Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, indicating that the proposed amendment would help a local business to expand and allow signage that is standard for the proposed distribution center. Staff reviewed the existing PUD sign requirements for the Dubuque Industrial Center and comparable sign regulations in the City's industrial districts. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the amendment is for the number of signs and removal of the restriction to generic names for company products. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The proposed amendment will allow sign content to include non-generic product names, and will allow an increase in number of primary signs permitted from two to five. These regulations will pertain to the entire Planned Industrial district. DISCUSSION Currently, the Dubuque Industrial Center PI district sign regulations permit primary signs to identify company products or services by generic name only. This means that signs in the PI district can state "beverage distribution", for example, but cannot use the brand name of the product(s) they distribute. The intent of the ordinance is to enable businesses within the industrial center to identify their corporate name and location, but not to advertise the products they manufacture or distribute. The Greater Dubuque Development Corporation and Kirchhoff Distributing have asked to amend the PI sign regulations to allow sign content to include a product's brand name. Currently, the Dubuque Industrial Center PI district sign regulations permit a maximum of two primary signs for each premises or lot. The Greater Dubuque Development Corporation and Kirchoff Distributing propose to install five primary signs on the premises. They propose to install two wall mounted, 500 square foot, "Budweiser" signs, and one wall-mounted, 52 square foot, Anheiser Busch logo on their building. They also propose to erect a freestanding, 24 square foot, Anheiser Bush logo flag on a 25-foot high flagpole, and a six-foot high, 42 square foot, monument sign identifying Kirchhoff Distributing. The intent of the existing limitation on the number of signs permitted for each lot in the industrial center is to enable businesses to advertise their name and identify their location, but to prevent the proliferation of signage commonly found associated with retail establishments in general commercial districts. Currently there are thirteen businesses within the Dubuque Industrial Center, all of which meet existing sign requirements. These existing signs would remain conforming if the sign amendment is approved. By limiting the allowable content and number of primary signs, the current Dubuque Industrial Center PI district is more restrictive than other industrial districts regulated the Zoning Ordinance. The Zoning Ordinance allows primary signs to pertain to the use of the premises. These signs can advertise an establishment, merchandise, service or product that is sold, manufactured or furnished on the premises. For the Light Industrial LI, Heavy Industrial (HI) and Modified Heavy Industrial (MHI) districts, the Zoning Ordinance allows two signs per business per street frontage either wall mounted or freestanding with certain size restrictions. The LI, HI and MHI sign regulations are attached for comparison. CONCLUSION Staff recommends that the Zoning Advisory Commission review the applicant's request in accordance with Section 3-5.5 Planned Unit Development District (PUD) regulations of the Zoning Ordinance. Greater Dubuque Development and Kirchhoff Family Realty understand that Dubuque's signage code is in place to protect the investment of other tenants and to maintain the integrity/beauty of the Dubuque Industrial Center. However, in this particular case, the existing code seems to work against the intent: Comprehensive Signage Package According to City of Dubuque Ordinance pertaining to signage (Section 4 "Site Signage"), items C-1 and C-2, present a challenge for the full completion of the company's beautiful, new facility at 5035 Chavenelle Road: Primary Siqn (C-:l.) Kirchhoff Distributing Company is, in the minds of most consumers, synonymous with "Budweiser." In fact, one could argue that many Dubuque residents perceive the company's actual name to be "Budweiser." As the exclusive distributor of Budweiser, Kirchhoff Distributing Company and their supplier have a mutual interest in the signage on the new facility. However, although a "graphic symbol or logo identified with the company" is permitted, it appears that "Budweiser" is not permitted on the site. In addition, although the company has no intent of doing so, they are allowed (according to Ordinance) to place a generic sign that reads "Beer" on the new facility. Request: Approval that would allow "Budweiser" (NOT the generic alternative "Beer" signage on the building. Primary Sion ¢C-21: According to City of Dubuque Ordinance, the maximum number of "primary signs shall not exceed two for each premises or lot." The plans for Kirchhoff's new facility/lot include two (2) pdmary signs and one (1) logo on the building itself. :In addition, Kirchhoff would like to erect a tasteful, monument sign (on ground) that would meet specifications outlined by the City of Dubuque for ground-based signage.
