BACKGROUND The City Council must request release of the funds for the Lead-Based Paint Hazard Control Grant from the U.S. Department of Housing and Urban Development, Office of Lead Hazard Control and Healthy Homes. The City of Dubuque has received a $3,230,815 Lead-Based Paint Hazard Control Grant for: 1) inspection, identification, and reduction of lead-based paint hazards in 129 units; 2) training of low/mod individuals and contractors for lead certification; and 3) citizen outreach and education on home health and safety. This amount includes $325,000 Health Homes supplement funds to identify and remediate housing-related health and safety hazards in 129 units. The City of Dubuque published a Notice of Intent to request Release of Funds (NOI/RROF) on January 5, 2016. This required notice allows 7 days for citizen and public agency comments on the environmental assessment of these programs. Public comment will be accepted until January 15, 2016, and will be taken into account before proceeding with the request for release of funds. The City may then file Requests for Release of Lead-Based Paint Hazard Control Grant funds and Certification with the U.S. Department of Housing and Urban Development (HUD). RECOMMENDATION/CONCLUSION I recommend that the City Council authorize the Mayor to execute a Request for Release of Funds and Certification after January 15, 2016, ten (10) days after publication of the NOI/RROF for the Release of Lead-Based Paint Hazard Control Grant funds and submit to the U.S. Department of Housing and Urban Development (HUD). Matching funds totaling $321,901 is committed by the Community Development Block Grant and other city, state, and community-based organizations. The Dubuque program is considered a leader in Iowa because of its close partnership between the health and housing departments, and was the first program in Iowa to for such a joint working relationship. Although rates of childhood lead poisoning in Dubuque have been decreasing, elevated blood lead levels and presence of lead-based hazards in homes remain a significant problem. The percent of children identifies as lead poisoned is 1.5 percent compared to a national average of 0.5 percent. However, applying the new CDC recommended action level of 5 ug/dI of greatly increases the number of lead poisoned children in Dubuque. The City of Dubuque is a prior Lead Hazard Control Program grantee. Detailed below is the fiscal year, program name, and award number of prior grant awards: • Round 4 — Fiscal years 1997 — 2000, Lead Hazard Control • Round 11 — Fiscal years 2004 — 2007, Lead Hazard Control • Round 14 — January 2008 -December 2011, Lead Hazard Control, IALHB0375-07 • Round 17 —April 2011 - March 2014, Lead Hazard Control, IALHB0466-10 • Round 17 —April 2011 — March 2014, Healthy Homes Production, IALHH0217-10 Round 17 was a successful program that met or exceeded all of the required benchmarks. That Program performance period ended March 31, 2014 with the Program being closed out effective June 30, 2014. It had always operated in the GREEN; achieving a score above 90% on every quarterly report. There is not an overlap in the operation of Round 17 and the current proposal. Although the City of Dubuque has obtained 4 previous Lead Hazard Control grant awards this has resulted in only 1,151 (6%) lead safe units from a total of the 19,889 residential properties built before 1978 that have a high propensity to contain lead hazards. The goals of the proposed lead hazard control project are: 1) reduce and eliminate lead poisoning in children; 2) increase the number of contractors and individuals that receive professional lead and healthy homes certification training; 3) increase collaborative public education, awareness, and knowledge; 4) coordinate with partners to promote and contribute to healthy and safe (specifically lead safe) living environments throughout the neighborhoods of Dubuque. These goals and objectives will encompass all citizens of the City of Dubuque but especially to high risk populations of minorities and low income individuals. Proposed is the City's Lead -Based Paint Hazard Control Program for inspection and lead-based paint hazard control in 136 units throughout the City of Dubuque with a concentration in Census Tracts 1, 5, 6, 7.01, 7.02, 101.01 and 101.03. (Any units located within the flood plain are prohibited from participating in this program). Units will be inspected, made lead -safe, and the property cleaned and cleared, according to HUD guidelines. Pre- and post lead hazard control dust, soil (where applicable), and blood sampling will be required to assure that environmental contamination has not occurred. This pre -and post sampling will also be used to evaluate the program's success. These samples will be taken prior to the lead hazard control work and immediately after completion. The above mentioned census tracts will be an area of concentration. This area includes the oldest housing stock in Dubuque, and in the state of Iowa. Of the housing stock in the target area, nighty three (93%) was built prior to 1978, with sixty-one (61%) percent built prior to 1940. These tracts have the greatest number of pre -1940 properties and the most families with income less than 80% area median (AMI). These areas traditionally have the highest number of EBL children Included in the Lead Based -Paint Hazard Control Program aplication is $325,000 additional funding to continue a healthy homes focus in conjunction with the lead azard activities. All of this $325,000 will be used for identification of hazards and direct health and safety remediations that are identified from the healthy home assessment and prioritized using the HUD Healthy Homes Rating System. The assessment will identify any of the 29 hazards as detailed by HUD. These 29 hazards are centered around the 7 Healthy Homes Principles and include deteriorated lead paint, trip hazards, guard and hand rails on stairs, smoke detectors, carbon monoxide testers, insulation, ventilation, water infiltration, mold, pest infestation, mechanicals, furnaces, hot water heaters, weatherization, cleanliness, and other safety concerns. An average cost identified for healthy home measures is $2,380. This would result in completion of 136 units with a holistic healthy homes approach. This Grant will improve some of our City's most distressed housing — housing where the poorest and most disadvantaged families reside. It may not be used for projects involving changes in use or new construction activities. It may also be used for the rehabilitation of individual units in a multi -family structure, but not for the rehabilitation/acquisition of an entire multi -family building (>4 units) per §58.35(a)(3)(ii), where using a Statutory Worksheet is recommended . Responsible Entities with projects located in SFHA's are responsible for ensuring that flood insurance is maintained for the statutorily -prescribed period and dollar amount. The proposed program could involve projects located within a 100 -year floodplain. The conclusion was that there is no practicable alternative to the possibility of potential projects being located within the following Flood Zones A and AE. It has been determined that the program must occur within the intended target area/areas, as described above. The alternatives considered included: 1) Funding the proposed program in other areas of the jurisdiction; 2) relocation of housing units and families; 3) no action. Program Activity/Project Description PROGRAM: The City of Dubuque will utilize the Lead -Based Paint Hazard Control and Healthy Homes supplemental funds to market, recruit, test, remediate, and clear homes with housing based lead and other health and safety hazards. A total of 129 low/mod income families residing with the city limits of Dubuque, Iowa, including areas in the 100 -year Special Flood Hazard Area, will receive the benefit of environmentally safe housing. Of the 129 units participating In the program it is anticipated 60% will be single-family, owner -occupied homes. The remaining units will be tenant -occupied rental units. In all cases, homes will have a child under the age of 6 living there or visiting at least 10% of the time. Other outputs will include: 190 applicants enrolled; 170 Lead Inspection/Risk Assessments (LIRA's) and Healthy Homes Assessments completed using the healthy Homes Rating System (HHRS); 129 units completed and cleared of lead-based paint hazards and other housing related health and safety hazard interventions as a result of HHRS findings. In addition, low/mod residents, other contractors, City staff, and other partners will be trained .and certified as Lead Safe Renovators, Abatement Contractors and Workers, Lead Inspector/Risk Assessor, and Healthy Homes Specialists. The Program will also provide educational outreach and conduct events throughout the City of Dubuque to educate citizens on the dangers of lead-based paint and other environmental health hazards. This Release of Funds (ROF) relates only to the environmental conditions as specified in the respective grant agreements, for proposed projects within identified high risk areas throughout the City of Dubuque. Prior to undertaking lead hazard control, healthy homes and related minor rehabilitation intervention activities, the program administrator should have satisfied other grant conditions, such as the approval of the budget, work plan, policies and procedures, and benchmark performance standards. All of these should be reviewed and approved by the grant's assigned Government Technical Representative (GTR). 2. Your ROF is based upon my assessment of your Tier I lEnvironmental Review, permissible under 24 CFR 58.15. You are required iocomplete the Tier ||siie'spadficEnvironmental Review for each project when information that is more detailed becomes available. 3. The Tier II site-specific environmental review should document, for each project (i.e., housing structure) where a physical intervention is proposed, compliance with the applicable reiated environmental laws and authorities at 24 CFR § 58.5, as well as other requirements at 24 CFR § 58.6.
