Van Milligen, City Manager SUBJECT: Acceptance of Subdivision Improvements in Pebble Cove Subdivision and Pebble Cove #2 Subdivision DATE: August 29, 2016 City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developer, Kivlahan Farms L.C., has recently completed in Pebble Cove Subdivision and Pebble Cove #2 Subdivision. Maintenance of said improvements shall be the responsibility of the owner, Kivlahan Farms L.C., for a period of two years from the date of acceptance by City Council. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineed =t DATE: August 26, 2016 SUBJECT: Acceptance of Subdivision Improvements in Pebble Cove Subdivision and Pebble Cove # 2 Subdivision INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements that the developers, Kivlahan Farms L.C., have recently completed in Pebble Cove Subdivision and Pebble Cove # 2 Subdivision. BACKGROUND As a condition of subdivision plat approval through Resolution No. 171-08 and 172-08, the developer of Pebble Cove Subdivision and Pebble Cove # 2 Subdivision was required to install certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, street lighting, and storm water detention facilities and to dedicate said improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On August 26, 2016, the owners requested City's acceptance of the improvements in Pebble Cove Subdivision and Pebble Cove # 2 Subdivision. Upon inspection by the City, it has been determined that the public improvements required by Resolution 171- 08 and 172-08, except for storm water detention facilities, have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would, therefore, recommend that the City Council accept the public improvements, except for storm water detention facilities, as described above. Maintenance of said public improvements shall be the responsibility of the owners, Kivlahan Farms L.C., for a period of two (2) years from the date of acceptance by City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public improvements in Pebble Cove Subdivision and Pebble Cove #2 Subdivision. Brant Schueller, Water Department Kerry Leppert, Water Department Dean Mattoon, Engineering Assistant Denise Ihrig, Environmental Engineer John Klosterman, Operations and Maintenance Manager RESOLUTION NO. 310-16 ACCEPTING PUBLIC IMPROVEMENTS IN PEBBLE COVE SUBDIVISION AND PEBBLE COVE # 2 SUBDIVISION, IN THE CITY OF DUBUQUE, IOWA Whereas, pursuant to Resolutions 171-08 and 172-08, certain public improvements including street paving with curb, sanitary sewer main, water main, storm sewers and catch basins, street lighting, and storm water detention facilities were installed by the developer of Pebble Cove Subdivision and Pebble Cove # 2 Subdivision in the City of Dubuque, Iowa; and Whereas, the improvements, except for storm water detention facilities, have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in Pebble Cove Subdivision and Pebble Cove # 2 Subdivision, except for storm water detention facilities, be and the same is hereby accepted. Section 2. That maintenance of said public improvements shall be the responsibility of the owners, Kivlahan Farms L.C., for a period of two (2) years from the date of this resolution.
