The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative, Al Urbain, spoke in favor of the request, reviewing the
location of the property, the previous use of the site, and that they intend to convert the
property into a restaurant with a drive-up window. The applicant indicated they held and
open house for the neighborhood, but only received one visitor.
Staff reviewed the staff report, noting surrounding zoning and land use, the former use
of the site as an auto sales lot and a Dog & Suds Restaurant. Staff noted the blighting
influence that vacant commercial sites can have on a neighborhood. Staff discussed
the drive-thru configuration has been reviewed by the Engineering Department.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting redevelopment of the
property would be a positive for the neighborhood. Commissioners discussed the drive-
thru window access alternatives, and concluded that City staff is responsible for access
to City streets and the Commission's role is to review the zoning request.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject properties were part of the original Dreibelbis addition
subdivided circa 1900 and houses were built on each lot. Subsequently the house at
800 Rhomberg Avenue was torn down and replaced with a gas station. In 1964 the gas
station was converted to a drive-in restaurant. In 1972 the drive in was converted to an
auto sales lot and the adjacent house at 804 Rhomberg Avenue was torn down and
replaced with a large garage. The property continued to serve as a legally non-
conforming auto sales lot and garage and was recently vacated.
Physical Characteristics: The subject property consists of two level lots that total
approximately 13,000 square feet in area located at the corner of Rhomberg Avenue and
Stafford Street with an alley behind. The property accommodates a 1,200 square foot
commercial building with a 1,400 square foot canopy attached to the west end and a 1,400
square foot detached garage and shop.
Concurrence with Comprehensive Plan: The Comprehensive Plan encourages
adaptive re-use of older structures and also encourages mixed use areas but cautions
that incompatible uses should be buffered from each other. The 2030 Future Land Use
Map calls for this area to remain commercial.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.

Traffic Patterns/Counts: The 2013 IDOT traffic data for this location indicates between
6,000 and 7,000 vehicle trips per day along Rhomberg Avenue north and south of the
subject property. The traffic generated by the proposed restaurant or other potential C-2
commercial uses should be minimal relative to the overall volume of traffic along Rhomberg
Avenue and Stafford Street.
Public Services: Existing public services are adequate to serve the property.
Environment: Staff does not anticipate any adverse impact to the environment as the
proposed redevelopment should be primarily internal to the building with some minor
parking lot improvements.
Adjacent Properties: The proposed restaurant with a drive-through component has the
potential to generate more noise, activity, traffic and demand for parking than many of the
uses permitted in the current C-1 Neighborhood Commercial district. The applicant
proposes seating for approximately 15 patrons inside the building along with a 15 space
parking lot. The number of off-street parking spaces proposed far exceeds that required by
UDC regulations. The property is grandfathered for an auto sales lot and could also be
reused for any of the uses permitted in the C-1 Neighborhood Commercial district which
includes retail sales establishments, laundromats and grocery stores, for example. It is
important to note that vacant commercial buildings impact property values and may
contribute to urban blight.
CIP Investments: None proposed.
Staff Analysis: The applicant's request is to rezone the subject lots from C-1
Neighborhood Commercial district and R-2A Alternate Two-Family Residential district to C-
2 Neighborhood Commercial Shopping Center district. The subject property is located in a
mixed-use neighborhood and is bordered by a vacant church, single- and two-family
residences, a grocery store and a medical office. The subject property consists of two lots
that total approximately 13,000 square feet in area that accommodates a 1,200 square foot
commercial building with a 1,400 square foot canopy attached to the west end and a 1,400
square foot detached garage and shop. The applicant is proposing to convert a currently
vacant commercial property and buildings that recently served as an auto sales lot, garage
and office space into a restaurant with a drive-through component.
The applicant proposes seating for approximately 15 patrons inside the building along with
striping a 15-space parking lot. The number of off-street parking spaces proposed far
exceeds that required by UDC regulations. The applicant also proposes a drive-through
component entering from Rhomberg Avenue travelling along the south side of the building
and exiting on to the alley. Preliminary review of the proposed drive-through by the City's
Engineering Department has not raised any significant concerns.

The C-1 district has15 permitted uses and the C-2 district has 20 permitted uses. The C-2
district permits a gas station, medical office and indoor restaurant whereas the C-1 district
requires that a conditional use be approved for these uses. Some of the uses permitted by
right in the C-2 district have the potential to generate more noise, traffic and demand on
parking than those uses permitted in the C-1 district. However, there is much overlap in
the permitted uses and, if not repurposed,the property could still be used as an auto sales
lot. It is also common for vacant and abandoned commercial buildings and properties to fall
into disrepair, attract litter and impact the value of adjacent properties, contributing to
neighborhood blight.
Staff recommends the Commission review Article 9-5 of the Unified Development Code
regarding reclassification of property.

Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter—described
property from R-1 Single -Family Residential and C-1 Neighborhood Commercial District
to C-2 Neighborhood Shopping Center District, to wit:
Lot 16 and the southwest 6.8 feet of Lot 15 Dreibelbis Subdivision and the
