SUBJECT: Streets in Southgate Planned Unit Development
DATE: December 13, 2007
Dan Mueller, the developer of Southgate, has requested that the City accept two private
streets in this development-Gateway Drive and Stonehill Drive. City Engineer Gus
Psihoyos recommends that the City not accept either Gateway Drive or Stonehill Drive
as public streets.
Existing improvements in the development adjacent to the streets over the last 15 years
are a concern to the Engineering Department and the Water Department. The concerns
are:
1. Signage behind the curb makes it difficult for maintenance of the street and
construction of sidewalk.
2. Required screening for site development has been established where the
sidewalk should be constructed. Elimination of the screening puts the site in
noncompliance with Zoning Regulations.
3. Inadequate room behind the curb for the construction of sidewalk and parkway.
4. Driveways do not meet City standards. Since the driveway approaches were not
constructed to accommodate sidewalks, the approaches and a portion of the
parking lot pavement need to be reconstructed.
This development was originally built with private streets and, it is the opinion of staff,
that the streets should stay private. When the City assumes responsibility for streets,
the City also assumes a significant amount of maintenance responsibility, including
snow plowing, patching and ultimate replacement of the street. The developer
obviously sees these expenses as a liability and wishes the City to assume
responsibility for that liability
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Honorable Mayor and City Council, staff recommends that the City does not accept
either Gateway Drive or Stonehill Drive as public streets. (Note attachment.)

ACTION TO BE TAKEN
The Engineering Department request concurrence with the recommendation that
Gateway Drive and Stonehill Drive within the Southgate PUD are not accepted as public
streets.

Dear Mayor and City Council Members:
Dubuque Southgate Development and the property owners served by Gateway Drive and Stone
Hill Drive would like to request that the City of Dubuque accept the dedication of both Gateway
Drive and Stone Hill Drive to the care and responsibility of the City of Dubuque.
The property owners have been paying for the care and maintenance of these streets since 1989
and feel that in return for the property taxes paid annually (2006 assessments of $101,176) that
the City should be caring for them in return. The City has accepted and does provided for the care
of the street directly West and Northwest or this property. The City is currently maintaining
Southpark Ct., First Hill Drive and Cross Hill Drive directly opposite the Hwy 61-151 / 52
intersection. These were properties developed by A.J. Spiegel and Bob Kiel.
The streets of Dubuque Southgate were constructed to the specifications of the City with 6 inches
of base stone and 7 inches of asphalt paving, concrete curb and guttered as per plans approved by
the City. Construction work was overseen by the City. They are however none conforming to
City standards in overall width and right of way width. This was due to the understanding that the
City required the development to be a PUD and that streets within such zone were required to be
private. Since our development the City changed it position with respect to this type development
allowing straight C-3 zoning and street dedication, examples being Spiegel and Kiel
Developments.
We are will to review with the City any requested expansion of easements to allow for
maintenance of the streets. We do, however request consideration that some signage there may be
within any expanded easements. All utilities, sewer, water, natural gas and electrical service lines
do lie within existing right of ways and / or utility easements.
We greatly respect the consideration of the Council in this request.
