Sealed bids were received for White Street Reconstruction - 21st to 32nd Street. Public
Works Director Mike Koch recommends award of the contract to the Iow bidder, WC
Stewart Construction Co., in the amount of $2,541,474.40. The bid is 14.1% under the
engineer's estimate.
Consistent with trying to reduce costs for development in Dubuque, this project will use
plastic pipe for the sewer mains and sewer laters.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the award of the construction contract for
the White Street Reconstruction - 21 sT to 32nd Street.
DISCUSSION
Sealed bids were received on February 7, 2002. The Iow bid was submitted b~y
W.C. Stewart Construction Co. in Dubuque, Iowa, in the amount of
$2,541,474.40.
This amount is based upon the City bid alternate for plastic pipe for the sanitary
sewer main and 4" private sewer laterals to the White Street right-of-way. The
bid is 14.1% under the engineer's base estimate.
During the City's review of the bids, it was noted that two contractors significantly
underbid one of the bid items that. was tabulated incorrectly, causing what is
called an "unbalanced bid". An unbalanced bid is a bid containing unit prices
which do not reflect reasonable and actual costs plus a reasonable proportionate
share of the bidder's anticipated profit, overhead costs, and other indirect costs
to complete that item.
The bid item in question was 48-inch storm sewer manhole sidewall. The cost to
supply 48-inch sidewall is over $60 per foot. One contractor bid a price to
purchase and install the manhole sidewall for $1 per foot and the second
contractor for $30 per foot. These pnces obviously do not reflect reasonable
prices for this work and is a clear case of unbalanced bidding. Unbalanced
bidding is prohibited by the City's standard specifications because it makes
comparison of bid proposals extremely difficult and can result in a situation where
the final contract price for the "lowest bidder" can actually be higher than if the
contract were awarded to one of the other bidders who fairly priced the bid item.
The base bid included the reconstruction of 6,287 feet of sanitary sewer main
with ductile iron pipe. The City also bid an alternative of PVC pipe for the sanitary
sewer main. A significant benefit was realized by bidding the PVC sewer main
pipe versus the ductile iron pipe. The cost-savings on the PVC sewer main was
n excess of $95,000 over the ductile iron bicl; this is an $185,000 savings from
the engineer's estimate.
The base bid included 298 sewer laterals to be replaced with cast iron pipe. An
alternate bid item was included to reconstruct the pdvate sewer laterals with PVC
piping. The PVC-constructed sewer lateral is being recommended for it was n
excess of $43,000 under the cast iron bid for pdvate laterals. Each property
owner's sewer lateral assessment will be reduced by more than 30% over the
odginal engineer's estimate.

The two unbalanced bids were rejected as not being responsive to the bid
specifications, and therefore, are not considered valid bids. This does not have
an effect on the determination of the Iow bidder.
RECOMMENDATION
I recommend that the construction contract be awarded to WC Stewart
Construction Co., in the amount of $2,541,474.40, which is based on the
alternative of PVC piping.

Street Construction Funds are available from the Fiscal Year 2001 budget in the
amount of $1,010,922 and $1,102,283 from the Fiscal Year 2002 budget, for total
City funds available of $2,113,205. This leaves a balance of $513,272 in Street
Construction Funds.
A balance in the Sewer Construction fund ($416,879) is available due to savings
on the High Bluff Sanitary Sewer Project and delay of the Keyway Sanitary
Sewer Project. In addition, $64,724 of the Street Construction Fund balance of
$513,272 noted above will be used to fund construction of the sanitary sewer.
The Water Extension Capital Improvement Project will be used to cover
$253,000 of the cost of watermain, with the balance of $258,874 coming from the
Street Construction fund balance noted above.
Low- to moderate-income property owners subject to street and sewer lateral
assessments will be eligible for financial assistance ranging from 20 to 100
percent of the Street assessment for owner-occupied resident property
depending on family size and income level. This financial assistance program is
made available through the 1% Local Option Sales Tax.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution awarding the
White Street Reconstruction Project - 21st to 32nd Street to WC Stewart
Construction Co.

Whereas, the City Council has proposed a Resolution of Necessity for the White Street
Reconstruction - 21st to 32"d Street Project - Supplemental Assessments to Resolution 23-02,
has given notice of the public hearing thereon as required by law; and
Whereas, the public hearing has been held, all persons offering objections have been
heard and consideration given to all objections and is pending before this Council; and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
Adopted, without amendment, and all objections filed or made having been dully
considered are overruled.
Adopted as amended by the Schedule of Assessments attached hereto as Exhibit A,
and made a part hereof by reference. All objections filed or made having been duly

and notice to bidders published in a newspaper published in the City of Dubuque, Iowa
on the 11th day of January, 2002.
Whereas, said sealed proposals were opened and read on the 7th day of
February, 2002, and it has been determined that the bid of W.C. Stewart Construction
Co. of Dubuque, Iowa, in the amount of $2,541,474.40 was the lowest bid for the
furnishings of all labor and materials and performing the work as provided for in the
plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to W.C. Stewart
Construction Co. and the Manager be and is hereby directed to execute a contract on
behalf of the City of Dubuque for the complete performance of the work.
BElT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond,
the City Treasurer is authorized and instructed to return the bid deposits of the
unsuccessful bidders.

1) Would allow a wider green area to accomodate small trees on the 22nd and 23rd
lmndred blocks on tl~: east side, and some green area on the west side of the 21st
block. AH major overhead wires on wcst side.
2) This would better align the 21st hundred block of White with the 22nd hundred
block at 22nd street h~tersection.
3) Lengthen driveway approaches between sidewalk and curb making a lower pitch to
driveway so vehicles 'won't hit bottom driving up. There are no alleys between
Central-White-Jackson.
4) Would save the city between $15,000-$20,000 by narrow~g these (3) blocks from
41' to 37' and maybe more if thickness is 7" instead orS" as propose& (-4' X 3
blocks=S15,000-$20,000 saved)
