Chicago Street Sanitary Sewer Extension Project
Work has been completed on the Chicago Street Sanitary Sewer Extension Project by
McDermott Excavating in the final contract amount of $93,178.80. The final contract
price is under the original contract amount by $17,782.67. The final assessable portion
of the contract was $13,820.46 below the original project estimate. Therefore, as a
result of the lower overall cost, the final assessments were reduced by approximately
35.55%, decreasing the assessment from $74.52 per foot to $48.03 per foot.
Public Works Director Mike Koch recommends acceptance of the Chicago Street
Sanitary Sewer Extension Project, establishing the Preliminary Schedule of Final
Assessments, and setting a public hearing for April 1, 2002, to establish connection fees
for the sanitary sewer.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Chicago Street Sanitary Sewer Extension Project
INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract
for the Chicago Street Sanitary Sewer Extension Project and the establishment of
the final assessments.
DISCUSSION
Work has been completed on the project by McDermott Excavating in the final
contract amount of $93,178.80. The final contract price is under the original
contract amount by $17,782.67. The final assessable portion of the contract was
$13,820.46 below the original project estimate. Therefore, as a result of the lower
overall cost, the final assessments were reduced by approximately 35.55%,
decreasing the assessment from $74.52 per foot to $48.03 per foot.
The project provided for the extension of approximately 1,060 feet of 8" sanitary
sewer pipe in the Chicago Street area. The sewer extension provided service to 5
homes and 13 vacant lots. All 5 homes have connected to sewer.
A portion of the assessments related to the cost of the sanitary sewer may qualify
for the City's Iow- to moderate-income special assessment assistance program.
Sanitary sewer construction funds will provide 20% to 100% of the sanitary sewer
assessments for eligible owner-occupied property. A summary of the income
qualifications of the financial assistance program is attached.
To allow sufficient administrative time, the process of financial assistance
payments for Iow- to moderate-income families, the adoption of the final schedule
of assessments will be delayed for approximately 45 days. In its place is a
resolution adopting the preliminary schedule of final assessments. Property
owners may use this period to apply for and receive financial assistance that may
reduce the amount of their assessment paid by the property owner.
RECOMMENDATION
I would recommend the project be accepted and the final sewer assessment levy
be approved.

A portion of the project was constructed as part of the Walker and Oneida Storm
Sewer Replacement Project. The City share for the sanitary sewer from Walker
and Oneida Streets is $12,241.15. The total City share for the project is
$95,843.87, with a Fiscal Year 1999 budget amount of $128,000 for the City
portion.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the
improvement, establishing the Preliminary Schedule of Final Assessments, and
setting a public hearing for April 1, 2002 to establish the connection fees for the
sanitary sewer.

RESOLUTION NO. -02
ACCEPTING IMPROVEMENT
Whereas, the contract for the Chicago Street Sanitary Sewer Extension
Project has been completed and the City Manager has examined the work and
filed his certificate stating that the same has been completed according to the
terms of the contract, plans and specifications and recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby
directed to pay to the contractor from the Sanitary Sewer Construction Fund in
amount equal to the amount of this contract, less any retained percentage
provided for therein.

FINAL ESTIMATE
Whereas, the contract for the Chicago Street Sanitary Sewer Extension
Project has been completed and the City Engineer has submitted his final
estimate showing the cost thereof including the cost of estimates, notices and
inspection and all miscellaneous costs;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the COst of said improvement is hereby determined to be
$107,627.62.
Section 2. That $24,986.71 of the cost thereof shall be assessable upon
private property and $82,640.91 shall be paid from the Sanitary Sewer
Construction Fund.

Clerk of Dubuque, Iowa, a proposed Ordinance establishing the Chicago Street
Sanitary Sewer Extension Project connection fees.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That on the 6th day of May, 2002, a public hearing will be held at 6:30 p.m.
in the Public Library Auditorium, 360 West 11 Street, at which time interested
persons may appear and be heard for or against the establishment of sewer
connection fees for the Chicago Street Sanitary Sewer Extension Project, and
the City Clerk be and is hereby directed to cause a notice of time and place of
such being to be published in a newspaper having general circulation in the City
of Dubuque, Iowa, which notice shall not be less than 21 days prior to the date
fixed for its consideration. At the hearing, any interested person may appear and
file objections to the proposed sewer connection fees for the Chicago Street

Notice is given that there is now on file for public inspection in the office of
the City Clerk of Dubuque, Iowa, a proposed Ordinance establishing the Chicago
Street Sanitary Sewer Extension Project connection fees.
The City Council will meet at 6:30 p.m. on the 6th day of May, 2002, in the
Public Library Auditorium, 360 West 11 Street, in the City of Dubuque, Iowa, at
which time the owners of property subject to said connection fees for the Chicago
Street Sanitary Sewer Extension Project or any other person having interest in
the matter may appear and be heard for or against the establishment of the
schedule of connection fees. A property owner will be deemed to have waived
all objections unless at the time of the hearing, the property owner has filed
objections with the City Clerk.
Any visual- or hearing-impaired persons needing special assistance or
persons with special accessibility needs should contact the City Clerk's office at

ORDINANCE NO. 27-02
AN ORDINANCE ESTABLISHING A SCHEDULE OF SEWER
CONNECTION FEES FOR THE CONNECTION OF PROPERTY TO THE
CHICAGO STREET SANITARY SEWER EXTENSION PROJECT
Whereas, after full consideration of the schedule of sanitary connection
fees proposed to be made for the Chicago Street Sanitary Sewer Extension
Project, which schedule of connection fees was filed in the office of the City Clerk
on the 27~ day of February, 2002; and
Whereas, the City Council has determined that the amounts shown on
said schedule are proper and are in proportion to the benefits conferred; and
Whereas, the City Council further finds that the schedule of sewer
connection fees for the Chicago Street Sanitary Sewer Extension Project be
approved and adopted.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. There is hereby established a schedule of sewer connection
fees the Chicago Street Sanitary Sewer Extension Project for the connection of
property to said City sewer.
Section 2. Each property owner whose property will be served by
connection to said City sewer shall pay a sewer connection fee to the City, as
shown on the schedule of sewer connection fees attached hereto.
Section 3. Such connection fee shall be due and payable when a sewer
connection application is filed with the City. All fees collected under this
Ordinance shall be paid to the City Treasurer.
Section 4. The City Clerk is hereby authorized and directed to certify a
copy of this Ordinance for recording in the office of the Dubuque County
Recorder.
