Van Milligen, City Manager Extension of Highway 20 Moratorium Building Services Manager Rich Russell is recommending approval of an Iowa Department of Transportation request to extend the building permit moratorium on Highway 20 until May 1, 2003, from Bluff Street east to the City limits, in connection with the U.S. Mississippi River Crossing Study. The City Council has approved moratoriums for this general area since May 1998. I concur with the recommendation and respectfully request Mayor and City Council approval. Michael C. Van Milligen, City Manager FROM: Rich Russell, Building Services Manager RE: Extension of Highway 20 Moratorium INTRODUCTION: This memo transmits a request from the Iowa Department of Transportation (IDOT) for the City to extend the building permit moratorium on Highway 20, in connection with the U.S. Mississippi River Crossing Study. A resolution and map are attached. DISCUSSION: On May 4, 1998, the City Council established a six month moratorium for Highway 20 from Bluff Street to Cherokee Drive/Collins Street, for the completion of the Highway 20 Land Use Plan. On April 19, 1999, the City Council extended the moratorium to May 1, 2000, and expanded the area of the moratorium to include Highway 20 east from Bluff Street to the city limits. In early 2000 and 2001, the City Council extended this moratorium for one year periods ending May 1, 2001 and May 1, 2002 respectively. In the 2000 memo, the area of the moratorium was reduced in area from Collins Street east to Bluff Street east. At this time, the IDOT has requested another one-year extension for the moratorium. The IDOT will shortly be hiring a design consultant for the bridge. The design work is expected to take two years. The area of the moratorium has been slightly increased on the north side of Highway 20. The attached map shows the expanded area. RECOMMENDATION: I recommend that the City Council extend the building permit moratorium for Highway 20,from Bluff Street east to the city limits, as requested by the IDOT in connection with the U.S. Mississippi River Crossing Study. With approval of the attached resolution and map, the City Council will extend the moratorium from Bluff Street east to the city limits until May 1, 2003. cc: Mike Koch, Public Works Director Laura Carstens, Planning Services Manager ORDINANCE NO. 21-02 AN ORDINANCE AMENDING CHAPTER 11 (BUILDINGS AND BUILDING REGULATIONS) OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY AMENDING SECTION 11-58.1 OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY ESTABLISHING A TWELVE MONTH MORATORIUM ON THE ISSUANCE OF PERMITS FOR WORK IN THE U.S. HIGHWAY 20 CORRIDOR. Whereas, the Iowa and Illinois Departments of Transportation are conducting a U.S 20 Mississippi River Crossing Study; and Whereas, the issuance of permits in the study corridor of U.S. 20 could impact the study negatively. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Chapter 11 (Buildings and Building regulations) of the City of Dubuque Code of Ordinances is hereby amended by amending Section 11-58.1 as follows: Section 11-58.1 Moratorium - for work in the U.S. 20 Corridor; The building official shall not issue any permit for any new construction or substantial enlargement, alteration, repair or remodeling of any structure, building, or sign in the U.S. 20 (Dodge Street), but not to include demolition, from the eastern corporate limits of the City of Dubuque westerly to the intersection of U.S. 20 (Dodge Street) with Bluff Street, as shown on the map on file in the Office of the City Clerk, 50 West 13th Street, Dubuque, Iowa, during a period from May 2, 2002 to May 1,2003, except where a vested right to the issuance of such permit accrued prior to May 1,2001 Section 2. No. BRF-20-9 (149)--38-31 U.S. 20, Mississippi River Crossing Dear Lara: We would like to request city council approval to extend the present building permit moratorium in connection with the U.S. 20, Mississippi River Crossing (Julien Dubuque Bridge) Project for another one-year period. I have enclosed a map showing the area needing to be covered by the moratorium. The area to be covered remains unchanged from the presently approved area. We are in the process of negotiating a consultant design contract for this project. Work is expected to begin shortly and take up to 2 years to complete. If you require any additional information or explanation, please let me know.
