Van Milligen, City Manager SUBJECT: Mystique Casino Request to Construct Outside Patio and Pergola DATE: May 10, 2016 As required by the Amended and Restated Lease Agreement between the City of Dubuque and the Dubuque Racing Ltd, Dubuque Racing Association President and CEO Jesus Aviles requests City Council approval to spend funds from the Dubuque Racing Association Depreciation and Improvement Fund to construct a patio and pergola in the area between the hotel and Houlihan's Restaurant to meet required Hilton standards. The total cost of the project is $37,800.96 and the funds are available in the Dubuque Racing Association Depreciation and Improvement Fund. Aviles, President and CEO/ Dubuque Racing Association Issue: Outside Patio and Pergola As required in the Amended and Restated lease Agreement between the City of Dubuque and the Dubuque Racing LTD.,I am formally requesting City approval to construct a patio and pergola in the area between the Hotel and Houlihan's Restaurant to meet required Hilton standards. The area for this improvement is on the old landfill, the ground will have to be raised by 8-10 inches to meet City code for ADA. This will also include removing and replacing the patio and the entrances to both Houlihan's and the Hotel in that area. My recommendation for this expenditure is $35,328.00 plus tax $2,472.96 for a total of$37,800.96. Three bids were obtained for the concrete work and pergola construction. The Concrete bid will be awarded to Manders Quality Concrete for $20,328.00, Pergola and gas line for firepit bid will be awarded to Epic Construction for $15,000.00 The source of the funding for the project is the Depreciation and Improvement Fund (D&I Fund) which has a balance of$729,153.64 and an available amount of$479,153.64 the required minimum for the D&I Fund is $250,000 per the City/DRA Lease Agreement.
