Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager SUBJECT: Alliant Energy Lease: City Annexation Request —Set for Public Hearing DATE: June 29, 2016 INTRODUCTION This memorandum transmits a 100% voluntary annexation request for City Council to set for public hearing. The request is being filed by the City Manager for approximately 21.14 acres of property owned by the City of Dubuque. The annexation territory will be leased to Alliant Energy. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory is part of the City's newly acquired land near the Dubuque Industrial Center West north of Humke Road and west of Seippel Road. Alliant Energy is collaborating with the City of Dubuque and the Greater Dubuque Development Corporation to lease the 21- acre parcel for a new solar energy site. The annexation territory is part of Subarea F in the Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District Urban Renewal Area as shown on the enclosed map. Platting the land is not required for annexation, but a "metes and bounds" legal description of the boundaries of the annexation territory is necessary to satisfy Dubuque County and State of Iowa requirements for annexation. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury and the City of Centralia. RECOMMENDATION Staff recommends the City Council approve the resolution to set the public hearing on the City annexation request for August 1, 2016. This date will provide adequate time to complete the notifications, certified mailings, and newspaper publication required by Iowa Code. Norman Place" in Section 25, Center Township, Dubuque County, Iowa, according to the plat thereof, as shown on Exhibits A and B and legally described in Exhibit C; and Whereas, the annexation territory is not subject to an existing annexation moratorium agreement and does not include any State or railroad property; and Whereas, the annexation territory does not abut or include Dubuque County right-of- way; and Whereas, Iowa Code section 368.7 authorizes the extension of City limits in situations of this character by adoption of a resolution after notification and public hearing; and Whereas, this annexation is consistent with the City's Comprehensive Plan; and Whereas, the City of Dubuque has the capacity to provide substantial municipal services to the annexation territory; and Whereas, the annexation is in the public interest.
