The agreement includes attachment of the City Council Goals and Priorities. Background The Fiscal Year 2017 budget recommends an allocation of $30,000 in Community Development Block Grant (CDBG) and $72,706 in General Funds for Purchase of Services activities. During the budget process, $10,000 CDBG was allocated to Four Mounds HEART Program. The remaining $92,706 was available for competition. At the June 20th, 2016 meeting, City Council approved the Community Development Advisory Commission recommendation to fund My GEAR Outreach in the amount of $21500. Discussion The grant application states, "My GEAR Outreach provides hope and comfort for children entering foster care for the first time by providing them with an overnight bag full of items they may need while in foster care. By providing these items for children, we are removing at least one burden they no longer have to worry about." Requested Action I respectfully request the City Council approve the attached Purchase of Services Agreement with My GEAR Outreach and authorize the Mayor to execute the agreement on behalf of the City. Program/Service While working in social work and interacting with foster Information (limited to children; the founder of My Gear saw a need that was not 2,500 characters) being met. We noticed that when children are removed from their home and placed in foster care they are often unable to bring their belongings with them. The foster home many of the time did not have what they needed on hand. As a social worker, we have seen how terrifying and scary being placed in a foster home can be. My GEAR Outreach provides hope and comfort for children entering foster care for the first time by providing them with an overnight bag full of items they may need while in foster care. By providing these items for children, we are removing at least one burden they no longer have to worry about. This stressful event of moving to an unfamiliar home with unknown caregivers can have life long impacts for children. The bags include a welcome box that supplies the following: toothpaste, toothbrushes, comb, liquid bath soap, washcloth, night light, deodorant, shampoo and conditioner. The over night bags includes: new pajamas, new shorts, a My GEAR t-shirt, new socks, new underwear, new pillow, new blanket, age appropriate, journals, coloring books, crayons, pens, makeup, balls, and stuffed animal. Infant bags include diapers, baby wipes, Destin, thermometer, formula, sleeper, receiving blankets, washcloths, baby soap, baby lotion, socks, baby toys, baby comb and brush and stuffed animals. On average, children are placed in two foster homes before moving to their forever home. The children are able to bring their My GEAR bag with them to each new foster home. The bags also relieve stress from the foster family. A foster family may be given very limited notice prior to receiving a child in their home, leaving them unable to acquire items that may be needed by the child. These bags not only help the children but also the foster care parents. Around 50 children from the city of Dubuque enter foster care each year. Entering foster care can happen suddenly, leaving the child no time to bring their belongings. The bags ensure the infants have the formula and diapers they need, school aged children have clothes so they don't have to go to school in the same outfit, as well as toys and other items to bring them comfort in their difficult transition. My GEAR seeks to aid in their success and provide them with hope and comfort. My GEAR is the only organization that provides this service to disadvantaged youth. Briefly describe your My GEAR Outreach is non-profit committed to bringing comfort organization, its mission and hope to children during the tough transition of entering and goals, and additional foster care for the first time. We carry out this mission by services provided. providing security through welcome boxes and first overnight bags to meet basic needs. My GEAR Outreach started Clinton County in October 1st, 2015. We expanded in to Jackson County in November and to Dubuque County in March, 2016. My GEAR is working on expanding into Scott County next. Since My GEAR has started, we have given out 39 bags in Clinton County, 8 bags in Jackson County and 8 bags in Dubuque County. My GEAR is able to provide these bags because of wonderful donations from major manufacturing companies, small business, churches and individuals in the community. My GEAR Outreach future goals are not only to meet the most basic need of the foster child entering foster care, but also meet the basic needs of the foster family so they may take care of that child to the best of their ability immediately. My GEAR would do this by providing new car seats, cribs, highchairs or any other equipment needed by that child. 3. My Gear was founded based off an unmet need in the community. Children in foster care are considered at risk and disadvantaged. When children are placed in foster care it is often after experiencing challenging events. The reasons children are removed from their homes can very from neglect, witness of domestic violence, physical abuse, parental drug use or mental illness. Experiencing these traumatic events often hinders the child's development, hindering their ability to develop skills, learn new information and interact in social settings. My Gear aims to send the message to children who have been abused, witnessed abuse, and/or have been neglected that the community has not forgotten or neglected them. We aim to give them a since of normalcy and belonging so they can successfully move through the foster care system with confidence. According to national statistics there are half a million foster kids in America. Everyday 1,600 children enter the system with whatever they can fit in two garbage bags. These children often leave everything behind and enter foster care with no family, no friends, no support, just what they can fit in two garbage bags. In Jackson county 40 children enter foster care for the first time every year. Once in the system the average child moves homes 2 to 3 times. Moving to a new home is difficult enough for children. My Gear believes no child should have to move from home to home with their belongings in a trash bag. My GEAR has partnered with local business including but not limited to : NelsonCorp Management, and DCAT of Dubuque County to make sure that all children in Jackson county that enter foster care for the first time will be able to receive a My GEAR bag. My GEAR wants to know that every Jackson County foster child feels that they are supported and loved by their community. 4. My GEAR then assembles the bags and deliver them to the agency who then delivers them to the children. 5. Researchers estimate that 30%to 80% of children in foster care exhibit emotional and/or behavioral problems, either from their experiences before entering foster care or from the foster care experience itself." Based on studies examining the young adults who were in foster care as children tells us that that children who remained in foster care appeared to have greater feelings of insecurity. Moreover, many youths leaving foster care end up in jail or on public assistance, or otherwise represent an economic cost to the community. A study of employment outcomes for youths aging out of foster care found that many were underemployed and progressing more slowly in the labor market than other low-income youths, and only half had any earnings in the two years after aging out of care. WHEREAS, City proposes to provide certain financial assistance to enable Agency to provide public services that meet the identified goals and priorities as identified by the City Council; and WHEREAS, City has deemed it to be in the public interest to provide financial assistance in the form of a Purchase of Services Grant to be used to cover general operating expenses of Agency's program. NOW THEREFORE, the parties hereto agree as follows: 1. Scope of Service Agency shall provide overnight bags with supplies to children entering the foster care system. The project aligns with the City's goals and priorities as described in the Purchase of Services Grant Application. The City Council goals and priorities are attached hereto as Exhibit A. 2. City Responsibilities City designates the Housing and Community Development Director to act as its representative with respect to the work to be performed under this Agreement, and such person shall have authority to transmit instructions, receive information, interpret and define City's policies and provide decisions in a timely manner pertinent to the work covered by this Agreement until Agency has been advised in writing by City that such authority has been revoked. 3. Time of Performance The term of this Agreement shall be from July 1, 2016 through June 30, 2017. 4. Compensation City shall pay Agency $2,500 as compensation for the services provided by Agency, which payment shall constitute full and complete compensation for such services. The compensation shall be paid by City to Agency within ten (10) business days after receipt by City of a requisition for such sum from Agency. 5. Audit and Evaluation Inasmuch as the funds to be provided to Agency by City are public funds, the Agency agrees that it will maintain books of account in accordance with Generally Accepted Accounting Standards together with necessary documentation to support all expenditures. The records of Agency, including payroll accounts and other records of disbursements and receipts, and other records relating to the performance of the activities herein specified, shall be made available for inspection by City or any Certified Public Accountant acting on its behalf, in order to ascertain performance of Agency under this Agreement. Agency agrees to retain such records for not less than three (3) years. 6. Reporting and Monitoring Agency shall render to the Housing and Community Development Director a quarterly report detailing its activities related to the use of City funds provided to Agency. Such report shall include a performance report on the program(s) supported by City funds and a financial report on the use of City funds, which shall be rendered no later than the fourth Thursday October, January, April, July. A written annual report shall be submitted to the City Council within sixty (60) days of year end. The annual report shall include a performance report on the program(s) supported by City funds and a financial report on the use of City funds. If Agency has an annual audit performed, Agency shall provide City a copy of the annual audit report within three months of year-end. 7. Discrimination In carrying the services under this Agreement, Agency shall not discriminate against any employee or applicant for employment because of race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. Agency shall take affirmative action to ensure that applicants for employment are employed and that employees are treated during employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. Agency assures that all qualified applicants will receive consideration for employment without regard to race, creed, color, sex, age, national origin, religion, sexual orientation, gender identity, or disability. Agency agrees and will undertake whatever affirmative measures are necessary so that no person shall be excluded from participation in, be denied the benefits of, or be subjected to 2 discrimination under any program or activities funded in whole or in part with any of the funds made available to Agency under the terms of this Agreement because of race, color, creed, religion, sex, national origin, age, sexual orientation, gender identity or disability. 8. Termination of Agreement If, through any cause, Agency shall fail to fulfill in a timely and proper manner its obligations under this Agreement, or if the Agency shall violate any of the covenants, agreements or stipulations of this Agreement, City shall thereupon have the right to terminate this Agreement by giving written notice to Corporation of such and specifying the effective date thereof not less than thirty days before the effective date of such termination. If Agency shall fail to cure its default to the satisfaction of City in City's sole discretion within such thirty day period, this Agreement shall be deemed terminated at the end of such thirty day period without further action of either party. Upon termination of this Agreement, Agency shall return to City all unexpended funds and/or any funds utilized for purposes other than stated in the Agreement. 9. Assignability Agency shall not assign any interest in this Agreement without the prior written approval from of City. 10. Insurance At the time of execution of this Agreement by Agency, Agency shall provide the City copies of Agency's insurance certificates showing general liability, automobile liability, and workers compensation insurance coverage to the satisfaction of City for the term of this Agreement.
