Kennedy (JFK) Road Sidewalk Installation Project Gordon Drive Properties DATE: December 10, 2007 INTRODUCTION The purpose of this memo is to provide information on the John F. Kennedy (JFK) Road Sidewalk Installation Project as it relates to the Gordon Drive properties. BACKGROUND At the December 3, 2007 City Council meeting the City Council adopted the Resolution of Necessity, approved the Preliminary Schedule of Assessment, established the date for the public hearing, and authorized the City Clerk to advertise for proposals for the John F. Kennedy (JFK) Road Sidewalk Installation Project between Asbury Road and the NW Arterial (IA Hwy 32). The public hearing has been set for 6:30 pm, December 17, 2007, in the City Council chambers at the Historic Federal Building. The preliminary Schedule of Special Assessments was mailed to all impacted property owners on December 6, 2007. The mailing also included an informational sheet concerning the special assessments. (Note attachment.) DISCUSSION Several Gordon Drive property owners who would be potentially affected by the project have contacted the Engineering Department and requested that a public informational meeting be held prior to the City Council public hearing. Also these property owners have been expressed opposition to the sidewalk installation on Gordon Drive due to maintenance issues. Although there is basically no new information to share until the Council's decision, the Engineering Department will hold a public informational meeting on December 11. BUDGET IMPACT The current estimate of probable cost for the John F. Kennedy (JFK) Road Sidewalk Installation Project from Asbury Road to the NW Arterial (IA Hwy 32) is as follows: Total Project Cost Estimate Construction Contract $ 189,528.50 Contingency (10%) 18,952.85 Construction Engineering & Inspection (10%) 20,848.14 Total Project Cost ~ 229,329.49 Based on the current total project cost, the following represents that portion of the Gordon Drive sidewalk installation. Project Cost Related to Gordon Drive Sidewalk Installation Estimate Gordon Drive Sidewalk Construction $ 44,532.87 Contingency (10%) 4,453.29 Construction Engineering & Inspection (10%) 4,898.62 Gordon Drive Sidewalk Installation Costs $53,884.77 The funding sources for that portion of Gordon Drive sidewalk installation are as follows: Funding Sources for Gordon Drive Sidewalk Installation Amount Assessments for the Gordon Drive Residents $23,571.45 City Share of Gordon Drive Assessments 30,313.32 Total Funding for Gordon Drive Sidewalk Installation 53 884.77 The proposed City cost share includes any retaining wall installation, the installation of sidewalk adjacent to City-owned property, pedestrian access curb ramps and any tree removal. ACTION TO BE TAKEN As a summary, if the Gordon Drive portion is removed from the John F. Kennedy (JFK) Road Sidewalk Installation Project, $53,884.77 would be removed from the project costs, with comparable assessment savings. KENNEDY ROAD FROM ASBURY ROAD TO THE NORTHWEST ARTERIAL -SIDEWALK INSTALLATION INTRODUCTION Enclosed is your individual Preliminary Assessment for the above project. This preliminary assessment was approved at the December 3, 2007 City Council meeting. The project, its scope, design and future will be discussed at the December 17, 2007 Public Hearing with input from citizens either in attendance or any written input received by the City Clerk no later than Wednesday noon, December 12, 2007. BACKGROUND On May 7, 2007 the City Council directed Engineering staff to study the feasibility of sidewalks along John F. Kennedy Road between Asbury and the Northwest Arterial. After City Council review of the information, initiation of the project was given and approved at the December 3, 2007 council meeting to proceed with the setting of the public hearing and approval of the Preliminary Schedule of Assessments. PROJECT SCOPE The initiated project includes 4,974 lineal feet of sidewalk installation on both the east and west sides of JFK Road from Asbury Road to Iowa Hwy 32 (Northwest Arterial). Small retaining walls may be needed to accommodate the sidewalk installation in select .areas along the corridor. Specifically in the area where guardrail is located on a portion of the east side of JFK Road between Asbury Road and Kaufmann Avenue and the backyard slopes of 11 properties on Gordon Drive, installing sidewalk in this area is more challenging. City staff recommends that sidewalks be placed behind the guardrail approximately two (2) feet from the curb at the elevation of the existing ground. This will avoid extensive retaining wall construction. Engineering estimates approximately 25 feet of two-foot high retaining may be needed in this area. The remaining areas of the JFK Road corridor may require retaining walls at several locations between Marywood and Kaufmann or, in some instances, minor grading on private property to bring the proposed sidewalk to grade. It is proposed that the City of Dubuque absorb these retaining wall costs. The distance and elevation between the sidewalk and the curb will vary to avoid additional retaining walls. A bus stop currently exists adjacent to 2640 Kennedy Road. This bus stop was installed in December, 2004 to primarily serve residents that live in a group home on Marywood Drive that is operated by Hillcrest Family Services. This location currently has six (6) passengers who regularly use this stop. Based on coordination efforts with ADA (American with Disabilities Act) consultants and the City's Human Rights Director Ketly Larson, the City is required under federal ADA guidelines to install sidewalks to this location if transit service is continued. TIME TABLE The schedule for the project is as follows: Publish Public Hearing Notice on Plans, Specs, Assessments December 7, 2007 Mail Special Assessment Notice to Property Owners December 7, 2007 Publish Notice of Special Assessment: 1st Publication: December 7, 2007 2nd Publication: December 14, 2007 Publish Notice to Bidders, Advertise for Bids December 14, 2007 Public Hearing on Plans & Specs, Spec. Assessments December 17, 2007 Receipt of Bid Proposals (Bid Letting) January 10, 2008 Award Construction Contract January 21, 2008 Property Owner Completion Deadline June 15, 2008 Project Completion Date: August 15, 2008 Property owners would have until June 15, 2008 to complete the installation and any remaining parcels after that date would be installed by the successful contractor and assessed against the abutting owner. ASSESSMENTS The estimate of probably costs for afour-foot wide sidewalk could be in the range of $25 to $28 per lineal foot if contracted by the property owner. Engineering proposes the property owners be given until June 15, 2008, to complete the work. After that date any remaining properties will be included in an assessable project. The estimated assessable rate of such work is $35 per lineal foot (including minor grading and property restoration). This cost would be assessed to the respective property owners. If property owners decide to not install and have the City perform the installation a final assessment would be developed after completion of the project. These final assessments will be equal to or less than the preliminary assessment stated. Most residential lots have between 61 and 125 feet of frontage with one of the largest lots at 208 foot. ACTION TO BE TAKEN The City Council has set the Public Hearing for December 17, 2007 in the City Council Chambers at the Federal Building, 6th & Locust beginning at 6:30 p.m. at their regularly scheduled council meeting. At that time any citizen may address the council with their concerns regarding this project. Now that the Resolution of Necessity has been approved by City Council on December 3, 2007, petitions can be filed with the Office of City Clerk and should be submitted no later than Wednesday, December 12, 2007. If the City Council approves this project either totally or partially, a public informational meeting will be held with the affected residents. These informational meetings offer mutual benefit to the City and property owner to discuss the project as approved by City Council, construction design, details and standards, any unique situations a property owner may have, time table and financial assistance. As always, City Engineering is available to answer any construction and design questions but want to reiterate the scope of the project will be determined by the City Council.
