The Claimant, Richard Wertzberger of L & I Building Company, states that his company
suffered a loss of revenue. Claimant's renter, Jeld-wen, made deductions from its rent
to L & I Building Company because of extra expenses it incurred trying to obtain access
to the rental building at 245 Railroad Avenue during the Salina Street Project.
According to the report of Michael Koch, Public Works Director, this claim relates to the
Salina Street Reconstruction Project that is being done by Portzen Construction, Inc. The
contract called for the standard form of contracts and bonds with the City, which require
the contractor to hold the City harmless from any claims of damage resulting from the
work. Therefore, it is the recommendation of the City Engineering Division that this claim
be forwarded to Portzen Construction, Inc. for further processing. The Legal Department
concurs with this recommendation.

This claim relates to the Salina Street Reconstruction Project that is being done by
Portzen Construction, Inc. The contract called for the standard form of contracts and
bonds with the City, which require the contractor to hold the City harmless from any

Therefore, it is the recommendation of the City Engineering Division that this claim for
damages be forwarded to Portzen Construction, Inc. for further
consideration/processing.
