City Engineer Gus Psihoyos is recommending City Council acceptance of the
construction contract for the Dubuque Furniture & Flooring Selective Demolition &
Restoration Project as completed by Epic Construction, establishment the final contract
amount at $150,655 and authorization for final payment of that amount to Epic
Construction.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Dubuque Furniture & Flooring Selective Demolition & Restoration (Project).
BACKGROUND
In April of 2010 the City Council adopted Resolution 92-10 authorizing the City to enter
into a Programmatic Agreement (PA) among the U.S. Army Corp of Engineers
(USACE), the Iowa Department of Natural Resources (IDNR), the State Historic
Preservation Officer(SHPO), and the City of Dubuque regarding the construction of the
Bee Branch Creek Restoration Project. The PA outlines the manner in which the City
can proceed with the Bee Branch Creek Restoration Project in accordance with the
requirements set forth in 36 CFR Part 800, Section 106 (Section 106 Process) which
ensures that no unnecessary harm comes to historic properties. As outlined in the PA,
"the City shall ensure that all historic architectural properties . . . whose removal is not
necessary for the project will be protected from both direct and indirect adverse effects
produced by activities associated with (construction of the project)."
On September 16 of 2013 the City Council adopted Resolution 292-13 authorizing the
acquisition of 430 Garfield as necessary for the Bee Branch Creek Restoration Project.
The proposed culvert system for the Bee Branch Creek Restoration Project required the
acquisition and removal of the northeast portion of the building at 430 Garfield, which
was obstructing the site requiring excavation.
DISCUSSION
The acquisition of the warehouse addition to 430 Garfield was necessary to enable the
City to construct the Bee Branch Creek culvert system. To that end, contract
documents were prepared for the Project. The Project involved the demolition of the
warehouse including all roofing, siding, walls, concrete floors, and concrete foundations.
The demolition was done with 96.45% of material diverted from the landfill coinciding
with Dubuque's sustainable ideals.
The Dubuque Furniture & Flooring Selective Demolition & Restoration Project was
completed by EPIC Construction of Kieler, WI, in the final contract amount of
$150,655.00, which is a 9.7% increase from the original contract in the amount of
$137,285.00. The cost increase can be attributed to additional work related to additional
masonry repair of the remaining building that was uncovered after the addition was
removed and removal of two existing wood headers to provide a water tight building
envelope as required by the purchase agreement.
On June 16, 2015 EPIC Construction requested final payment to the Contractor.
RECOMMENDATION
I recommend that the City Council accept the improvements and establish the final
contract amount at $150,655.00.

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution to accept the
improvements and to authorize the final payment for the contract amount of
$150,655.00 to EPIC Construction for the Dubuque Furniture & Flooring Selective
Demolition & Restoration.

RESOLUTION NO. 248-15
ACCEPTING THE DUBUQUE FURNITURE & FLOORING SELECTIVE DEMOLITION
& RESTORATION PROJECT AND AUTHORIZING THE PAYMENT TO THE
CONTRACTOR
WHEREAS, the public improvement contract for the Dubuque Furniture & Flooring
Selective Demolition & Restoration Project (the Project) has been completed has been
completed by the Contractor, EPIC Construction (Contractor), the City Engineer has
examined the work and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $150,655.00; and
WHEREAS, the Contractor has previously been paid $143,122.25, leaving a balance
of $7,532.75; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1.The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2.The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $7,532.75 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
