Project will provide for the installation of 4,974 lineal feet
of public sidewalk along John F. Kennedy Road from Asbury Road to Iowa Hwy 32
(Northwest Arterial)
The proposed district to be benefited and subject to assessment for the cost of such
improvements is described as follows:
John F. Kennedy Road from Asbury Road to Iowa Hwy 32 (Northwest
Arterial). All abutting properties in this area for sidewalk improvements.
The City Council will meet on the 17th day of December, 2007, at the Historic Federal
Building, Council Chambers, 350 W. 6th Street, Dubuque, Iowa, at which time the owners
of property subject to assessment for the proposed improvement or any other person
having an interest in the matter may appear and be heard for or against the making of
the improvement, the boundaries of the district, the cost, the assessment against any
lot, or the final adoption of a resolution of necessity. A property owner will be deemed
to have waived all objections unless at the time of hearing the property owner has filed
objections with the clerk.

CITY OF DUBUQUE PUBLIC IMPROVEMENT PROJECT
JOHN F. KENNEDY (JFK) SIDEWALK INSTALLATION PROJECT,
FROM ASBURY ROAD TO IOWA HWY 32 (NORTHWEST ARTERIAL)
Time and Place for Filing Sealed Proposals. Sealed bids for the work comprising
each improvement as stated below must be filed before 2:00 p.m. on the 10t" day of
January, 2008, in the office of the City Clerk, City Hall -First Floor, 50 West 13t" Street,
Dubuque, Iowa.
Time and Placed Sealed Proposals Will be Opened and Considered. Sealed
proposals will be opened and bids tabulated at 2:00 p.m. on 10 day of January, 2008,
at City Hall - Conference Room B, 50 West 13t" Street, Dubuque, Iowa, for
consideration by the City Council (Council) at its meeting on January 21, 2008. The
City of Dubuque, Iowa, reserves the right to reject any and all bids.
Time for Commencement and Completion of Work. Work on each improvement
shall be commenced within 10 days after the Notice to Proceed has been issued and
shall be fully completed by August 15, 2008.
Bid Security. Each bidder shall accompany its bid with a bid security as security that
the successful bidder will enter into a contract for the work bid upon and will furnish after
the award of contract a corporate surety bond, acceptable to the governmental entity,
for the faithful performance of the contract, in an amount equal to one hundred percent
of the amount of the contract. The bid security shall be in the amount of ten percent
(10%) of the amount of the bid and shall be in the form of a cashier's check or certified
check drawn on astate-chartered or federally chartered bank, or a certified share draft
drawn on astate-chartered or federally chartered credit union, or the governmental
entity may provide fora bidder's bond with corporate surety satisfactory to the
governmental entity. The bid bond shall contain no conditions excepted as provided in
this section.
Contract Documents. Copies of the construction documents may be obtained at the
Engineering Department, City Hall -Second Floor, 50 West 13t" Street, Dubuque, Iowa
52001. No plan deposit is required.
Preference for Iowa Products and Labor. By virtue of statutory authority, preference
will be given to products and provisions grown and coal produced within the State of
Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes.
Sales Tax. The bidder should not include sales tax in its bid. A sales tax exemption
certificate will be available for all material purchased for incorporation in the project.
