Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that he does not plan to build any
additional apartments initially, but may in the future.
Staff reviewed the submitted plat, indicating that Lot 3 is substandard as it has no
frontage on a public street. The Engineering Department also recommended that
easements be platted for water and sewer to ensure access to City utilities.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted plat
of survey creates an additional building lot for a multi-family structure with access to
Kehl Court and that sufficient access is provided for emergency vehicles.
Recommendation
By a vote of 3 to 2, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot frontage requirement for Lot 3 and that
easements are platted for water and sanitary sewer..
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey Lots 1, 2 & 3 of A. H. Oeth Subdivision No. 5 subdivides two
existing parcels into three. The plat of survey provides for a new building lot behind two
existing homes that front on Rockdale Road with access provided through a 20-foot wide
easement to Kehl Court.
DISCUSSION
The submitted plat of survey Lots 1, 2 & 3 of A. H. Oeth Subdivision No. 5 creates an
additional building lot behind two existing homes fronting on Rockdale Road. Access to Lot 3
will be by way of a 24-foot wide access easement to Kehl Court. The subject property is
zoned R-4 Multi-Family Residential and the approval of this plat would allow a new multi-family
residential structure to be constructed on Lot 3. Lot 3 is substandard in that it does not have
any frontage on a public street. The proposed access easement runs between two existing
multi-family buildings on Lot 4 and Lot 5 of A. H. Oeth Subdivision No. 4.
In addition, easements must be acquired and shown on the plat of survey for connection to
water and sanitary sewer mains. City water is available in Kehl Court and sanitary sewer is
available within the Rockdale Road right-of-way.
The proposed plat of survey will allow the placement of a multi-family structure directly behind
two existing family structures fronting on Rockdale Road. The location of Lot 3 also creates an
irregular situation for access, as the new building on that lot will be given a Kehl Court
address; however, the building itself will be removed more than 100 feet from Kehl Court with
access provided by a 24-foot easement placed between two existing multi-family structures.
RECOMMENDATION
Staff recommends the Zoning Advisory Commission determine whether the proposed plat of
survey providing a lot with access through a 24-foot wide easement is appropriate. Approval
of the Plat of Survey of Lots 1, 2 & 3 of A. H. Oeth Subdivision No. 5 must be done subject to
waiving the lot frontage requirement for Lot 3 and the platting of easements for access to
water and sanitary sewer mains.

RESOLUTION NO. 146-02
RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS 1, 2 & 3 OF A.H.
OETH SUBDIVISION NO. 5 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Lots 1, 2 & 3 of A. H.
Oeth Subdivision No. 5 in the City of Dubuque, Iowa; and
Whereas, said plat provides Lot 3 with 0 feet of lot frontage, where 50 feet is required
by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said plat of survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said plat of survey has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to alloW
Lot 3 with 0 feet of lot frontage, where 50 feet is required.
Section 2. That the plat of survey Lots 1, 2 & 3 of A. H. Oeth Subdivision No. 5 is
herebY approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque~ Iowa upon. said final plat.
