Van Milligen, City Manager SUBJECT: NW Arterial Fiber Optics —JFK to US 52 Project CI P 3001133, 3001266 and 3002144 DATE: August 5, 2016 City Engineer Gus Psihoyos is recommending acceptance of the construction contract for the NW Arterial Fiber Optics —JFK to US 52 Project, as completed by Portzen Construction, Inc., in the final contract amount of$92,572.50, which is a 19.99% decrease from the original contract amount of$115,697.50 due to the project being completed without rock sawing. BACKGROUND The NW Arterial Fiber Optics — JFK to US52 Project provided for the installation of Duraline Futurepath (7 way) Conduit along the south side of the NWA Arterial from JFK to US 52. This conduit will allow us to complete a fiber loop within the City of Dubuque. DISCUSSION The NW Arterial Fiber Optics — JFK to US52 Project was completed by Portzen Construction, Inc. of Dubuque, Iowa, in the final contract amount of$92,572.50. RECOMMENDATION I recommend that the City Council accept the improvements and establish the final contract in the amount of $92,572.50,which is a 19.99% decrease from the original contract amount of $115,697.50 due to the project being completed without rock sawing. BUDGET IMPACT The project cost summary for the NW Arterial Fiber Optics — JFK to US52 Project is as follows: Award Final Construction Contract $115,697.50 $ 92,572.50 Contingency 10,877.00 0.00 Total Project Cost $ 126.574.50 $ 92.572.50 The project funding summary is as follows: CIP No. Fund Description Fund Amount 3001133 Reconstruct Signals at JFK[Wacker $ 69,997.50 3001266 Traffic Signal Interconnect Conduit $ 22,575.00 Total Project Funding L2257 ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution to accept the improvements and to authorize the payment of the contract amount of$92,572.50 to Portzen Construction, Inc. for the NW Arterial Fiber Optics — JFK to US52 Project. cc: Jenny Larson, Budget Director David Ness, Civil Engineer II Duane Richter, EIT 2 RESOLUTION NO. 299-16 ACCEPTING THE NW ARTERIAL FIBER OPTICS - JFK TO US 52 PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the NW Arterial Fiber Optics — JFK to US 52 Project (the Project) has been completed and the City Engineer has examined the work and filed a certificate stating that the Project has been completed according to the terms of the Public Improvement Contract and that the City Engineer recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $150,096.07; WHEREAS, the Contractor has previously been paid $150,096.07; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the NW Arterial Fiber Optics — JFK to US 52 Project fund for the contract amount of $92,572.50 Tess any retained percentage provided for therein as provided in Iowa Code chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
