Section 203, "Board Of Appeals" is hereby amended by repealing such section and i
replacing such section with a new section in lieu thereof as follows: fl
Section 203. Mechanical Code Board.
(a) Board Established. In order to determine the suitability of alternative materials and
methods of installation, to provide for reasonable interpretations of the mechanical
code, to serve as an appeal body for the decisions of the building official, to advise the
city council on all heating, ventilating, air conditioning and refrigeration regulations and
procedures, and to provide for examining applicants for certification of competency and
issuing certificates of competency and registration, there is hereby created the
mechanical code board.

(b) Membership. The mechanical code board shall consist of seven (7) members
appointed by the city council. Each member shall have a background or experience in
sheet metal contracting, hot water and steam fitting contracting, hot water and steam.

(c) Term Of Office. The term of office of all board members shall be three (3) years.

(d) Rules And Regulations. The board shall make such rules and prescribe such
procedures as may be reasonably necessary for its operation, except that such rules
shall include the following:
i
(1) The chairperson of the board shall be elected annually by a majority of the board.
(2) The building official, or the building official's designee, shall be secretary of the !,
board. The secretary shall arrange for meetings and prepare and keep such minutes
and records and perform such other clerical work as the board may direct.
(3) Four (4) members of the board shall constitute a quorum. The affirmative vote of four
(4) members of the board shall be necessary to adopt any motion.

(4) Upon completion of the term of office, a member of the mechanical code board shall
continue to serve until their successor has been duly appointed.
(5) The mechanical code board shall meet at least once every three (3) months upon
call of the chairperson, secretary or city manager. A member of the mechanical code
board shall attend at least two-thirds (Z/3) of all scheduled meetings within a twelve-
month period. If any member does not attend such prescribed number of meetings, it
shall constitute grounds for the board to recommend to the city council that said
member be replaced.
(6) The attendance of all members shall be entered on the minutes by the secretary.
(7) All meetings shall be held in conformance with the provisions of the Iowa open
meetings law.
(8) The mechanical code board shall file with the city clerk a copy of the minutes of each
meeting of the board within ten (10) working days after such meeting.
(9) All administrative, personnel, accounting, budgetary, and procedural policies of the
city shall govern the mechanical code board in all of its operations.
(10) Any person who is aggrieved by a decision of the building official resulting from the
enforcement of the mechanical code may appeal from such decision to the mechanical
code board, and said board shall serve as an appeal board. In case the aggrieved party
is a board member, said member shall be disqualified as a member of the board acting
as an appeal board until the person aggrieved has been heard and a decision rendered.
The appeal shall be made by the person aggrieved giving written notice of such appeal l
to the building official at the building official's office within seven (7) days. The building
official shall, within seven (7) days thereafter, notify the board of the appeal. The
mechanical code board shall meet within seven (7) days after receiving such notice and
shall render a decision within five (5) days thereafter. Any interested party, including the
building official, may have the right to present such party's case to the appeal board,
whose decision shall be final unless appealed to the district court as provided by law.

MEDIACOM CABLE SERVICES FRANCHISE j.
PROPOSED RENEWAL AGREEMENT

1. Franchise Term
The proposed franchise term is fifteen (15) years. The franchise would be
for the delivery of cable services and would be nonexclusive.

2. Broadcast Basic Tier
While the size, contents, and pricing of a basic cable service package
cannot be a formal term of the agreement, Mediacom has represented to
the City that it will begin to offer a limited "broadcast basic" package with
21 channels. By federal law, these must include the broadcast TV j
stations and the local PEG (Public, Educational and Government) access
channels.

3. Senior Citizen Discount j
Mediacom will maintain the current ten percent (10%) Senior Citizen
discount on the 72-channel Family Cable tier, which is currently priced at {
$45.50 for most subscribers, $40.95 for seniors. There will be no discount
on the price of the limited "broadcast basic" package. A subscriber(head
of household) who reaches the age of 65 and submits an application to
Mediacom with proof of age and proof of at least one other utility in their
name at that address will qualify for the Senior Citizen discount.
4. Technology Updating Fund
To keep the cable system as technologically current as possible,
Mediacom will contribute $300,000 per year in years one through twelve of P
the franchise, (totaling $3.6 million), to an Updating Fund. This money
can only be spent by joint agreement of the City and Mediacom.

5. System Upgrade f

Within twenty-four (24) months of the signing of the agreement, Mediacom
will upgrade the electronics in their Dubuque cable system to increase the
total bandwidth (capacity)from the current 750 MHz to 860 MHz.
Mediacom would expend all or part of the first four years of contributions
to the Updating Fund (above) on this upgrade.

11. Industrial Parks
In addition to any existing Mediacom fiber and the new business fibers to
be installed along with the I-Net, Mediacom will extend designated fiber i
links to Dubuque Technology Park and Dubuque Industrial Center West
within two years of the agreement.
12. Free Service To Certain Facilities

Upon request of the City, Mediacom will provide one activated cable II
service drop and Basic Cable Service to each school and each facility y
owned or leased by the City at no charge. Each institution may further
distribute the service within the facility at its own expense for uses 3
consistent with the institution's mission.

Also, Mediacom will provide one 200-ft. (maximum) drop and maintain one
connection for Internet access to one computer terminal in each school or
library within the franchise area at no charge. Any additional costs will be

borne by the school or library for a time and materials charge.

13. Trenching
When either the City or Mediacom is trenching in the public right-of-way,
the other party would have the right to install its own conduit at the same
time. However, if the City ever establishes a municipal communications
utility that competes with Mediacom, the City would have to reimburse 1,
Mediacom on a pro-rata basis for its portion of the trenching costs for any
cable the City previously installed in Mediacom trenches.
14. Importing Broadcast Television Signals
All broadcast television station signals will be imported into the Dubuque
system by optical fiber, resolving a 50-year-old reception problem.

15. Universal Service !'
Mediacom is required to extend residential-type cable service to all
businesses and residences within the City.

Mediacom will direct hearing-impaired callers to Answer Iowa, a state-
wide service, for assistance. The company will clearly advertise the
availability of the Answer-Iowa service.

service gross revenues (estimated at $25,000 per year)to distribute in the
community. Initially, the fund will focus upon arts and cultural affairs. The
board of the foundation will include Mediacom employees and members of
the City's Cultural Affairs Advisory Commission.
22. Remedies !j
Instead of moving directly to termination of the franchise as the only
penalty for a violation of the franchise agreement, the new franchise
provides incremental steps and monetary penalties for different types of
violations.

23. Right-of-Way Ordinance

Mediacom's use of the rights of way will be the subject of a separate
ordinance based upon one devised by the Iowa Municipal Attorneys

Association, with Corporation Counsel Barry Lindahl participating.
Although this ordinance will initially apply only to Mediacom, the goal will
be to eventually apply the right of way ordinance to all utilities.

TRANSIT ADVISORY BOARD

5-1-1: BOARD CREATED:
There is hereby created the Transit Advisory Board. �
5-1-2: PURPOSE:
The purpose of the board is to recommend the establishment of routes, schedules, and 1
changes in fare structure and/or rates. j
5-1-3: INTERNAL ORGANIZATION AND RULES:

The board may adopt rules and regulations to govern its organizational procedures as
may be necessary and which are not in conflict with this Code of Ordinances or the
Iowa Code.

5-1-4: PROCEDURES FOR OPERATION:
All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the board in all its operations.
5-1-5: MEMBERSHIP:
i
The board comprises five (5) residents of the city, appointed by the city council.
5-1-6: OATH:
Each person, upon appointment or reappointment to the board, must execute an oath of

office at the first meeting of the board following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the board.

5-1-7: TERMS:
i
The term of office for members of the board is three (3) years or until such member's
successor is appointed and qualified.
5-1-8: VACANCIES:
Vacancies must be filled in the same manner as original appointments.
5-1-9: OFFICERS/ORGANIZATION:
The board must choose annually a chairperson and vice-chairperson, each to serve a
term of one (1) year. The chairperson must appoint a secretary, who need not be a
member of the board. The board must fill a vacancy among its officers for the remainder
of the officer's unexpired term.
5-1-10: MEETINGS:
A. Regular Meetings. The board must meet not less than bimonthly..
B. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the members.
C. Open Meetings. All meetings must be called and held in conformance with the Iowa
Open Meetings Law.
D. Attendance.
1. In the event a member of the board has been absent for three (3) or more
consecutive meetings of the board, without being excused by the chairperson,
such absence will be grounds for the board to recommend to the city council
that the position be declared vacant and a replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.

E. Minutes. A copy of the minutes of all regular and special meetings of the board must
be filed with the city council within ten (10) working days after each meeting, or by the I'
next regularly scheduled city council meeting, whichever is later.
F. Quorum. Three (3) members of the board constitute a quorum for the transaction of
business. The affirmative vote of a majority of the members present and voting is j
necessary for the adoption of any motion or resolution.
5-1-11: COMPENSATION:
Members serve without compensation, provided that they may receive reimbursement
for necessary travel and other expenses while on official board business within the limits
established in the city administrative policies and budget. a
5-1-12: REMOVAL:
Except as provided in 5-1-10(D)(1), the city council may remove any member for good
cause.

The board has the following powers, duties, and responsibilities:

A. Advise the city council on executing agreements and grants relating to the transit
system operation and the purchase of new equipment.

B. Advise the city council on rates, fares, or charges for the transportation of
passengers and any incidental services and the rates or charges to be made for
advertising in buses or any other facility.

5-1-14: FARE INCREASE OR REDUCTION IN SERVICE, PROCEDURE:
I�
A. Definitions: The following words and phrases, when used in this title shall, for the
purpose of this title, have the meanings respectively ascribed to them in this section:
SUBSTANTIAL REDUCTION IN SERVICE:
1. Routes: Elimination of a route; I
2. Service Hours: Reduction of ten percent (10%) of service hours of a route;
3. Service Miles: Reduction of ten percent (10%) of service miles of a route; and/or
4. Bus Stops: Elimination of one (1) or more stops on a route that would result in a
greater than one-fourth (1/4) mile walking distance between bus stops.
B. Public Hearing: Prior to the adoption of any fare increase or a substantial reduction in
service by the city council, the city council must set a time and place for public hearing
on such proposed fare increase or reduction in service, and must cause a notice of the
time and place of such hearing to be published in a newspaper of general circulation in I�
the city not less than four (4) nor more than twenty (20) days prior to such hearing. All
notices must comply with all federal, state, and local regulations.
C. Contents of Notice: The notice must state the time and place of hearing, include a
summary of the proposed fare increase or reduction in service level, indicate who the
increase or reduction will affect, indicate the date the increase or reduction will take
effect, and request that interested persons comment, in writing filed with the city clerk
prior to the time of the public hearing or in person at the public hearing, on the proposed q
increase or reduction. The notice must also state that any comments submitted will be
considered by the city council, and that following the public hearing, the city council will
act to adopt, modify or reject the proposed fare increase or reduction in service. All
notices must comply with all federal, state, and local regulations.

ZONING BOARD OF ADJUSTMENT
Amendment Adopted 8-17-15
A. Board Created.
There is hereby created the Zoning Board of Adjustment.

B. Purpose: h
The purpose of the board is to review applications regarding criteria for granting of
special exceptions, conditional use permits, or variances; to decide citizens' appeals of
orders, requirements, decisions, or determinations made by Planning Services staff;
and to hear cases given by applicants and decide whether the request should be
granted based on the criteria set forth in the Zoning Ordinance.

C. Internal Organization and Rules
The board may adopt rules and regulations to govern its organizational procedures as
may be necessary and which are not in conflict with this Code of Ordinances or the
Iowa Code.

D. Procedures for Operation:
All administrative, personnel, accounting, budgetary, and procurement policies of the
city govern the board in all its operations.

E. Membership:
1. The board comprises five (5) residents of the city, appointed by the city
council.
2. Residents must be eighteen (18) years of age or older.
3. Two (2) members from the board must be appointed as cross-representatives
i
to the Airport Zoning Board of Adjustment, with city council approval.
4. A majority of the members of the board must be persons representing the
public at-large and must not be involved in the business of purchasing or selling
real estate.
5. Membership on the board must comply with the provisions of Iowa Code
§69.16A, relating to gender balance. No person can be appointed or reappointed
to the board if that appointment or reappointment would cause the number of
members of one gender to be greater than one-half(Y2) of the membership of the
board plus one (1). If the city has made a good faith effort to appoint a qualified
person to fill a vacancy on the board for a period of three (3) months but has
been unable to make a compliant appointment, the city must utilize a fair and
unbiased method of selecting the best qualified applicants.

F. Oath:
Each person, upon appointment or reappointment to the board, must execute an oath of
office at the first meeting of the board following the appointment or reappointment or at
the city clerk's office any time prior to the first meeting of the board.

G. Terms.
The term of office for members of the board is five (5) years or until such member's
successor is appointed and qualified. The terms of the cross-representative appointees
to the Airport Zoning Board of Adjustment must serve a term on the Airport Zoning
Board of Adjustment which coincides with their terms on the Zoning Board of
Adjustment.
H. Vacancies:
Vacancies must be filled in the same manner as original appointments.
I. Officers/Organization: .
The board must choose annually a chairperson and vice-chairperson, each to serve a
term of one (1) year. The chairperson must appoint a secretary, who need not be a
member of the board. The board must fill a vacancy among its officers for the remainder
of the officer's unexpired term.

J. Meetings.
1. Regular Meetings. The board must meet monthly.
2. Special Meetings. Special meetings may be called by the chairperson or at the
written request of a majority of the members.
3. Open Meetings. All meetings must be called and held in conformance with the
Iowa Open Meetings Law. l
4. Attendance.

a. In the event a member of the board has been absent for three (3) or II
more consecutive meetings of the board, without being excused by the
chairperson, such absence will be grounds for the board to recommend to
the city council that the position be declared vacant and a replacement
appointed.
b. Attendance must be entered upon the minutes of all meetings.
5. Minutes. A copy of the minutes of all regular and special meetings of the board
must be filed with the city council within ten (10) working days after each
meeting, or by the next regularly scheduled city council meeting, whichever is

6. Quorum. The concurring vote of three (3) members of the board is necessary
to reverse any order, requirement, decision, or determination of any such
administrative official, or to decide in favor of the applicant on any matter upon
which it is required to pass under any such ordinance or to effect any variation in
such ordinance.
K. Compensation:
Members serve without compensation, provided that they may receive reimbursement
for necessary travel and other expenses while on official board business within the limits
established in the city administrative policies and budget.

L. Removal:
The city council may remove any member for cause upon written charges and after a
public hearing.

M. Powers:
The board has the following powers, duties, and responsibilities:
1. To hear and decide appeals where it is alleged there is error in any order,
requirement, decision, or determination made by an administrative official in the
enforcement of Iowa Code Chapter 414, as such may be amended from time to
time, or any ordinance adopted pursuant thereto.

2. To hear and decide special exceptions to the terms of this Code upon which
such board is required to pass under such ordinance, in accordance with the
general regulations of the zone in which the property is located and specific
standards contained herein.
3. To hear and decide conditional use permits under the terms of this Code upon
which such board is required to pass under such ordinance, in accordance with
the general regulations of the zone in which the property is located and specific
standards contained herein. "
4. To authorize upon appeal in specific cases such variance from the terms of the
ordinance as will not be contrary to the public interest, where owing to special
conditions a literal enforcement of the provisions of the ordinance will result in
unnecessary hardship, and so that the spirit of the ordinance must be observed
and substantial justice done.
In exercising the above-mentioned powers such board may, in conformity with the
provisions of this section, reverse or affirm, wholly or-partly, or may modify the order,
requirement, decision, or determination appealed from and may make such order
requirement, decision, or determination as ought to be made, and to that end shall have
all the powers of the officer from whom the appeal is taken.

69.16A Gender balance.
1. All appointive boards, commissions, committees, and councils of the state
established by the Code, if not otherwise provided by law, shall be gender balanced.
No person shall be appointed or reappointed to any board, commission, committee, or
council established by the Code if that appointment or reappointment would cause the
number of members of the board, commission, committee, or council of one gender to
be greater than one—half the membership of the board, commission, committee, or
council plus one if the board, commission, committee, or council is composed of an odd
number of members. If the board, commission, committee, or council is composed of
an even number of members, not more than one—half of the membership shall be of one
gender. If there are multiple appointing authorities for a board, commission, committee,
or council, they shall consult each other to avoid a violation of this section.
2. All appointive boards, commissions, committees, and councils of a political
subdivision of the state that are established by the Code, if not otherwise provided by
law, shall be gender balanced as provided by subsection 1 unless the political
subdivision has made a good faith effort to appoint a qualified person to fill a vacancy
on a board, commission, committee, or council in compliance with subsection 1 for a
period of three months but has been unable to make a compliant appointment. In
complying with the requirements of this subsection, political subdivisions shall utilize a
fair and unbiased method of selecting the best qualified applicants. This subsection
shall not prohibit an individual whose term expires prior to January 1, 2012, from being
reappointed even though the reappointment continues an inequity in gender balance.
