City Engineer Gus Psihoyos recommends City Council acceptance of the storm water
detention facility that the developer, McDermott Brothers Construction, has completed
and is dedicating in Brunskill Street Place in the City of Dubuque. Maintenance of the
facility will be the responsibility of the City, which will assess said costs to the property
owners in Brunskill Street Place.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Storm Water Detention Facility in Brunskill Street Place
INTRODUCTION
The enclosed material provides for City Council acceptance of the storm water detention
facility that the developer, McDermott Brothers Construction, has completed and is dedicating
in Brunskill Street Place in the City of Dubuque, Iowa.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 342-12, the developer of
Brunskill Street Place was required to install certain improvements including sanitary sewer
main and storm water detention facilities and to dedicate these improvements to the City upon
completion. All public improvements, except the detention facilities, were accepted on January
22, 2013 by Resolution No. 14-13 for Brunskill Street Place.
DISCUSSION
The Subdivision Ordinance requires that upon completion of the required public improvements,
the developer shall notify the City in writing of the completion of the improvements, requesting
that the City either approve or reject the acceptance of the improvements, together with a
statement of reasons for any rejection.
On September 23, 2015, McDermott Brothers Construction requested the City's acceptance of
the detention facilities in Brunskill Street Place. Upon inspection by the City, it has been
determined that all the detention facilities required by Resolution No. 342-12 have been
completed in accordance with plans approved by the City Council and in conformance with
City specifications. Maintenance of the detention facility would become the responsibility of the
City with the costs for same being assessed to the property owners within Brunskill Street
Place.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the storm water detention facility in
Brunskill Street Place. Maintenance of the facility will be the responsibility of the City which will
assess said costs to the property owners in Brunskill Street Place.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the storm water
detention facility in Brunskill Street Place.

RESOLUTION NO. 338-15
ACCEPTING STORMWATER DETENTION FACILITIES IN BRUNSKILL STREET
PLACE, IN THE CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution Numbers 342-12, certain public improvements
including stormwater detention facilities on Lot A of Brunskill Street Place No. 1 were
installed by the developer of Brunskill Street Place in the City of Dubuque, Iowa; and
Whereas, the said storm water detention facilities have been completed and the
City Manager has examined the work and has filed a certificate stating that the same
has been completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the improvements be
accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said storm water detention facilities in Brunskill Street Place in the City of Dubuque,
Iowa, be and the same is hereby accepted.
Section 2. That maintenance of said improvements shall be the responsibility of
the City and assessable to the property owners as outlined in Resolution Numbers 342-
12.
