Van Milligen, City Manager SUBJECT: FY16 Sewershed 7, 11 and 12 Sanitary Sewer Manhole Project (CIP 7101335) DATE: August 8, 2016 City Engineer Gus Psihoyos is recommending acceptance of the public improvement construction contract for the FY16 Sewershed 7, 11 and 12 Sanitary Sewer Manhole Project, as completed by Connolly Construction, Inc., in the final contract amount of $150,819.25, which is a 36.77% increase from the original contract amount of $110,274.20. The cost increase was primary due to unsuitable backfill materials found during construction, and additional concrete and asphalt materials needed for street patches. Also, there were seven additional service laterals near the excavations that needed to be replaced. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer v DATE: August 4, 2016 RE: FY16 Sewershed 7, 11 and 12 Sanitary Sewer Manhole Project (CIP 7101335) INTRODUCTION The enclosed resolution provides for the acceptance of the public improvement construction contract for the FY16 Sewershed 7, 11 and 12 Sanitary Sewer Manhole Project. BACKGROUND The City of Dubuque, Iowa is under a Consent Decree according to Case 2:11-cv-01001-EJM, United States of America and the State of Iowa v. the City of Dubuque, IA (N.D. Iowa), Civil Action Number 2008V00041, DOJ Case Number 90-5-1-1-09339 effective June 27, 2011. The City is required to submit Corrective Action plans for each of the Sanitary Sewersheds identified in the Consent Decree. The FY2016 budget appropriated funds for sanitary sewer manhole improvements in the Consent Decree Correction Action Plan. DISCUSSION The 2016 Sewershed 7, 11 and 12 Manhole Replacement Project was completed by Connolly Construction, Inc. of Peosta, Iowa, in the final contract amount of $150,819.25 which is a 36.77% increase from the original contract amount of $110,274.20. (Contractor), the City Engineer has examined the work and recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $150,819.25; WHEREAS, the Contractor has previously been paid $143,278.28, leaving a balance of $7,540.96; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $7,540,96 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
