Sealed bids were received by the Iowa Department of Transportation for the Bee
Branch Creek– Basin Overlook & 22nd Street Parking Lot Project. City Engineer Gus
Psihoyos recommends award of the construction contract to the low bidder, Portzen
Construction, Inc., in the amount of$1,420,509.10, which is 15.6% above the engineer's
estimate, subject to Iowa Department of Transportation approval.
The overlook improvements will be adjacent to the Lower Bee Branch Creek near the
16th Street Detention Basin. Features of the overlook and plaza area will include a
pavilion, concrete sidewalk, lighting, drinking fountains, bike racks, trash receptacles,
benches, trees, shrubs, and interpretive signs.
The improvements associated with the 22nd Street parking lot involves the construction
of a 12-space trailhead parking lot at Prince Street to provide trail access for the Bee
Branch Creek Mississippi River Trail Route and the 26-mile Heritage Trail. The design
features a pervious pavement system to infiltrate storm water and minimize the need for
storm sewers. The proposed storm sewer drainage system also includes a nutrient
separating baffle box to further mitigate the discharge of pollutants into the adjacent Bee
Branch Creek. The project also includes sidewalk, lighting, benches, flag poles, litter
receptacles, a water fountain, trees, shrubs, and other landscaping elements.
The funding specifically set aside in the budget for these improvements is $1,764,748.
Therefore, even though the low bid exceeded the engineer's estimate, the established
funding is sufficient to award the contract to the low bidder. Project funding includes
$960,000 from a DMATS Transportation Alternative Program appropriation and
$228,500 from a Vision Iowa RECAT grant.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to seek authorization to award the construction
contract for the Bee Branch Creek— Basin Overlook & 22nd Street Parking Lot Project,
Iowa DOT Project No. TAP-U-2100(683)--81-31.
BACKGROUND
In April of 2011, the City Council passed Resolution 114-11, authorizing the execution of
the River Enhancement Community Attraction and Tourism (RECAT) Program Grant
which includes funding for an overlook at the 16th Street Detention Basin (Basin
Overlook) and the trail head parking at 22nd Street (22nd Street Parking Lot).
In December of 2014, the City Council passed Resolution 383-14 authorizing the City
Manager to sign and submit a Request for Transportation Improvement Program Funds
to the IDOT for the use of Dubuque Metropolitan Area Transportation Study (DMATS)
funding for the Basin Overlook improvements.
In February of 2015, the City Council passed Resolution 33-15 authorizing the City
Manager to submit a Request for Transportation Improvement Program Funds to the
IDOT for the use of DMATS funding for the 22nd Street parking improvements.
In May of 2015, DMATS amended their FY 2015-2018 Transportation Improvement
Program budget to include $960,000 in Transportation Alternative Program (TAP)
funding for the improvements associated with the Basin Overlook and the 22nd Street
Parking Lot.
In July of 2015, the City Council passed Resolution 223-15 approving the Federal -Aid
Agreement with the IDOT in order for the City to receive the Transportation Alternatives
Program funding for the project.
DISCUSSION
The Upper Bee Branch Creek Restoration Project (Phase 7 of the Bee Branch
Watershed Flood Mitigation Project) will be constructed through multiple contracts. The
Bee Branch Creek— Basin Overlook & 22nd Street Parking Lot Project is the fourth
contract.
The overlook improvements will be adjacent to the Lower Bee Branch Creek near the

Due to the use of DMATS TAP funding, the project was let through the Iowa
Department of Transportation (Iowa DOT) who administers the funds on behalf of.
both the federal and state governments.
BID RESULTS
The bid letting was held by the Iowa Department of Transportation (Iowa DOT) on
November 17, 2015. Portzen Construction, Inc. of Dubuque, Iowa submitted the low bid
in the amount of$1,420,509.10. This amount is 15.6% above the engineer's estimate
of probable cost. A summary of the bids received is as follows:

Portzen Construction, Inc. of Dubuque, Iowa in the amount of$1,420,509.10, subject to
Iowa DOT approval of award.

of award.

Whereas, said sealed proposals were opened and read by the Iowa Department of
Transportation on the 17th day of November, 2015 and it has been determined that
Portzen Construction, Inc. of Dubuque, Iowa, with a bid in the amount of $1,420,509.10
is the lowest responsive, responsible bidder for the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That a Public Improvement Contract for the Project in the amount of $1,420,509.10 is
hereby awarded to Portzen Construction, Inc., subject to the concurrence by Iowa
Department of Transportation, and the City Manager is hereby directed to execute a
Public Improvement Contract on behalf of the City of Dubuque for the Project.
