SUBJECT: Acceptance of Lot D of Stone Brook Center Second Addition
DATE: June 22, 2016
City Engineer Gus Psihoyos recommends City Council approval of a Resolution
accepting the dedication of Lot D of Stone Brook Center Second Addition to the City of
Dubuque, Iowa. This lot is currently being used as a storm water detention basin to be
owned and maintained by the City. A portion of this lot is also required for the
construction of the Southwest Arterial, and acceptance of the lot was a condition of a
recent purchase agreement with NEZTROP LLC.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of Lot D of Stone Brook Center
Second Addition in the City of Dubuque, Iowa. This lot is currently being used as a storm
water detention basin to be owned and maintained by the City.
BACKGROUND
The final plat of the Stone Brook Center Second Addition dedicated streets (Lots A and B) and
a storm water detention lot (Lot D). The resolution approving the plat and plans included the
acceptance of all dedicated lots except for Lot D.
DISCUSSION
The approval resolution should have included the acceptance of said storm water detention lot,
Lot D. The dedication of the storm water detention lot should be accepted by resolution to
formally transfer title to the City of Dubuque. A portion of this lot is also a required for the
construction of the Southwest arterial project, and the acceptance of the lot was a condition of
a recent purchase agreement with NEZTROP LLC.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the dedication of Lot D of Stone
Brook Center Second Addition.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the dedication of Lot
D in Stone Brook Center Second Addition.

RESOLUTION NO. 256-16
ACCEPTING LOT D IN STONE BROOK CENTER SECOND ADDITION, IN
THE CITY OF DUBUQUE, IOWA
Whereas, Lots A (Stone Valley Drive), Lot B (Boulder Brook Court), and
Lot D (Detention Area), of the Final Plat of Stone Brook Center Second Addition
in the City of Dubuque, Iowa, recorded as Instrument No. 4087-04 in the records
of the Dubuque County Recorder, were dedicated to the public for the described
purposes; and
Whereas, Pursuant to Resolution No. 61-04, Lots A (Stone Valley Drive)
and Lot B (Boulder Brook Court) of the Final Plat of Stone Brook Center Second
Addition in the City of Dubuque, Iowa were accepted by the City of Dubuque for
the described purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That. the City of Dubuque wishes to now accept the dedication
of Lot D of the Final Plat of Stone Brook Center Second Addition. The existing
storm water detention facilities serving the subdivision, which are to be owned
and maintained by the City, are located on said Lot D
Secton 2. That the dedication of Lot D of the Final Plat of Stone Brook
Center Second Addition in the City of Dubuque, Iowa, from NEZTROP LLC, is
hereby accepted.
Passed, adopted and approved this 5th day of July, 20f/1.
