Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant spoke in favor of the request, indicating that the subject location is ideal
for their residents as the parcel is close to shopping and public transit.
Staff reviewed the surroundiing zoning and land use and indicated that a shared
access will be constructed to serve the proposed multi-family building and the future
Health Services Credit Union.
There were two letters submitted in support of the rezoning.
The Zoning Advisory Commission discussed the request, noting that there is multi-
family zoning existing to the west across Keyway Drive and that the residential
apartments will not adversely impact adjacent commercial property.
Recommendation
By a vote of 7-0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

ORDINANCE NO. 6-02
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT END OF JOHN F. KENNEDY CIRCLE FROM
C-3 GENERAL COMMERCIAL DISTRICT TO R-4 MULTI-FAMILY RESIDENTIAL
DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter described
property as shown in Exhibit A, and to the centerline of the adjoining public right-of-way,
all in the City of Dubuque, Iowa from C-3 General Commercial District to R-4 Multi-
Family Residential District; and
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication, as
provided by law.

To Whom It May Concern:
Area Residential Care would like to construct an apartment building on the lot we are
requesting to have re-zoned. The apartment building would be relatively small (see
attached drawing) but would have several units designed and built to wheelchair
accessibility standards. The location of the property is ideal for the type of clientele that
we intend to serve in the apartment building for several reasons.
1. The residents would have access to grocery stores and other retail shopping
without having to :rely on assisted transportation to and from the shopping areas.
2. The land is relatively flat and therefore allows for independent mobility for people
with wheelchairs in the immediate vicinity of their apartments.
3. The property has both residential and commercial properties in its immediate
vicinity. This assists with the prevention of isolation that is sometimes associated
with residential options for people with disabilities or Iow incomes.
Area Residential Care has been searching for some apartment style living settings with
these characteristics for some time now, for people with physical and mental disabilities.
We have been unsuccessful in our search until now. Existing residential properties with all
of these characteristics simply were not available to us. We would therefore respectfully
request that the property be re-zoned to allow for the construction of an apartment building
at ground level.

Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate a use for this property.
Impact of Request on:
Utilities: Existing utilities, are adequate to serve the site.
Traffic Patterns/Counts: John F. Kennedy Circle is a boulevard-style street that
directly connects to John F. Kennedy Road. No traffic counts are available for this
street.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.

Adjacent Properties: Staff does not anticipate any adversely impacts to adjacent
properties as the proposed rezoning is less intense than the surrounding
commercial property.
CIP Investments: None proposed.
Statf Analysis: The Area Residential Care Foundation is requesting rezoning of the
subject parcel from C-3 General Commercial to R-4 Multi-Family Residential. Attached
to this staff report is a letter fi'om Area Residential Care, Inc. explaining their request to
rezone the parcel to a multi-family designation.
The subject parcel is actually a portion of Lot 5 of Herrig JFK Addition. The entire
property is currently owned by the Health Services Credit Union, who plan in the future
to develop their portion of the parcel for a credit union building. Attached to this staff
report is a layout plan that shows the proposed location of the ARC apartment building.
Access to the site will be by way of a shared access drive from John F. Kennedy Circle.
No access to Keyway Drive is planned. The property surrounding the subject parcel is
primarily C-3 General Commercial; however, adjacent to the parcel on the west are
existing apartments along the; west side of Keyway Drive. Planning staff does not
believe that the proposed rezoning to R--4 would adversely impact the surrounding
commercial property.
Planning staff recommends the Zoning Advisory Commission review Section 6-1.1 of
the Zoning Ordinance that establishes criteria for the review of rezoning requests.
