The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the number of proposed ball
fields, access locations, including W. 32nd Street and potential for a right-in/right-out
access to the Northwest Arterial. Mr. Yoko reviewed that a concession stand will be
provided as well as sufficient parking area for all fields. Mr. Yoko noted his request
does not include the property to the west abutting Tiffany Court.
Staff reviewed the staff report, noting the receipt of two letters of opposition submitted
by neighboring property owners. Staff reviewed the concept plan, the allowed uses in
the Commercial Recreation District and that Engineering staff will be evaluating access
to W. 32nd Street for compliance with City standards. Planning staff noted that rezoning
and developing the site for commercial recreation uses will increase vehicle trips, but
that development of the property for residential purposes would likely increase vehicle
trips even more. Planning staff Member Kyle Kritz reviewed access standards for W.
32nd Street and the Northwest Arterial.
There were several public comments that expressed concern or opposition to the
request because of increased traffic and difficult access along W. 32nd Street. Other
concerns were expressed related to hours of operation, lighting, and having a second
access to the Northwest Arterial.
The Zoning Advisory Commission discussed the request, and reviewed concerns
regarding vehicle trips from the subject property and its potential impact on the
surrounding roadways. The Commission discussed reducing the area to be rezoned by
eliminating the area along W. 32"d Street to mitigate adverse impact to existing homes
along W. 32nd Street.

Recommendation
By a vote of 3 to 2, the Zoning Advisory Commission recommends that the City Council
deny the request (due to lack of four concurring votes). The Commission's motion
included reducing the area to be rezoned and allowing only an access to the Northwest
Arterial.

A super majority vote is needed for the City Council to approve the request as submitted
or with conditions.

Property History: Due to its steep topography the southern half of the subject property
has remained undeveloped and the northern half has been farmed since before its
annexation to the City of Dubuque circa 1975.
Physical Characteristics: The subject property is an approximately 77 acre lot that extends
approximately 2,500 feet from its southern frontage along W. 32°d Street to its northern
frontage along the Northwest Arterial. There is approximately 160 feet of grade change
between the property's low point along W. 32nd Street and the high point at the center of
the property. The southern half of the lot is a steep wooded hillside and the northern half is
gently sloping farm fields. The only current access to the property is taken from a farm
road off of the Northwest Arterial along the north frontage.
Concurrence with Comprehensive Plan: The Comprehensive Plan encourages infill
development and provision of recreational opportunities throughout the community but
cautions that incompatible uses should be buffered from each other. The 2030 Future
Land Use Map calls for this area to be developed as single- and mixed-residential.
Impact of Request on:
Utilities: City water and sanitary sewer are available at the property's southern
frontage along W. 32nd Street. Water mains, including hydrants and sanitary sewer
would likely have to be extended approximately 2,000 feet from W. 32nd Street to
serve the north half of the property.

Traffic Patterns/Counts: The 2013 IDOT traffic data for this location indicates
approximately 4,200 vehicle trips per day on W.32nd Street along the south frontage of the
subject property and between 12,000 and 13,000 vehicle trips per day along the Northwest
Arterial at the north frontage of the property.
Public Services: If developed under the auspices of all relevant City codes, existing
public services should be adequate to serve the property.
Environment: Staff does not anticipate any adverse impact to the environment as any
excavation, grading, erosion control and storm water management measures,
landscaping and green space requirements must to comply with the Unified
Development Code's Site Design standards, City Engineering's erosion control and
storm water management standards and all relevant City, state and federal codes.
Adjacent Properties: There are six residential properties and two farms directly adjacent to
the subject property. There are also 20 residential properties within 2,500 feet of the
southern half of the subject property with direct access on to W. 32nd Street. As it is likely
that the primary access to the developable north half of the subject property will be taken
from W.32 ND Street, an increase in traffic may slightly affect safe driveway access to the
street from neighborhood houses. Although most of the adjacent residential properties will
be well removed from the potential recreational activity, noise and lighting may still have an
impact on these properties. Also there are three residential properties along W.32nd Street
that will have vacant, somewhat level lot area on one or two sides of their property. If
developed for commercial purposes, or if the primary access is located in close proximity to
their side property lines, development of the subject property may have an impact on the
use and value of these properties.
CIP Investments: None proposed.
Staff Analysis: The applicant's request is to rezone approximately 77 acres of the subject
property's 84 acre parcel from AG Agricultural to CR Commercial Recreation district. The
applicant's stated intention is to develop six baseball fields, concessions and a playground
on the north half of the property with the primary access to the facility taken from W. 32nd
Street. Most of the south half of the subject property, except for a small portion along W.
32nd Street, would be difficult to develop due to the topography and presence of bedrock.
The north half of the property is gently sloped cultivated fields and more likely to be
developed.
The current AG district is fairly restrictive, allowing only agricultural activity including
cultivation of field crops and the keeping of livestock. The CR district, by contrast, allows
32 uses including a broad spectrum of recreational activities, retail sales, restaurants,
laundry and carwash. Some of these uses, if developed on a 77 acre property, may be
intense and generate noise, activity, ball field lighting, traffic and demand on parking that
could impact adjacent residential properties. However, most of the adjacent residences,

save the three directly adjacent to the subject property along W. 32nd Street, are well
removed from the area likely to be developed. It is also important to note that intensive
agricultural activity including plowing, fertilizing, spraying, harvesting and livestock
operations can produce their own impacts on adjacent residential properties.
The three residential properties along W. 32nd Street most affected by the proposed zoning
change have relatively level ground along their side yards that could potentially be
commercially developed if the rezoning were to be approved. It is possible to reduce the
area to be rezoned to protect the side yards of these properties with very little impact on
the proposed recreational development area.
If the rezoning is approved, subsequent development of the subject property would require
submittal of a site plan detailing all proposed grading, erosion control and storm water
management measures, proposed access(es), paved parking lot configurations,
landscaping and green space plans. Access to the site can potentially be taken from W.
32nd Street and the Northwest Arterial. However, access from the Northwest Arterial must
be approved by the Iowa Department of Transportation and the City Council. This approval
has not been sought or approved at this point. Such access approval is not assured.
Staff recommends that the Commission consider reducing the area to be rezoned to
protect the residential properties at 1801, 1901 and 1951 W. 32nd Street.
Staff recommends the Commission review Article 9-5 of the Unified Development Code
regarding reclassification of property.

ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER

ROAD INTERSECTION FROM AG AGRICULTURAL DISTRICT TO CR COMMERCIAL
RECREATION DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter—described property
from AG Agricultural District to CR Commercial Recreation District, to wit:
As shown in Exhibit A, and to the centerline of the adjoining public right-of-way, all in
the City of Dubuque, Iowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication as
provided by law.

Kevin, I am contacting you with this e-mail to comment about an issue that the Zoning Advisory Board
will be discussing at their meeting this coming Wednesday evening.The proposed zoning issue is the
baseball complex located between West 32nd Street and the NW Arterial. First of all, I am a supporter of
baseball, and I have no objection to the fields being built on the Gantz's property. However,there is one
BIG concern regarding traffic on West 32nd Street. Based on initial discussions with neighbors,the area
where the ingress and egress is slated to be located is troublesome, I find it hard to believe that the
proper(and safe)sight distances can be achieved. Homeowners in the affected area already face
challenges pulling into/out of their driveways. If you add-in the traffic from the baseball fields, it will
make a difficult traffic situation much worse. Then if you consider that simultaneously you could also
have events at the nearby soccer complex,the Marshall park/Arboretum and "spring planting" crowds
at Steve's Ace Hardware,we would have a potentially dangerous traffic situation.As a citizen, I wanted
to express my concerns on behalf of my family and my neighbors in the northwest portion of Dubuque's
2nd Ward.Thank you and please forward my concerns to the Zoning Advisory board members, City
Council members and Mayor Buol.Thank you for your anticipated cooperation and please do not

In light of the recent vote of our rezoning request before the Dubuque Advisory Commission
(DAC), we kindly ask the Dubuque City Council to send our application back to DAC for
reconsideration.
As a result of the discussion held at the DAC public hearing, we would like to present new
information that will clarify our plans which we feel will mitigate much of the concerns
expressed by some Dubuque residents and the DAC member. In addition, we would appreciate
the opportunity to present our request to the full Commission.
While we understand this will delay our appearance and request before City Council, we would
rather explain and present our new information so that not only will the Dubuque Advisory
Committee have the most up-to-date information, but also the citizens of Dubuque whom we
hope will support our application.
