The Federal Emergency Management Agency (FEMA) has been notified that the Dubuque
County Historical Society and the City of Dubuque have applied for 404 permits fi:om the Corps
of Engineers. Please-refer to the enclosed Public Notice.
Your community is participating in the National Flood Insurance Program. Activities described
in the enclosed Public Notice are under the purview of your community and should be reviewed
to determine whether or not they meet the minimum requirements of your community's
floodplain management regulations prior to a commencement of construction/development
activity. You should refer to your community's floodplain management ordinance for the
definition of development.
If the above developments are located within the floodway, the community must obtain a "no-
rise" certificate/statement as to the effects of possible flooding before these developments are
pm'mitted by the commtmity. This analysis must be performed by a licensed engineer as required
by your floodplain management ordinance.

.2~ Project Location. Mississippi River, right bank, approximate dyer mile 579.2, in Section 25, Township 89 Nodh, Range 2 East, and
in Section 30, Township 89 North, Range 3 East, in Dubuque, Dubuque County, Ibwa.
3. Project Descfipiton. The applicants pr'(~pose to construct a wetland, perform dredging operations, construct boat docks, and
construct an access mad on and adjacent to the Mississippi River. The applicants' stated purpose of the project is to perform the
above construction activities as part of the Mississippi River Discovery Center Museum Project exhibits and amenities within the
Dubuque Ice Harbor. Appmximataiy 30,500 cubic yards of clay-type matadal will be mechanically excavated from an area
approximately 450 feet long and varying in width from 185 to 300 feet. The excavated material will be loaded into a barge or trucks and
disposed of in two previously used upland disposal sites. Sand type matarial either hydraulically dredged from within the ice harbor or
trucked in from a land source will be placed to form a berm for the wetland creation site and for the base matafial for the wetland.
Appmximataly 29,000 cubic yards of sand will be utilized. Ceo-textile fabric and layers of gravel and stone dprap wilt be placed on the
· dverward slope of the berm to prevent erosion. A minimum 3.0-foot-thick layer of clay will be placed to seal the wetland area and
embankment. Subsoil and topsoil wilt then be placed to establish final design grades and wetland plantings will be installed. Wooden
boardwalks and two independent segments of floating boat docks will be attached to the berm and shoreline to allow museum visitors
access to the wetland and museum exhibits. An access roadway will be constructed _along the bank line of the ica harbor to facilitate
access past the wetland exhibit. A concrete retaining wall will be installed to stabilize the roadway and bank line. An existing storm
water discharge headwall will be extended through the wetland and into the ice harbor. A boat-launching exhibit will be constructed
along the bank line. The exhibit wilt require the excavation of clay type matedal and He placement of geo-taxtile fabric, gravel, riprap,
and heavy timber ways. A crane rail track will also be constructed at this location. Dudng the construction activities of this museum
complex, the existing William M. Black dredge boat will be temporarily moored at a different location within the ice harbor before being
permanently moored to the wetland berm and shoreline.
4. Agency Review.
a. Department of the Army, Corps of Engineers. The Department of the Army application is being processed under the provisions of
Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344).
b. State of Iowa, The project plans have been submitted to the Iowa Department of Natural Resources for state certification of the
proposed work in accordance with Section 401 of the Clean Water Act. The certification, if iesued, will express the Department's
opinion that the proposed activity will comply with Iowa's water quality standards (Chapter 61 lAC). The applicant has also applied for
authorization of work in the floodplain pursuant to Chapter 455B of the Iowa Code and other applicable state permits, Written
comments conceminq possible impacts to waters of Iowa should be addressed to: iowa Department of Natural Resources,
900 East Grand Avenue, Des Moines, Iowa 50319. A copy of the comments should be provided to the Corps of Engineers office (see
paragraph f 1. of this public notice for address).
5, Historical/Archaeological. A Memorandum of Agreement (MOA) between the Federal Highway Administration, the U.S. Fish and
Wildlife Service, the U.S. Army Corps of Engineers, the National Endowment for the Humanities, the City of Dubuque, the Dubuque
County Historical Society, the iowa Department of Transportation, and the Iowa State Historic Preservation Office has been prepared
mitigation of adverse effects under the subject permit action for the City of Dubuque's River Discovery Center project which has histodc
properties eligible for inclusion in the National Register of Histodc Place. Execution of the MOA and its filing with the Advisory Councit
on Historic Preservation [36 CFR 800.6(b)(1)(iv)] has been completed and documents the District's compliance with Section 106 of the
National Historic Preservation Act.
6. Endangered Species. District staff have performed a preliminary review of this application for the potential impact on threatened or
endangered species pursuant to Section 7 of the Endangered Species Act as amended. Our preliminary determination is that the
proposed activity is not likely to adversely affect any listed species or critical habitat. Therefore, no formal consultation has been
initiated with the United States Fish and Wildlife Service at this time. However, this preliminary determination is subject to change
should further information become available.
7. Dredge/Fill Material Guidelines. The evaluation of the impact of the proposed activity on the public interest will also include
application of the guidelines promulgated by the Administrator of the United States Environmental Protection Agency under authority of
Section 404(b} of the Clean Water Act (40 CFR Part 230).
8. Public Interest Review. The decision whether to issue the Corps permit will be based on an evaluation of the probable impact
including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which reasonably may be expected to' accrue from the proposal must be
balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, sesthetics, general environmental concerns, wetlands,
cultural values, fish and witdlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion,
recreation, water supply and conservation, water quality, energy needs, safety, food production and, in general, the needs and welfare
df the people.
9. Who Should Reply. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials;
Indian Tdbes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments
received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on endangered species, histodc properties, water quality,
general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an
Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments
are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. These
statements should be submitted on or before the expiration date specified at the top of page 1. 'Cnese statements should bear upon the
adequacy of plans and suitability of locations and should, if appropdate, suggest any changes considered desirable.
10. Public Headng Requests. Any person may request, in writing, within the comment period specified in this notice, that a public
headng be held to consider this application. Requests for public hearings shall state, with particularity, the reasons for holding a public
hearing. A request may be denied if substantive reasons for holding a headng are not provided.
