City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the 2015 Sewershed 7 & 20 Manhole Replacement Project, as
completed by Top Grade Excavating, Inc., in the final contract amount of$150,096.07,
which is an 11.6% decrease from the original contract amount of$167,468.00.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the 2015 Sewershed 7 & 20 Manhole Replacement Project.
BACKGROUND
The City of Dubuque, Iowa has entered into a Consent Decree in the case of The
United States of America, and the State of Iowa v. The City of Dubuque, Iowa, Civil
Action No. Case 2:11-cv-01011-EMJ, Civil Action Number 2008V00041, DOJ Case
Number 90-5-1-1-09339, United States District Court for the Northern District of Iowa.
The provisions of the Consent Decree apply to and are binding upon the City and its
officers, directors, employees, agents, servants, successors, assigns, and all persons,
firms and corporations under contract with the City to perform the obligations of the
Consent Decree. The City is actively rehabilitating brick manholes and sanitary sewer
pipes that were identified in the plan to be deficient.
DISCUSSION
The 2015 Sewershed 7 & 20 Manhole Replacement Project was completed by Top
Grade Excavating, Inc., of Farley, Iowa, in the final contract amount of $150,096.07
which is an 11.6% decrease from the original contract amount of$167,468.00.
The project involved the replacement of 14 sanitary sewer manholes and the elimination
of 2 sewer manholes at different locations within Sewershed 7. Portions of some water
mains were relocated as part of this project due to the replacement of the manholes.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $150,096.07 to Top Grade Excavating, Inc., for the 2015
Sewershed 7 & 10 Manhole Replacement Project.

REQUESTED ACTION

Project.

RESOLUTION NO. 258-16
ACCEPTING THE 2015 SEWERSHED 7 & 20 MANHOLE REPLACEMENT PROJECT
AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the 2015 Sewershed 7 & 20
Manhole Replacement Project (the Project) has been completed by the Contractor, Top
Grade Excavating, Inc. (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $150,096.07;
WHEREAS, the Contractor has previously been paid $142,591.27, leaving a
balance of $7,504.80; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $7,504.80 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
