Creation: There is hereby created a community development advisory commission whose primary purpose shall be to provide for citizen participation in the development and evaluation of the city of Dubuque's community development block grant (CDBG) program. B. Membership: The commission shall comprise nine (9) members; four (4) members shall be residents of census tracts and block groups where at least fifty one percent (51%) of the residents are low/moderate income persons as determined by the United States department of commerce, bureau of the census; four (4) members shall be residents of the community at large; and one member shall be that member of the housing commission designated by the housing commission. (2007 Code § 15-46) 2-5C-2: TERM; FILLING OF VACANCIES; COMPENSATION: A. Term:The term of office for a commission member shall be three(3) years. B. Removal Of Member: A commission member may be removed at any time with or without cause by a vote of two-thirds (2/3) of all members of the city council. C. Filling Vacancies: A vacancy occurring on the commission caused by resignation or otherwise shall be filled by appointment of the city council for the remainder of the unexpired term. D. Compensation: Members of the commission shall serve without compensation except for actual expenses, which shall be subject to approval by the city council (2007 Code § 15-48) 2-5C-3: ORGANIZATION: The commission shall choose annually, at its first regular meeting of the fiscal year, one of its members to act as chairperson, and another of its members to act as vice chairperson, to perform all of the duties of the chairperson during the chairperson's absence or disability. The commission shall adopt such rules and regulations governing its organization and procedures as it may be deemed necessary, consistent with the following: A. Meetings: The commission shall meet as necessary to fulfill the purposes for which the commission was created. B. Attendance Of Members: Members of the commission shall attend at least two-thirds (2/3) of all regularly scheduled meetings within any consecutive twelve (12) month period. If any member fails to attend such prescribed number of meetings, such failure shall constitute grounds for the commission to recommend to the city council that said member be replaced. Attendance of all members shall be entered in the minutes. C. Minutes Filed With Clerk: The commission shall file with the city clerk a copy of the minutes of each regular and special meeting of the commission within ten (10) working days after such meeting. (2007 Code § 15-51) 2-5C-4: GENERAL DUTIES AND RESPONSIBILITIES: The commission shall have the following duties and responsibilities: A. To conduct public hearings in accordance with the minimum standards established in the CDBG program's citizen participation plan to ensure meaningful citizen input in the planning, implementation and assessment of the city's CDBG program; B. To provide for and encourage the participation of low and moderate income persons who reside in designated areas of slum and blight and residents of low and moderate income neighborhoods, as defined by the city council, in the planning, implementation and assessment of the CDBG program; I� C. To identify community development needs, particularly the needs of persons of low i 0 and moderate income; { D. To serve in an advisory role upon the request of the city council in policy decisions regarding funding priorities and program development and implementation; E. To monitor and evaluate program activities to advise whether identified community development objectives have been met; F. To undertake public information efforts to educate the citizenry of the availability of CDBG funded programs and to provide for a greater understanding of the city's community development efforts; G. To assist in the preparation of the statement of community development objectives and projected use of funds, amendments thereto and required reports including, but not limited to, the annual grantee performance report (GPR) and the annual comprehensive housing assistance strategy (CHAS); H. To serve in an advisory role to the city manager in the review of complaints and grievances received in accordance with the procedures established in section 2-50- 5 of this article; and I. To support, upon request, the efforts of the city council and other city commissions in the assessment of the general development needs of the community. (2007 Code § 15-49) j s 2-5C-5: GRIEVANCE PROCEDURE; REVIEW STANDARDS; APPEAL PROCESS: ! i d 9 s The grievance procedure for the community development block grant program shall be as follows: A. Right To File: Any aggrieved person may file a grievance with the city manager. B. Contents: Grievances shall contain a concise statement of the grievance and an explanation of the action desired. C. Forwarding To Commission: The city manager shall forward the grievance to the commission within seven (7) working days of its receipt. D. Setting Date For Hearing; Notice To Complainant: The commission shall, within I� fifteen (15) working days of the receipt of the grievance, set a time for a hearing. The complainant shall be notified in writing of the time.and place of the hearing. If a grievance is resolved prior to the date of the hearing, the aggrieved party shall request in writing that the grievance be withdrawn. a E. Hearing Procedure: The commission shall conduct a hearing to review the grievance. The grievant may appear in person, by agent, or by attorney. All persons wishing to appear before the commission shall have an opportunity to be heard regarding the grievance. Minutes shall be kept of the proceedings of the hearing. l F. Recommendations Of Commission: The commission shall forward its recommendation, in writing, to the city manager within ten (10) working days following the hearing. G. Action By City Manager: The city manager shall receive and review the recommendation of the commission and shall respond to the grievant within ten (10) working days of the receipt of the recommendation. The commission shall be I advised of the action of the city manager. H. Compliance With Federal Regulations: The recommendations of the commission shall comply with the regulations established by the U.S. department of housing and urban development for the community development block grant program under title I of the housing and community development act of 1974, as amended, and this code. I. Appeal To Council By Grievant: If the grievant is unsatisfied with the response of the city manager, an appeal may be made filed with the city clerk. The appeal shall be forwarded by the city clerk to the city council. The city council may, at its discretion, hold a hearing to consider the concerns of the grievant. J. Council Action; Appeal To HUD: Upon review of the appeal, the city council shall: 1) accept the response of the city manager; 2) modify the response of the city w manager; or 3) return the grievance to the city manager for further review. If the outcome of such appeal is unsatisfactory, the complainant may file a written appeal with the U.S. department of housing and urban development (HUD). (2007 Code § 15-50) 2-5C-6: PROCEDURES FOR OPERATIONS: The commission shall operate in accordance with the standards and procedures set forth in the city's community development block grant (CDBG) program's citizen participation plan. All administrative, personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all its operations. Commission Created: There is hereby created the Historic Preservation Commission. B.. Purpose: The purpose of the commission is to: 1. Promote the educational, cultural, economic, and general welfare of the public through the protection, enhancement, and perpetuation of districts, individually I designated historic properties, landmarks, and landmark sites of prehistoric, historic, architectural, archeological, and cultural significance; 2. Safeguard the city's prehistoric, historic, aesthetic, architectural, archeological and cultural heritage by preserving historic properties, districts, landmarks, and landmark sites of historical, architectural, and cultural significance; 3. Stabilize and improve property values; 1 4. Foster civil pride in the legacy of beauty and achievements of the past; i 5. Protect and enhance the city's attractions to tourists and visitors and the support and stimulus to business thereby provided; 6. Strengthen the economy of the city; and 7. Promote the use of properties, districts, landmarks, and landmark sites of prehistoric, historic, architectural, archeological, and cultural significance as sites for the education, pleasure, and welfare of the people of the city. C. Internal Organization and Rules: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. D. Procedures for Operation: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. E. Membership: 1. The Commission comprises nine (9) residents of the city, appointed by the city council. 2. Age Requirement. Residents must be eighteen (18) years of age or older. 3. Special Qualifications. a. One (1) resident from each designated historic preservation district, including historic districts hereinafter established. b. Four (4) at-large members. u 9 c. Each member must possess qualifications evidencing expertise or interest in architecture, history, archeology, law, construction, building rehabilitation, city planning, or conservation in general. d. One (1) member must be a licensed architect. 4. Membership on the commission must comply with the provisions of Iowa Code n §69.16A, relating to gender balance, and Iowa Code §303.34, subsection 3, relating to establishment of a commission to deal with matters involving areas of historical significance. F. Oath: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. G. Terms: The term of office for a commissioner is three (3) years or until such commissioner's successor is appointed and qualified. H. Vacancies: Vacancies must be filled in the same manner as original appointments. In the event that a vacancy occurs in a seat which requires that the appointee be a resident of a historic preservation district and for which there is no application from a qualified resident, the city council must appoint a tenth commissioner, which appointment is temporary, and upon appointment of a qualified resident to the vacancy, the temporary appointment terminates. I. Officers/Organization: The commissioners must elect from its membership a chairperson and vice chairperson, whose terms of office are fixed by bylaws adopted by the commission. The chairperson presides over the meetings of the commission and has the right to vote. The vice chairperson, in cases of absence or disability of the chairperson, may perform the duties of the chairperson. The city manager must designate a city employee to serve as secretary to the commission. The secretary must 4 keep a record of all resolutions, proceedings, and actions of the commission. p J. Meetings: 1. Regular Meetings. The commission must meet at least three (3) times in a calendar year to maintain Certified Local Government status. 2. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. 3. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. ? p l 1 4. Attendance. i a. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to , recommend to the city council that the position be declared vacant and a replacement appointed. b. Attendance must be entered upon the minutes of all meetings. 5. Minutes. A copy of the minutes of all regular and special meetings of the commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. 6. Quorum. Five (5) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and y voting is necessary for the adoption of any motion or resolution. K. Compensation: Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and budget. i L. Removal: The city council may remove any commissioner for cause upon written charges and after a public hearing. M. Powers: The commission has the following powers, duties, and responsibilities: 1. To promote and conduct educational and interpretive programs on historic properties within its jurisdiction. 2. To develop and adopt specific standards for review and design guidelines, in addition to those set forth in section 16-10-7 of this chapter, for the alteration of landmarks, landmark sites, individually designated historic properties and property and structures within historic districts. 3. To adopt its own bylaws. p Y 4. To identify, evaluate, register, manage and protect significant prehistoric and historic archeological sites. a 5. To conduct an ongoing survey to identify historically, archaeologically and architecturally significant properties, structures and areas that exemplify the cultural, social, economic, political, archeological or architectural history of the nation, state or city. i i i I 6. To research and recommend to the city council the adoption of ordinances i designating areas as having historic, architectural, archeological or cultural value or significance as historic districts. 7. To review in progress or completed work to determine compliance with specific certificates of appropriateness or certificates of economic nonviability. 15. To serve as an advisory design review body to the city council for review of public works projects which have historic preservation implications in historic districts, individually designated historic properties, or for alteration of landmarks, landmark sites or structures, that would result in a material change in appearance or be visible from the public way. 16. I I i' 'I i I i i i 9 I 6 I 02/25/2016 t b Mechanical Code Board 14-1f-2: International Mechanical Code Amendments: Section 203, "Board Of Appeals" is hereby amended by repealing such section and replacing such section with a new section in lieu thereof as follows: Section 203. Mechanical Code Board. (a) Board Established. In order to determine the suitability of alternative materials and methods of installation, to provide for reasonable interpretations of the mechanical code, to serve as an appeal body for the decisions of the building official, to advise the city council on all heating, ventilating, air conditioning and refrigeration regulations and procedures, and to provide for examining applicants for certification of competency and issuing certificates of competency and registration, there is hereby created the mechanical code board. (b) Membership. The mechanical code board shall consist of seven (7) members appointed by the city council. Each member shall have a background or experience in sheet metal contracting, hot water and steam fitting contracting, hot water and steam. fitting work, refrigeration contracting, refrigeration work, .or mechanical engineering. I (c) Term Of Office. The term of office of all board members shall be three (3) years. i a (d) Rules And Regulations. The board shall make such rules and prescribe such procedures as may be reasonably necessary for its operation, except that such rules shall include the following: (1) The chairperson of the board shall be elected annually by a majority of the board. (2) The building official, or the building official's designee, shall be secretary of the I board. The secretary shall arrange for meetings and prepare and keep such minutes and records and perform such other clerical work as the board may direct. i (3) Four (4) members of the board shall constitute a quorum. The affirmative vote of four (4) members of the board shall be necessary to adopt any motion. (4) Upon completion of the term of office, a member of the mechanical code board shall continue to serve until their successor has been duly appointed. (5) The mechanical code board shall meet at least once every three (3) months upon call of the chairperson, secretary or city manager. A member of the mechanical code board shall attend at least two-thirds (2/3) of all scheduled meetings within a twelve- month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that said member be replaced. 9 (6) The attendance of all members shall be entered on the minutes by the secretary. (7) All meetings shall be held in conformance with the provisions of the Iowa open meetings law. (8) The mechanical code board shall file with the city clerk a copy of the minutes of each I meeting of the board within ten (10) working days after such meeting. (9) All administrative, personnel, accounting, budgetary, and procedural policies of the city shall govern the mechanical code board in all of its operations. (10) Any person who is aggrieved by a decision of the building official resulting from the enforcement of the mechanical code may appeal from such decision to the mechanical code board, and said board shall serve as an appeal board. In case the aggrieved party is a board member, said member shall be disqualified as a member of the board acting as an appeal board until the person aggrieved has been heard and a decision rendered. The appeal shall be made by the person aggrieved giving written notice of such appeal , to the building official at the building official's office within seven (7) days. The building official shall, within seven (7) days thereafter, notify the board of the appeal. The mechanical code board shall meet within seven (7) days after receiving such notice and shall render a decision within five (5) days thereafter. Any interested party, including the building official, may have the right to present such party's case to the appeal board, l whose decision shall be final unless appealed to the district court as provided by law. Board Created. There is hereby created the Zoning Board of Adjustment. B. Purpose: The purpose of the board is to review applications regarding criteria for granting of special exceptions, conditional use permits, or variances; to decide citizens' appeals of orders, requirements, decisions, or determinations made by Planning Services staff; a and to hear cases given by applicants and decide whether the request should be granted based on the criteria set forth in the Zoning Ordinance. C. Internal Organization and Rules The board may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. I D. Procedures for Operation: All administrative, personnel, accounting, budgetary, and procurement policies of the l city govern the board in all its operations. ; E. Membership: 1. The board comprises five (5) residents of the city, appointed by the city council. 2. Residents must be eighteen (18) years of age or older. 3. Oath: Each person, upon appointment or reappointment to the board, must execute an oath of office at the first meeting of the board following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the board. G. Terms. The term of office for members of the board is five (5) years or until such member's successor is appointed and qualified. The terms of the cross-representative appointees to the Airport Zoning Board of Adjustment must serve a term on the Airport Zoning Board of Adjustment which coincides with their terms on the Zoning Board of Adjustment. i H. Vacancies: { Vacancies must be filled in the same manner as original appointments. I. Officers/Organization: The board must choose annually a chairperson and vice-chairperson, each to serve a term of one (1) year. The chairperson must appoint a secretary, who need not be a member of the board. The board must fill a vacancy among its officers for the remainder of the officer's unexpired term. J. Meetings. 1. Regular Meetings. The board must meet monthly. 2. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the members. 3. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. 4. Attendance. a. In the event a member of the board has been absent for three (3) or more consecutive meetings of the board, without being excused by the chairperson, such absence will be grounds for the board to recommend to the city council that the position be declared vacant and a replacement appointed. b. Attendance must be entered upon the minutes of all meetings. 5. Minutes. A copy of the minutes of all regular and special meetings of the board must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever is later. i i i i f 6. Quorum. The concurring vote of three (3) members of the board is necessary to reverse any order, requirement, decision, or determination of any such administrative official, or to decide in favor of the applicant on any matter upon which it is required to pass under any such ordinance or to effect any variation in such ordinance. j K. Compensation: Members serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official board business within the limits established in the city administrative policies and budget.
