Housing Commission Three, 3 year terms through August 17, 2019 (Expiring Term of Heimke, Schwendinger, Wall) Applicants: Wesley Heimke, 2350 Knob Hill Dr. Dorothy Schwendinger, 3390 Windsor Ave. David Wall, 333 W. 17th St. Mechanical and Plumbing Code Board One, 3 year term through March 16, 2019 (Expired term of Papin) Applicant: Paul Papin, 2955 Jackson Title 2 J Chapter 5 Article B HOUSING COMMISSION Amendment Adopted 10-19-15 Amendment Adopted 12-07-15 2-513-1: COMMISSION CREATED: There is hereby created the Housing Commission. 2-513-2: PURPOSE: The purpose of the commission is to undertake and carry out studies and analysis of I housing needs and the meeting of such needs; to recommend proposed projects in the area of low- and moderate-income housing for the citizens of the city; to monitor the city's housing programs; and to conduct grievances regarding the Rental Assistance Program, except in the area of Housing Code enforcement. 2-513-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with this Code of Ordinances or the Iowa Code. j 2-513-4: PROCEDURES FOR OPERATION: All administrative, personnel, accounting, budgetary, and procurement policies of the city govern the commission in all its operations. 2-513-5: MEMBERSHIP: A. The commission comprises ten (10) residents of the city. !� I B. Residents must be eighteen (18) years of age or older. j II C. Special Qualifications. 1. At least three (3) members must be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds management, or other related areas of expertise. 2. One (1) member must be a person who is a recipient of tenant based rental assistance under Section 8 of the United States Housing Act of 1937 whose name appears on a lease of Section 8 property. If such member ceases to be a recipient of rental assistance under Section 8, the term of such member is deemed terminated and a new member who meets the requirements of this Subsection must be appointed for the remainder of the term. 3. One (1) member must be appointed by the commission, with city council approval, to serve on the Community Development Advisory Commission. s R 4. Two (2) members must be appointed by the commission, with city council approval, to serve on the Housing Trust Fund Advisory Committee. 5. The remaining members are at-large members. I �I 2-5113-6: OATH: Each person, upon appointment or reappointment to the commission, must execute an oath of office at the first meeting of the commission following the appointment or reappointment or at the city clerk's office any time prior to the first meeting of the commission. 2-5113-7: TERMS: The term of office for commissioners is three (3) years or until such commissioner's successor is appointed and qualified. The terms of the cross-representative appointees to the Community Development Advisory Commission and the Housing Trust Fund Advisory Commission must coincide with their terms on the Housing Commission. j 2-5113-8: VACANCIES: Vacancies must be filled in the same manner as original appointments. i 2-513-9: OFFICERS/ORGANIZATION: The commissioners must choose annually a chairperson and vice-chairperson, each to serve a term of one (1) year. The chairperson must appoint a secretary, who need not be a member of the commission. The commissioners must fill a vacancy among its officers for the remainder of the officer's unexpired term. 2-513-10: MEETINGS: A. Regular Meetings. The commission must meet monthly. B. Special Meetings. Special meetings may be called by the chairperson or at the written request of a majority of the commissioners. C. Open Meetings. All meetings must be called and held in conformance with the Iowa Open Meetings Law. D. Attendance. 1. In the event a commissioner has been absent for three (3) or more consecutive meetings of the commission, without being excused by the chairperson, such absence will be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. 2. Attendance must be entered upon the minutes of all meetings. 3 E. Minutes. A copy of the minutes of all regular and special meetings of the { commission must be filed with the city council within ten (10) working days after each meeting, or by the next regularly scheduled city council meeting, whichever 1 is later. F. Quorum. Six (6) commissioners constitute a quorum for the transaction of business. The affirmative vote of a majority of the commissioners present and voting is necessary for the adoption of any motion or resolution. 1 2-513-11: COMPENSATION: 1 Commissioners serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and budget. 2-513-12: REMOVAL: l Except as provided in 2-5B-10(D)(1), the city council may remove any commissioner for good cause. ,f i 2-513-13: POWERS: The commission has the following powers, duties, and responsibilities: A. To conduct public hearings to ensure meaningful citizen input in the planning, implementation, and assessment of the city's housing programs; C. To provide for and encourage the participation of low and moderate income persons in the planning, implementation, and assessment of housing programs; h D. To provide input into the community planning process and to assist in s' accomplishing a coordinated and consistent housing development program of the city in accordance with present and future housing needs; E. To request and review ongoing surveys assessing housing needs and identifying future community housing needs, particularly the needs of persons of low and moderate income; F. To support the efforts of the city council and other city commissions in the assessment of the general housing needs of the community; G. To undertake from time to time other specific ongoing housing planning which may be referred to it by the city council; H. To research and recommend to the city council policies and programs facilitating the development of affordable housing; f I. To undertake public information efforts to educate citizens of the availability of federal, state, and locally funded housing assistance programs; J. To assist in the preparation of the housing element of the city comprehensive plan and the annual consolidated plan; K. To offer comment, as appropriate, on the consistency of proposed housing development with the comprehensive plan, consolidated plan, and existing city housing strategies; and L. Board Created: In order to hear and decide appeals of orders, decisions, or determinations made by the code official relative to the application and interpretation of this code, there shall be and is hereby created a Mechanical and Plumbing Code Board. The Mechanical and Plumbing Code Board shall be appointed by the City Council and shall hold office at its pleasure. B. Membership: The Mechanical and Plumbing Code Board shall consist of seven (7) residents of the city, appointed by the City Council for a term of three (3) years or until such member's successor is appointed and qualified. Vacancies must be filled in the same h manner as original appointments. 1. Special Qualifications. The Mechanical and Plumbing Code Board shall consist of seven (7) individuals eighteen (18) years of age or older, from each of the following professions or disciplines: 'i a. Two (2) at-large members; b. Five (5) members who possess a minimum of one of the following requirements: minimum of five (5) years working experience in the plumbing or mechanical trade, hold a state certification as a mechanical or plumbing contractor, licensed mechanical or hydraulic engineer, or any combination thereof. { I C. Oath: Each person, upon appointment or reappointment to the board, must execute an oath of office at the first meeting of the board following appointment or reappointment or at the city clerk's office any time prior to the first meeting of the board following the appointment or reappointment. D. Officers/Organization: The board must choose annually a chairperson and vice- chairperson, each to serve a term of one (1) year. The code official is the secretary of the board. The board must fill a vacancy among its officers for the remainder of the officer's unexpired term. E. Compensation: Members serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official board business within the limits established in the city administrative policies and budget. F. Disqualification of Member: A member shall not hear an appeal in which that member has a personal, professional, or financial interest. I i G. Application for Appeal: 1. Any person affected by a decision of the code official or a notice or order issued under this code shall have the right to appeal to the Mechanical and Plumbing Code Board, provided a written application for appeal is filed within twenty (20) days after the day the decision, notice, or order was served. 2. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equally good or better form of construction is proposed. H. Limitations on Authority(Board Powers): 1. The board has the following powers, duties, and responsibilities: a. To advise the city council on all mechanical and plumbing code regulations and procedures. b. To serve as an appeal body for the decisions of the code official or the j code official's designee. c. To provide for reasonable interpretations of the mechanical and 1 plumbing code. The Mechanical and Plumbing Code Board of Appeals does not have the authority to waive the requirements of this code. i; I. Notice of Meeting: The board shall meet upon notice from the chairman, within not less than ten (10) days and not more than sixty (60) days of the filing of an appeal, at stated periodic meetings, or at the written request of a majority of the members. 4 " J. Open Hearing: 1. Hearings before the board shall be open to the public and in compliance with l the provisions of the Iowa open meetings law. 2. The appellant, the appellant's representative, the code official, and any person whose interests are affected shall be given an opportunity to be heard. K. Hearing Procedure: 1. The board shall adopt and make available to the public through the secretary procedures under which a hearing will be conducted. The procedures shall not require compliance with strict rules of evidence, but shall mandate that only relevant information be received. 2. A quorum shall consist of a minimum of two-thirds (2/3) of the board membership. a j h 3. Members of the board shall attend at least two-thirds (2/3) of all regularly scheduled and held meetings within a twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that the member be replaced. The attendance of all members shall be entered upon the minutes of all meetings. 4. The code official shall file with the city council a copy of the minutes of each meeting of the board within ten (10) working days after each such meeting. 5. All administrative, personnel, accounting, budgetary, and procurement policies of the city shall govern the board in its operations. p 6. Removal: The city council may remove any member for cause upon written charges and after a public hearing. r{ I, L. Postponed Hearing: Either the city or the appellant may request a postponement of a hearing subject to the approval of the code official. In no event may a postponement exceed ninety (90) days I� beyond the date of the appeal i{ M. Board Decision on Appeals: The board may, by majority vote, affirm, modify, or reverse the decision of the code official. � N. Resolution: The decision of the board shall be by resolution. A written copy shall be furnished to the appellant and placed in city records. O. Administration: ti The code official shall take immediate action in accordance with the decision of the j board. P. Court Review: Any person, whether or not a previous party to the appeal, shall have the right to apply to the appropriate court for a writ of certiorari to correct errors of law. Application for review shall be made in the manner and time required by law following the filing of the decision in the office of the code official chief administrative officer. Q. Stays of Enforcement: Appeals of notice and orders (other than Imminent Danger notices) shall stay the enforcement of the notice and order until the appeal is heard by the appeals board. Section 4.
