The application, staff report and related materials are attached for your review. Discussion Chairperson Norton stepped down due to a conflict of interest. The applicant's representative spoke in favor of the request, noting the location of the proposed subdivision. Staff reviewed the staff report, noting the location of the property, number of building lots, access locations, street layout and location of the proposed park land to be dedicated to the City. Staff reviewed the sustainability measures proposed by the developer, including solar-orientated lots, reduced paving width, and tree planting requirement for each lot. There were no public comments. The Zoning Advisory Commission discussed the request, and had no concerns with the submitted Preliminary Plat. Recommendation By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends that the City Council approve the request as submitted. Typically, the City Council only reviews preliminary plats when the subdivision includes a private street. Although public streets are planned, the streets will be private until such time as the subdivision is annexed. Subdivision Staff Report — Rustic Point Estates Page 2 Conformance with Comprehensive Plan: This subdivision meets the Comprehensive Plan Land Use Element Goals 1.2, 1.5, 4.1., 4.4, and 7.2. The 2030 Future Land Use Map designated the property for agricultural use. Impact of Request on: Utilities: The subject subdivision is located within Dubuque County and is currently not served by City water and sanitary sewer utilities. City staff is currently in the process of acquiring the necessary utility easements to extend both water and sanitary sewer to the proposed subdivision. Once extended, the utilities will have sufficient capacity to serve the entire development. The water main will be extended from the existing water tower on John F. Kennedy Road to a point that can serve the proposed subdivision, and will then be extended throughout the subdivision by the developer. The sanitary sewer will be extended from its current terminus from property near Asbury Plaza and be extended through adjacent farm fields to Derby Grange Road and then to a point that can serve the proposed subdivision. The acquisition of the necessary easements and rights-of-way are currently underway by City staff. Traffic Patterns: The proposed subdivision includes six new public streets. The public streets will be built to either a 27-foot paving width or 31-foot paving width. In either case, a 50-foot right-of-way will be provided. The 27-foot wide streets will have on-street parking restricted to one side only. Public sidewalks will be constructed along both sides of the streets as lots are developed within the subdivision. Planning staff estimates the subdivision, when fully built out, will generate approximately 1,000+ vehicle trips per day. Currently, based on 2013 IDOT Counts, John F. Kennedy Road carries approximately 3,360 average daily vehicle trips. Public Services: Existing public serves are adequate to serve the site upon annexation. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control is provided during all phases of development of the property, and adequate storm water management is provided as per City of Dubuque requirements. Adjacent Properties: Staff anticipates that impacts to adjacent properties will include additional vehicle trips on John F. Kennedy Road and Derby Grange Road, and a change in the built environment as new homes are constructed on what was once an agricultural piece of land. Subdivision Staff Report— Rustic Point Estates Page 3 Recommended Conditions on Plat: None. Staff Analysis: The submitted Preliminary Plat of Rustic Point Estates subdivides approximately 50 acres of property into 108 building lots. The subject property is currently in Dubuque County and the developers have signed an agreement with the City of Dubuque that in return for serving the subdivision with City water and sanitary sewer, the developers will annex the property into the City of Dubuque. Currently, City staff is in the process of acquiring the necessary utility easements and right-of-way to process an application for the annexation of the property into the city of Dubuque. The property does not currently have adjacency to the city of Dubuque corporate limits which is required by state law. The City of Dubuque plans to accomplish this by acquiring the right-of-way easements for John F. Kennedy Road from the adjacent property owners and annexing the roadway from the current city corporate boundaries to a point that the developers, Derby Grange, LLC, can then submit an annexation request. The City of Dubuque would then take over maintenance of that portion of John F. Kennedy Road once it is annexed to the city. City staff has had discussion with County officials who are aware of this project and have not objected to the development or ultimate annexation of the property into the city of Dubuque. The review of this preliminary plat, if approved, is subject to the annexation of the property to the city of Dubuque. The proposed Rustic Point Estates subdivision is comprised of 108 single-family homes and 15 two-unit townhome lots. These lots are served by five new public streets with two access points — one to John F. Kennedy Road and one to Derby Grange Road. The subdivision also provides for a stub street to the west that can serve an additional 18 acres of property owned by a separate property owner. The developers of Rustic Point Subdivision and the adjacent property owner have had discussions to cooperate in the extension of City streets and water and sanitary sewer to serve the adjacent property to the west in the future. The proposed subdivision includes three areas reserved for detention of storm water and will be compliant with City of Dubuque Storm Water Management regulations and policies. As previously mentioned, City water and sanitary sewer utilities are not currently at a point that can serve the proposed development. City staff is working on acquiring the necessary utility easements to extend City water and sanitary sewer to the site. City water will be extended to the site along John F. Kennedy Road from the current water tower north along John F. Kennedy Road. Sanitary sewer will come up through adjacent farm fields to Derby Grange Road and then extend eastward that can serve the proposed subdivision. The proposed Preliminary Plat of Rustic Point Estates will comply with the City's sustainability requirements and that they will achieve at least 40 points for the following techniques. 1) 70% of the subdivision is solar-ready lots 30 points 2) Reduce street width to 27-foot 5 points 3) Tree planting requirement 5 points TOTAL: 40 points The City's Unified Development Code Section 11-9 provides a recommended amount of open space for new subdivisions. Based on the number of single-family lots and two-family lots platted for Rustic Point Estates Subdivision, approximately 51,000 square feet of open space recommended. A 37,000 square foot park area is proposed for an area on the eastern side of the subdivision tucked in behind single-family homes on three sides. Leisure Services Manager Marie Ware is reviewing this proposal and will make a final determination on the suitability of the park land as part of reviewing the improvement plans.
