Maintenance of the facility shall be the responsibility of the City, which will assess said costs to the property owners in Stone Brook Center Second Addition. FROM: Gus Psihoyos, City Engineer:_, DATE: June 9, 2016 SUBJECT: Acceptance of Storm Water Detention Facility in Stone Brook Center Second Addition INTRODUCTION The enclosed material provides for City Council acceptance of the storm water detention facility that the developer, NEZTROP LLC, has completed and is dedicating in Stone Brook Center Second Addition in the City of Dubuque, Iowa. BACKGROUND As a condition of subdivision plat approval through Resolution No. 61-04, the developer of Stone Brook Center Second Addition was required to install certain improvements including storm water detention facilities and to dedicate these improvements to the City upon completion. All public improvements, except the detention facilities, were accepted on December 15, 2008 by Resolution No. 426-08 for Stone Brook Center Second Addition. DISCUSSION The Subdivision Ordinance requires that upon completion of the required public improvements, the developer shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. The acceptance of the storm water detention facility was a condition of a recent Southwest Arterial Project purchase agreement with NEZTROP LLC. Upon inspection by the City, it has been determined that all the detention facilities required by Resolution No. 61-04 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. Maintenance of the detention facility would become the responsibility of the City with the costs for same being assessed to the property owners within Stone Brook Center Second Addition. RECOMMENDATION I I would, therefore, recommend that the City Council accept the storm water detention facility in Stone Brook Center Second Addition. Maintenance of the facility will be the responsibility of the City which will assess said costs to the property owners in Stone Brook Center Second Addition. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the storm water detention facility in Stone Brook Center Second Addition. That the recommendation of the City Manager be approved and that said storm water detention facilities in Stone Brook Center Second Addition in the City of Dubuque, Iowa, be and the same is hereby accepted. Section 4. That the City waives the requirement that the developer maintain the detention facility until 80% of the Tots in Stone Brook Center Second Addition are developed and that maintenance of said improvements shall be the responsibility of the City and assessable to the property owners as outlined in Resolution Numbers 61-04.
